    Please, help me clear up this confusion since I am about to fill out the i864 for my fiancee.

    We had a daughter (out of wedlock) and was born in a foreign country, my fiance and my kid have just come to the state fews week ago. The problem is when i filled out the i864 do i have to put the name of my kid on part 3 of the form where it said (list any spouse and or children immigrating with the immigrant name above). I am so confused cause my kid already had a US passport (that is how she enterd to the state, as i remember back then all i had to proved was DNA test, and application report child aboard over at the embassy in vietnam), therefore ........Do i event need to put the kid name in the i864 form.?????

    Please, be advice.

    Please, help us out. My Fiance and our kids have just come to the state about 1 week, we went to the court house and get our marriage license (which is on the way). the confusion part for me is that ...I don't know what steps we need to do for AOS (such as what kind of form do we need to fill out), currently I am unemployment, and still haven't find a new job yet. What should we do.? Please advice.

    How did your fiance get a visa approved if you are unemployed? What proof of income did you provide for the consulate interview?

    Did you have a cosponsor?

    I am just recently become unemployment, my fiance visa was approved at the time I am still working and exceed beyond the poverty guidelines. The consulate at vietnam certainly did not make it any easy for us. I had to provide my LAST 5 YEARS

    If you are unemployed right now you will probably need a co-sponsor for the Affidavit of support.

  4. It all depend, whether the interviewer look at it, but If i was you, I'll damn sure to have some paper to back up

    for the reason those dates was wrong (Original birth certificate is the 110% sure proof, photocopy is a 50% chace)

    Is this a problem if the dates of birth of my parents are differents on the G 325A (sent to the service center) and the ones on DS 230 Part1 (sent to the Embassy) are different. I think I made a mistake. Not sure but you never know..... Will this be a problem resulting in the denial of the visa. does the embassy check the G 325A?

    Ok, let me clarify the situation.....

    - We did applied for K1 visa about a year ago

    - My fiancee was up for the interview at her country.......so I went over there

    - After her interview, we were asked to submitted document + application for our child whom was born out of Wedlock

    - I filled out the paper while I was there, and ask for the appointment that schedule 10 days after.

    - 147 dollars was the fee for the child's application

    - After the interview come the request for DNA test (which MUST DONE in the State not the country of my fiancee)

    ---Asking suggestion, help from anyone who had gone through the DNA test previous

    I believe from looking at the timeline this person is on a k1 to bring his fiance over from armania. They had their interview - which is what he is ranting about, from what I gather his fiance is preggers/or has had the baby but has to also file for the kid to come over with her - hence the other $147 he is talking about. But there is not sufficeint proof to say the child is his so he has to have a DNA test done but doesnt know where.... ( I would assume go to a hospital in the place of his fiance's residence and ask for one seems like a logical thing to do - but that would mean yet another rip back over to her)

    You need to make yourself more clear!! We are all guessing at what you were asking so in return you may get wrong information.

    It had been a while since I come back to the forum. Well, just come back from the trip visit my fiancee, since we up for the interview......

    All I can say is that they (you know who) HAD SURE KNOWN how to make a living hell out of everyone who had the interview. I must have carried around 30lbs of paper that taken the entire backpack that with me all the time. Still, they gave us hell over the thing that I must proof of 5 yrs physical presence in the state.......Eventhought, I had live in the state for almost 20 some years.

    Anyway, make the stories short......Now they want the DNA testing in which I had no ideas what and where about to process....anyone had been through this please share some experience..?????????

    Our case was K1, with a kid out of wed-lock, and NO it is not making your kid automaticlly become us citizen, unless YOU have satisfied all their requirement and Yeah, besure you have about 147 buck Non-Refundable when put in the application for you kid :))

    HI! My girlfriend is Vietnamese, while I live in the US. She told me the other day, very passionalty I might add, that the US government increased the restrictions on K1 visas for Vietnamese. SHe said if could take up to 1-1.5 years (!!) for her to be able to come to the US. I'd like to know if anyone else heard of this or could help me in any way. This a great website...and I hope to learn from everyone experiences!

    I just being update from a friend that one of their relative who recently had the interview with the consular in hochiminh, and yes seems like they starting to discard all the co-sponsor (not officially but did happen)

    Somone told me that for K1 Visa the petitioner alone must meet minimum income requirements and CANNOT have a co-sponsor. Is this true?

    False!

    You, petitioner can have a co-sponsor if your income doesn't meet the poverty guideline.
