  1. I was under the impression that someone who entered US on a CR-1 visa after marrying a US Citizen will have to renew his/her green card. In my case, the green card is valid for two years after data of entry to US. So do I need to file for renewal of green card (form i-90) or file for removal of conditions (form i-751)?

  2. Petitioner will be counted.

    His household size is 4 - he, his father, the person his father co-sponsored last year, his wife (beneficiary) if his father filed taxes separately without his mother.

    If his father filed married filing jointly with his mother, it will become 5, because the petitioner is combining the co-sponsor's (father's OR father's&mother's) income.

    My father filed 'married filing jointly'. So this makes the household size 5. The poverty guidelines for a household of 5 are $32,237. I think we are on border line. I really hope the consulate accept the current Affidavit of Support otherwise it will delay the visa more :(

  3. I have a question about Affidavit of Support Poverty guidelines. It is a little complicated. Here it goes: I have submitted AOS and a joint sponsorship I-864A from my father for my wife (beneficiary). I go to school and currently do not work. I did not work in 2009 and had no income on my 2009 tax return. My Joint sponsor has the same household address as mine. He has a household of 2 (himself & his wife). He has already been a co-sponsor for another person who immigrated to the U.S. last year. His income reported on tax returns in 2009 income was $40,669, in 2008 was $23000 and in 2007 was $27000. His 2010 income would be equal to 2009 income.

    I think the household size comes out to be 4 in this case (my father, his wife, the person he co-sponsor last year, my wife (beneficiary)?

    Is this correct?

    Does he meet the poverty guidelines for 2010 for this household?

    Assuming I am counting the household size accurate for poverty guidelines purposes. Then we meet the 125% of poverty line for a household size of 4 which is $27,562.

    If not, what is the exact household size in this case?

    Is my calculation right or am I missing something?

  4. I just called NVC the automatic response system said they need 6-8 weeks to process the checklist letter response. I called again and spoke with a customer service representative and she told me that my case is complete and is now waiting to be scheduled for interview at the Islamabad embassy. She said they schedule interview on the 2nd week of every month for the following month. She said something like October is out of question. I still dont understand why its out of question. I dont know when would be the interview. Can anyone give me an estimated time line as to when to expect the interview. It will be much appreciated.

    I just tried loggin in the NVC payment system and login failed. woohooo.. hehe sorry im just a little excited.

  5. So I sent in all the civil documents and NVC received them on June 23rd. They said it will take them 6-8 weeks to process them. Today, August 10, I received an email from NVC saying they need two photographs of the beneficiary.

    I wanted to ask if I could send the same photographs I sent in to INS when I first filed the petition I-130. I quickly called NVC, the person I spoke with said, “Yes I can send the same picture again”. He also said it will take 2 weeks to get the picture in the system from the time they receive it. And it will take 6-8 weeks to process it.

    I called again and the guy said it will take 6-8 weeks to process.

    I am still confused. I don’t want to get another email after 2 months saying I need to send a current photograph of the beneficiary.

    Also, I am really upset at the processing time.

    Any of you in the same boat? Any advice will be much appreciated. Thanks.

  6. Collecting unemployment will not affect the probability of getting a visa insofar as you will not be denied because you are collecting unemployment.

    It potentially creates an issue with the I 864 affidavit of support, although you have already sent in your affidavit of support, correct?

    Just to clarify further:

    When I sent in my Affidavit of Support (which was a long time ago), I was unemployed and not collecting unemployment. My father was a co-sponsor for Affidavit of Support. I started my job after I sent in Affidavit of Support. Now I do qualify for unemployment if Im laid off. Would it affect the visa petition of my wife?
