Just so I understand, So when CBP questions things, she can explain it. If they accept it, it is good and she enters.
If they do not like her responses or explanation, what happens?
I have a elderly family member that has an active GC. Last time (and only time) they were in the USA was in 2018. Due to family circumstances and other events, they could not come back. They are planning to come back and this time actually stay.
The GC is still valid. Should they go through the SB-1 process or is there another process to ensure they can enter the country? They do not necessarily have any financial ties in the country - just familial.
I am the petitioner and sponsoring my foreign spouse who works abroad. We have been living abroad since we got married about 4 years ago. I did not work during this time but my husband did work. I have also not filed tax returns for these last 4 years.
We are in the process of providing civil and support documents to NVC.
When filling out the I-864 should I just state that I have not filed returns because I didn’t work (stay at home) and that our income was below the threshold? I’m not using my foreign spouse’s income.
We have a joint sponsor. Joint sponsor plans to complete I-864.
