Apparently, a petioner who had an I-751 petition adjudicated close to the timeframe of filing the N-400 application had the bio-metric requirement waived on account of having a still valid record from the recently-adjudicated I-751 petition.

Tough luck in your case. A shame it didn't work for you.

Actually, we were able to get an info pass appointment this morning with the local Application Support Center in Nashville, TN. The officer there was much better to speak with then the agents at the customer support center.

The officer stated that the biometrics are indeed valid for 15 months and we would not have to pay again. She stated a mistake was made on our case however it looks as though the mistake was caught and our case was forwarded to Memphis on 4-4-14. She stated our case would not have been sent to Memphis if the biometrics were not yet complete. She stated we should get a notice of interview very soon. She did e-mail the supervisor of the Memphis feild office while we were in her office to confirm that she was correct and also to make sure everything goes smooth for us moving forward. She said she would call us this afternoon after she recieved a reply to her e-mail.

I did ask if we had sent the payment in would it have delayed our case further, she stated it could have because there would then have been an overpayment on the application that would need to be corrected before the case moved forward.

Probably good that we picked this battle and didn't just pay the fee because we were told to do so.

Here's hoping we get a interview date soon and we can get this behind us.

I just got off the phone with the USCIS and I was told by the Supervisor that she does not have an explanation as to why we are being charged a second time and that we have no way to dispute this and we need to just do what you have been instructed to do..

I am a very proud American citizen; I served this country with honor and pride along the side of some very brave men and women of the 101st. I am blessed to have a beautiful Filipino wife and two beautiful sons, I just want my wife to be a citizen just as the three of us are. I can honestly say this is the first time in my life that I have been ashamed of this wonderful country. It is not fair that a US government agency has the power to tell a resident or a citizen that they have no voice and no recourse. We have consumer protection agencies in this country to protect residents and citizens from corporations treating us like this, but of course this does not apply to the government because these laws would not apply to them. Funny as one of the answers to a question given in the civics exam is that "no one is above the law".

Okay, so we made a mistake and filed our N-400 right after we moved from Ohio to TN and we did not meet our 3 months in District. We were told to withdraw our application and refile and pay the $595 application fee again. We were told by the USCIS officer at the interview that we would not have to pay for biometrics again. So we complied and sent in a new N-400 application and paid the $595 as instructed. Today we got this notice from the USCIS.

On March 28, 2014, we suspended processing of this case N400, APPLICATION FOR NATURALIZATION because the finger print fee submitted was incorrect. We have sent you a notice instructing you to submit the correct amount. Please submit the payment together with the notice as soon as possible. If you have not received this notice within 30 days from the March 28, 2014, call Customer Service at 1-800-375-5283 for further assistance.

We called custgomer service and the USCIS is not willing to wave the biometrics fee even though they were taken on 2-11-2014. They are less than 60 days old. We were told they were good for 15 months?? Another delay and more expense!!

I am sure everyone will jump down my throat again for complaining but this getting a little rediculious and expensive. I am sure if any one of you were in our shoes you would feel the same.

Keep your chin up, you will probably be okay. If you look at the instructions for the N-400 under Processing information it states the following:

Processing Information

Any Form N-400 that is not signed or accompanied by the

correct fee will be rejected. Any application that is not

completed in accordance with these instructions, is missing

pages or otherwise not executed in its entirety, or is not

accompanied by the required initial evidence may also be

rejected. If your Form N-400 is rejected, the form and any

fees will be returned to you and you will be notified why

the form is considered deficient. You may correct the

deficiency and resubmit Form N-400. An application or

petition is not considered properly filed until accepted by

USCIS.

Your application was accepted and should be considered properly filed. If the USCIS felt it was not properly filed it should have been sent back to you with an explanation on why the form was considered deficient.

Although that being said, I don't want to get your hopes ups as this section is not always accurate. We were told my wife's N-400 was not properly filed and she was told to withdraw her application at the interview and resubmit. So in our case the USCIS accepted our application but then decided at the interview stage that it had not been properly filed. The reason was that we had moved from Ohio to Tennessee in December and had not met the required 3 months in district requirement. Good news is we were able to file again immediately, bad news we are out an additional $595.00 application fee.

Check cashed, updating. Also updating biometrics, date is in Feb because of previously filed N-400, no biometrics required for this application.

Ok, so we sent the N-400 in again on Monday, March 24 after being told at the interview in Memphis on March 21 to withdraw the application filed in Jan 2014 as they stated it was not properly filed because we moved from Ohio to Tennessee in December and we had not lived at our current address for more than 3 months. The USCIS in Lewisville, TX received the application packet yesterday with a check for another $595.00. We don't have to pay the biometrics this time around.

