  1. Hello,

My husband, Legal Permanent Resident of US, is planning trip home for 2 weeks. Question: on the return flight to Chicago, wondering if his trip can include two brief layovers (hour, two hours) in two different European countries- Italy, Netherlands. I can't find a clear answer anywhere, and Alitalia didn't know.

    Anyone know?

    Thanks for your help! =)

    Lindsay

I'm not sure why the US would care where you stopped on the way back, it's not against the conditions of his GC.

  2. Yes sorry I meant the ESTA online registration :) (sorry I thought it was pretty much the same thing  )

If I don't renew it, because I am entering before July 27th is it alright to stay until August 5th? because I'd rather not pay a fee to lodge a new one unless I had too

You only need the ESTA to get into the US, so if it expires while you're here you won't have any problems, you'll still be able to stay the entire length of your visa waiver.

The CSC needs to get it together and start sending the NOAs already.

  4. I just went to uscis.gov's website and entired the search criteria to find the estimated processing times for I-130 petition for marriage/spouse and it says estimated time is 13.9 months!!! :wow:

Then I entered search criteria for 129-F petition for fiance and it says 5mos! Why the enormous discrepancy here???? This seems to me to be grossly unfair. They receive more petitions for 129-F and yet the processing time is faster? Really?

Can someone give me some insight as to why this would be? Because that's just ridiculous in my opinion. :wow:

It might have something to do with the fact that the I-130 is an immigrant visa, and the I-129 is non-immigrant, and processing works differently between immigrant and non-immigrant visas.

  5. Let me clarify "interview".... If a case is fwd'ed to the local office that means they doubt your marriage and want to interview you before they approve your i130. My petition was forwarded to an office... Idk which office... So I'm here at the local office to find out where it is. If its here, can I get an interview same day???

It probably depends on the office your case was forwarded to, you'd have to check with them, but I'd think it's probably unlikely that they'll just let you walk in and have an interview.

  6. hope someone can advise me on this. I file I 130 for my wife dated 10/6/2011. After 7 months I contacted USCIS thru senator's office and got following reply:

"A check of USCIS records indicates that this case is currently under extensive background check review and it should be processed within 180 days. We apologize for the delay and inconvenience caused. Thank you and have a wonderful day."

Neither me or my wife ever broke any law (except speeding tickets). She never been to USA. We have wedding videos, pictures.....anything they can ask for to proof that we are married. They didnt ask for RFE.

I got my citizenship thru prior marriage which lasted over 5 years. We got divorce in good term, wasn't a massy divorce.

    My questis are:

    1. Did any one of you had similar situation? If yes how long it took you to go thru the process?

    2. Do you advise that I should file I 129f?

    3. I contacted Citizenship and Immigration Services Ombudsman today. Will it help?

    Hope someone can help me.

    Thanks

It's possible they saw some kind of red flag in processing your application. I'm not sure if contacting the Citizenship and Immigration Services Ombudsman will do you much good, you may just have to wait out the background checks.

  7. greetings,

sent my package's a week ago today, but my check hasn't clear yet :(

That's kind of lame, but i never was that eager to give them my money!!!

i'll update the post as soon as they take it! i hope you guys are luckier than me ;)

    Noth

They got my package on 05/01 and I'm still waiting for my check to clear, so I know how you feel. I check my account every day hoping to be $590 poorer.

  8. Hello everyone again.

I just have a quick question, after receiving th NOA, is there any possibility of them asking for more evidence?

Just wanted to know that cause am not sure how the process works.

Thanks all and all the best.

If they don't think you were able to successfully prove your relationship they may ask for more evidence, or an interview.

  9. @ Yurika & Jim

I sent my package on April 30th, they receive it on may 2nd(I used priority mail).

Today 5/7/12 I received NOA letter the date shown is 5/3/12. The letter indicates the one year extension and I should wait for biometric later.

Does this mean I have been approved for the ROC or just indicating they are processing my request?

Thanks in advance all and I wish all the best.

The NOA just means that they are working on your ROC and that they will send you a date for your biometrics soon. It won't be until after you've completed your biometrics that your ROC will be approved.

  10. My GC expires 05/14/12. I sent my I-751 to the CSC on 04/25 but they only just received it today.

    Included:

    • I-751 signed by both my Wife and I
    • $590 payment
    • Copy of GC (front/back)
    • Joint tax returns 2010/2011
    • Copy of joint lease
    • Copy of join renters insurance policy
    • Copies of joint medical insurance cards showing joint policy
    • Copies of joint dental insurance cards showing joint policy
    • Copies of Target Credit Card showing joint account.
    • Utility bills in both names to the same address
    • Copy of AirNZ itinerary from Feb-Mar 2012 trip back to New Zealand
    • Various photos of my Wife and I over the last couple of years.

It doesn't seem like much/enough, so hopefully I'll be ok.

  11. Just got home after my interview. Visa Approved!

I wasn't asked for any of the things I brought with me, it was a 15 minutes process of first the Visa Assistant looking over my papers, and then talking to a Immigration Officer for a few minutes. He only asked me a couple of questions before telling me he had no doubts about the validity of our marriage, and telling me I'd recieve my passport back in 2 - 3 days with the visa in it.

  12. can i ask my husband to fill/print and sign the ds3032 and mail it to me?? is it okay to mail the ds3032 on his behalf from here?

what should i do where it says place ur case barcode strip at the top

You aren't able to mail it on his behalf, it needs to come from him. Sending in a hard copy via snail mail is a waste of time though. When you have the NVC case number and have given an operator your email addresses they'll email you the request for the DS3032 within a couple of days, and just get him to send an email based on the template for the form, it will be much faster.
