  1. How old is shy? A lot of questions will depend on that. Assuming young-ish child, mostly she'll be asked as she met step parent, is she looking forward to coming to the USA, going to school there- she won't get difficult questions like an adult would.

    Never make travel plans until you/she have the visa- even if it all goes smoothly, the visa printing machine could be down or whatever.

    She is now 17 yrs. old. She did not come to the US when her mother was granted a K1 visa (3 years ago).

    She stayed back to finish her high school and was also not very keen at that time to come to the US. Now she is willing and wants to very much come to US.

    Thanks for the response. We were hoping, since she has her K-2 and medical etc. all done, that visiting US and adjusting status could save us all the hassle of refiling for her again. We still hope that when she is past this teenage phase, she might actually change her mind or visiting here may make her think again. We can only hope................

  3. Hello all,

    I apologize for this long absence. The good news is that my fiancee had arrived in the US and we got married and now her permanent resident status has been approved.

    Her 15 year old daugher had stayed back in India and her K-2 visa is going to expire on Oct. 13th 2010. Finally, we have been able to talk her into visiting the US before the 13th and get her status adjusted.

    Our questions are:

    1. Would she be interviewed by USCIS or would they adjust her status based on her mothers approved (permanent resident) status?

    2. Would her fingerprinting process move any quicker than her mother's?

    3. She is willing to visit only for a month or so - is it possible to get her status adjusted within a month given that her mom's status is approved?

    Any other thoughts?

  5. Hello!

    Is anyone aware of DHS regulation which instructs states not to issue drivers license to any beneficiary (AOS for a fiancee) whose I-94 is going to expire in less than 60 days? We are Kansas residents.

    We are already married (she has a SS#) and her AOS in the works. Are any states issuing drivers license that anyone is aware of?

    What is the alternative if any? Any thoughts?

  6. Hello All,

    My fiancee and her two children have received their K-1 and K-2 visas. Problem is that my fiancee's 14 year old daughter is now refusing to travel to the US (two days before the flight). Reason - she is 14 and doesn't want to leave her cozy environment at home - we have tried everything.

    Staying back in india for her is not a big issue as she is living with my fiancee's mom and is very close to her. We are willing to give her the space till she is out of this "odd 14 year stage", however, we want to make sure that the doors are not closed for her to travel to US when she gets her senses back.

    Possibility 1:

    Her K-2 visa is good till Oct. 2010 - she may change her mind by then (hopefully) - then it should't be a problem, I suppose?

    Possibility 2:

    Can I file for her AOS even if she doesn't travel to the US? Her status is derived through her mom so is it possible?

    Possibility 3:

    She may not get her senses back till a few years from now - in which case her mom can file for the daughter when she gets her citizenship (in 3-4 years)? Any issues there?

    I am looking for any suggestions/ pitfalls etc that we might run into right from the point my fiancee enters the US (POE) of AOS etc.

  7. I would agree with NigeriaorBust, front loading at the beginning should be helpful. Its up to them if they want to look at each and every piece of evidence or not. Make sure that every deficiency or weakness from your earlier k-1 petition is addressed with supporting evidence in your new petition. One thing you can certainly be asked at the interview is the reason as to why you didn't get married and choose to re-file a k-1. Whatever the answer you should be prepared for it.

    I don't think it is an issue. Your passport was issued before you got married, right? It should't be an issue at all.

    In my fiancee's case, her passport still has her late husband's name on it.

    US passports don't even have a place for spouse's or parents name unlike Indian passports.

    I suggest, Don't worry about getting it changed at this late stage. Just be prepared to answer the question if at all it is asked.

  9. The biggest risk I see is damage done to your property by outsider, if you don't have relatives living near by or someone who you trust isn't taking care of the property.

    I am not just taking about the physical damage but also your tenants taking over your property over the time of years. So make sure you have foolproof lease agreements and all the other legal aspects are taken care of.

    Good point. That definitely is a risk...........from what I have heard though things are a little better than what they used to be in favor of the land lord and the key is how and to who you lease the property.

  10. This may seem an off-topic subject but is specific to India so I am taking the liberty of posting in this forum.

    I am looking for opinions, ideas, and suggestions on the following invesment opportunities in India:

    since the return on investment (real-estate, savings, CD's etc.)here in the US are far lower compared to what one could expect by investing in india, does it make sense to invest e.g. in real-estate in india with money earned/borrowed here in the US.

    Here is a scenario:

    I take a home equity loan for $200,000 at a nominal interest rate of 5%. Repatriate this money to india and purchase real-estate for say 90 lacs. I can expect to double my money in probably five years (i.e. 20% annual return on investment) for this real-estate. Taking off the 5% interest I end up with a net 15% annual return. I can't get similar return in the US.

    So what are the risks or things that I may be missing by doing so? Any opinions or suggestions please.

  11. We finally received the visa from New Delhi for my fiancee and she will be joining me soon along with her children........ yes, it was a long wait and took two K-1 filings.

    My BIG THANK YOU to the VJ community who was always there to support and provide guidance whenever needed. I was double-minded whether to be present for the interview with my fiancee but you all advised me to be there - it definitely made a difference.

    Thanks for your response. It is encouraging to know that you received a similar reply and got approved.

    Did you do anything during that month of waiting? Like any follow-up contact with the embassey.

    In your case the petition expiration was not a concern but ours is a K-1 petition with 4 month validity. That's why I am a little concerned.

    The reason I am suspicious of the Delhi CO is that last time there was no mention of a second passport. Are they just trying to delay it till the petition expires?

  14. My fiancee had her K-1 interview last week at the New Delhi consulate. I was present at the interview alongside my fiancee. The interview went well.........questions asked were expected and things were going well till the point my fiancee was asked whether this was her second passport. The answer was no as my fiancee had never applied for a passport before the one she currently has. After that point the consular officer started to type a letter. Here are the contents of the letter:

    Please bear with us as case is under mandatory Administrative processing.......... you will get your passport and visa as soon as the processing is completed.........if you need your passports before that please contact us........

    This letter was typed on a white paper unlike the 221(g) format.

    They have'nt asked for any more documents from us.

    Ours is a second time refile of K-1 visa for the same fiancee - last year our case was denied for not having sufficient evidence to establish a credible relationship and also that our petition had expired. This time we had everything taken care of over 90 photographs, receipts, emails, cards etc.......etc.

    My Questions:

    1. What does this mean? Mandatory Admin Processing is a very vague and standard terminology the CO's use.

    2. I am suspecting it could be a name check issue as her name is quite a common one. Are my suspcions valid? Does it have to do with security check or is it something else.

    3. One of our fears is could we again run into the same issue of petition expiry. Admin processing can sometimes take a long time - what if it takes more than a month? Will the CO extend the petition or are they using this (AP) as an excuse to again let the petition expire? I am very suspicious of New Delhi consulates modus operandi.

    Please provide any suggesions as to what we should do - just wait and see or contact the CO, congressman, state dept.?
