    So I called our local POE office...again...thought I was armed with new info...was wrong (as per the CO). He said that most people coming from Canada don't have to pay duty because their car was manufactured in North America so it falls under NAFTA, which makes the vehicle duty free. My fiance just had to buy a BMW in Canada that was manufactured in Germany, therefore making it ineligible for NAFTA vehicles, thus incurring duty. Arggghhh!!!

    Anyone else out there import a BMW? Did you have to pay duty?

    I'm chasing my tail! I guess we might as well bite that bullet and pay the darn duty :(

    It's very crappy that, in the state of Utah specifically, to add him to my auto insurance he needs a driver's license. To obtain a driver's license, he needs his I-94 (have), SSN (have), and two forms of proof of residence (don't have as they are very specific as to what they will accept and nothing on the list is in his name). One of the forms they will accept is his auto registration, which is why we are going through this in the first place.

  2. My fiance crossed the border from Canada 3/27/10 in Port Huron in his car filled with his belongings. He activated his K1 and he received his I-94. He also told the CO that he was importing his car, for which he had the letter of compliance. The CO said he didn't need to see it and didn't give him any paperwork for his car.

    Now we are trying to register his car in the state of Utah, but they say he needs form CF 7501 completed by CBP to do so. We went down to the Salt Lake City port office and was told he owed 2.5% duty. He said he'd do some research and get back with them, as we thought we read that he could import his car duty free as long as it was less than one year from entry. The CBP officer stated that is correct, however if he wants his car to remain in the states permanently, which we do, then we need to pay duty. He said that duty free was only if the car would be in the US temporarily. Also, it's a BMW...German made, so again, it would incur duty.

    My questions: Is the information the Utah CBP officer gave me ragerding duty correct? Should he have received paperwork from Port Huron regarding the importation of his car when he first activated his visa? Any help on the subject would be much appreciated.

  4. Hello to all! It's been a while since I've posted as well. Everyone is seems to be at the "busy" stage of this process...or enjoying the reunion :) Adam POE'd 3/27 and made it into SLC the afternoon of 3/30. We had our civil ceremony to begin AOS paperwork 4/1. We felt April Fools Day appropriate for such service...you know...this whole process being a big joke and all :) Anyway, life is wonderful. I can't imagine being any happier. Sometimes when I awake in the middle of the night, I roll over and reach for him just to make sure he's really there. I love that my dreams of being with him have finally come true! I hope the rest of you feel the same sort of happiness as I do! Good luck to all, no matter the stage you are in in this process.

    Now let's just hope EAD and AP comes through quickly! *fingers crossed*

In preparation for our interview, I'm completing the I-134 (Affidavit of Support) and am confused as to how to answer question 11: I "intend" or "do not intend" to make specific contributions to the support of the person(s) named in item 3. I reviewed the sample form, but I don't understand why it states I don't need to answer this for a K1. The I-134 filing instructions don't say anything about that question not being completed simply due to me filing a K1. Can anyone here opine? How did you fill yours out? I don't even know that I understand the meaning of either option. I would assume I "intend"...right?

  6. Also, someone mentioned a bit ago in another thread that they obtained a Certificate of Non-Marriage (from Manitoba?), as they were never married and had no legal evidence of custody arrangements, as there weren't any.

    I thought I would help you out and called Alberta Registries, Vital Statistics in Edmonton at Tel: (780) 427-7013 to ask if they have similar certificates available. She said they do not offer a cert of non-marriage, but they will do a serch for marriage over a specified 3 year time period. If no marriage license found, that's what the search will state. Granted this is just for Alberta and only over a three year period. The cost is $40 ($20 to govt, $20 to agent) and takes approx. 5 business days to process once form received, then mail time. You can print the form at http://servicealberta.ca/pdf/vs/REG3023.pdf. Again, this doesn't exactly state you have custody, but may be somewhat helpful, in conjunction with a more specific notarized letter from the father, in getting your visas approved.

    Here's my input for what it's worth. I would re-word the letter to something like I've posted below. Of course I would have this notarized.

    TO WHOM IT MAY CONCERN:

    I, (FULL NAME OF FATHER), BIOLOGICAL FATHER OF (FULL NAME OF CHILD), DO HEREBY GIVE MY WRITTEN CONSENT for her to immigrate to the United States of America as a K2 visa holder, accompanying her biological mother, (FULL NAME OF MOTHER), as a K1 visa holder, with intent to become a citizen of named country.

    This Letter of Consent is being issued this ____ day of _______________ 2010 at (PLACE OF ISSUE) in compliance with immigration requirements for unmarried minors immigrating to the United States of America not accompanied by or joining either parent.

  8. I am the USC and work for a lending institution. In all my working years, giving permission to run my credit is pretty standard practice when job hunting. However, it has always been after an interview and offer of employment, with me giving written permission for them to pull my credit. My continued employment was contingent upon an "acceptable" credit report.

    On a seperate note, having worked with all three of the major credit bureaus in the U.S. for years, if your credit is pulled as a result of potential employment, it will hit your bureau as a "soft inquiry", which does not damage or ding your credit score as it would if you were applying for say...an auto loan. So take some comfort in that...maybe?

  9. So Julyers...Adam and I finally received our interview date...3/16/09 in Montreal (March 16th is also my daughters birthday). I'm sad I won't be able to make it, but I'm sure he'll do just fine without me. Such an excruciating wait. I'll be so relieved when it's all over. We were planning an April 9th wedding, but weren't feeling very comfortable we'd make it so last Monday we decided to officially move the date to August 9th...Doh :blink: Oh well. We'll just have the civil ceremony in April and our "this is the day we'll celebrate our anniversary" wedding in August.