A little bitter about the $595.00 penalty. Especially if you read the processing information section of the instructions. It states:

Looks like someone at the USCIS reviewing my application initially made a mistake just as I did in submitting. According the statement above my application should have been returned with fees with an explanation on why the form was deficient, if not it should be considered properly filed as it was accepted by the USCIS.

I did include a cover letter with my application addressed to the USCIS Supervisor pointing out the above and requesting his or her kind consideration of waiving the second fee. I am sure nothing will come of it, but shouldn't hurt to try.

Here's hoping we can get through the entire process this time around.

General Eligibility Requirement #3 clearly states that you must have resided in the jurisdiction from which you are applying for 3 months before you are able to submit your N-400.

Hypnos, I am usually very good at reading the instructions. In fact your response actually made me feel like a complete idiot. Not really what I am use to on this site. I immediately looked up the instructions and could not believe I would miss a requirement outlined as it currently is. I went back and pulled all the copies I had of the application I filed. The available application at the time I filed was OMB No. 1615-0052; The current application form was not released until Feb 4, 2014. We had already submitted the application by that time. I just read the instructions for the application we filed line for line and there is no mention of the 90 day current resident in a district prior to filing requirement.

Thank you both for pointing this out to me. I did miss this. Very expensive penality for a simple mistake. I do not believe I implied in any way that the officer receives any type of compensation for the resubmission of the application. I simply stated what was said to my wife and I today at the interview.

I guess my only other question would be why would she be scheduled for an interview and test if she did not meet the basic eligibility requirements. It seems to me they would have rejected the application if they had reviewed it. The only office they have in Tennessee is in Memphis, we had to travel the 4 hours from Nashville today so a lot of waisted time for everyone.

Today my wife was told at her Naturalization interview that she needed to withdraw her application for citizenship because we moved from Ohio to Tennessee in December. I was transfered to Tennessee by my employeer. We filed in Jan with our new address after submitting a change of address form to the USCIS. Apparently you have to live at your current address for 90 days prior to filing a N-400. I looked over the instructions and this is not mentioned. We cannot appeal because it wasn't denied so we are forced to refile and pay the filing fee once again and start all over. I think they did it this way on purpose so we would not be able to appeal. We have now been at our new address for longer than 90 days. The imigration officer told us we could file again today but she made sure to stress that the original fee was not refundable and we would need to send another check with her application. She has been in the US and we have been married for over 4 years, I am an American citizen, we have 2 boys together that are American citizens, and they act like they want to deny her citizenship. I thought she would have as strong a case as anyone.

Okay now I am more confused than ever. We have been waiting on the RFE that was sent on 7-14 then we get the follow notification today. Our case has been updated to Card/ Document Production. I called they said they would enter a service ticket and get it resent, but the guy couldn't tell me what they were trying tp send a RFE or Green Card. What is everyone elses take on this?

Card/ Document Production

On August 2, 2010, the post office returned your document I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS as undeliverable. We will hold it for 180 days from August 2, 2010 to allow you time to contact us. If you do not contact us at 1-800-375-5283 within 180 days, this document will be destroyed and you will need to file a new application or application for replacement with fee.

This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

Hello everyone and congrats to all who have had approvals! We have been waiting for our RFE which was mailed on July 14th, at this point I am almost certian it got lost in the mail. When I call the 800 number it says we need to wait 30 days before reporting that we did not recieve it. Does anyone know if this is a hard and fast rule, and what is the general timeline that USCIS gives you to return the requested documents? Thanks to anyone who can help with this.

Okay, so after recieving the EAD in the mail and touches on AOS on 7-2, 7-5, 7-6, and Saturday 7-10( I dind't know they worked weekends) my hopes were dashed that an approval was on the way when I recieved e-mail notification today of a RFE. Hopefully it is something simple, but really wasn't expecting to get one after the transfer to the CSC.

Thank you very much for the reply.we are still in manila now.I did send my passport and the email that it was approved but the embassy didint get back to me.

I walked at the embassy and drop the copy of my sons passport and crba and until now im still waiting for it.\

Sounds funny because they didint even get a hold if it would be ok or not.I just go there to make sure things will be ok.

Hi, sorry for the late reply. I just sent an e-mail to the VISA unit stating the CRBA fro our son was approved and asked if they could send the VISA. They did not respond but the VISA came a couple of days later. So not sure if the e-mail helped or not, but I figured it didn't hurt to try.
