  1. I am currently working as a full time employee. Lay offs are imminent in my company. It seems as if I will be laid off soon. I am tossing the idea of applying for unemployment after getting laid off. Would this affect visa petition for my wife in any way?

    To give you a little bit of background: I have petitioned CR1 category visa for my wife. I am a US Citizen. A couple of days ago, I sent in DS-230 forms along with all the civil documents to the National Visa Center (NVC). If there is no mistake in documents, she will be given an interview date (in her country) in a few weeks.

    Can they deny her immigration visa based on the fact that I am collecting unemployment?

    I don’t want her visa petition to be denied because of me collecting unemployment. I would not even apply for unemployment if her visa application could be in jeopardy.

    This economy and my likely lay off have put me in a very onfusing situation.

    Any insight into my question will be greatly appreciated.

  2. I am filling out DS-230 form for my wife who is a graduate of a foreign medical school. (She hasn’t taken the USMLE Board exams that will allow her to practice in U.S. as a medical doctor.) I am confused about the following question in DS-230 form: DS-230 Part II- Sworn Statement (page 3). 40 e.

    The question reads as follows:

    “An alien who seeks to enter for the purpose of performing skilled or unskilled labor who has not been certified by the Secretary of Labor, who is a graduate of a foreign medical school seeking to perform medical services who has not passed the NBME exam or its equivalent; or who is a health care worker seeking to perform such work without a certificate from the CGFNA or from an equivalent approved independent credentialing organization.”

    What should I check for this question; YES or NO.

  3. I have a general question about creating an account at USCIS.gov for the purposes of receiving automatic case status updates.

    The following link provides information about creating an account:

    If I create an account at the following link to get automatic case status updates, would I still be able to get letters in the postal(snail) mail from USCIS about the case progress and/or any requests for further documentation.

    Has anyone used this feature before? May be you can shed some light on it.

  4. I am a U.S. citizen. I got married outside of United States a couple of months ago with a non U.S. Citizen. I am in the process of filing an immigration visa for my wife (intended beneficiary). I have a few questions and was wondering if any of you can help guide me through the process. Here are my questions:

    1. Do I need to submit a copy of my wife’s (intended beneficiary) birth certificate from her country with I-130 form?

    2. What happens if you are missing a required document when you file for I-130? Does USCIS refunds your fee and ask you to resubmit the form with ALL required documents? Or your fee is gone and you can submit a new I-130 with a new fee and required documents?

    3. Can I myself (the petitioner) translate my marriage certificate into English? Or do I need to have someone else translated into English?
