  1. Ugh! Geez its harder than I thought then.  She can't read so for her to fill out the paperwork would be hard, she went to a lawyer and was ripped off, her other family doesn't want to or know what the steps are so. I don't know how or where to start. 😞

  2. So question....currently we are going through the I130 process with my husband. Now he is wanting for my MIL to come visit while we wait for the waiver to be approved(hasn't physically seen her in 20yrs) . She has already tried once but was denied ( she also went with a group of people) so I am wondering what we can do to apply for her visa from the US.

  3. Actually he doesn't need to be married to you and he has a green card. He just needs to prove he entered the marriage in good faith and apply for a divorce waiver to remove the conditions. However, given the circumstances, for him that may be hard to prove.

    Thank you for your best wishes and what I meant was he doesn't have the 10yr card, but the 2yr one (CR1) Given that we don't have anything together and he basically left the state 1 1/2 mths after arriving even through it was for work (we both agreed) and he basically hasn't looked back since he's cut off all communicatiom with me and has moved on with his life with another woman. Yup I would say that it'll be a little hard.

  4. Withdrawal of petition? What do you men by that? He has his GC, nothing to withdraw.

    He doesn't have his GC he has a CR1 which is a conditional resident meaning that he needs to be married to the USC that petitioned for him, and if there is an annualment or divorce depending on what the judge decides he'll be out of legal status here. Since my lawyer has said that there are alot of red flags in MY case then more than likely the judge will grant me an annulment meaning that there was never a marriage therefore he should have never been granted a visa.

    Annulments are very difficult to get especially when you have been married for so long.

    What evidence do you have that it was fraud?

    Just wonder how you prove non consummation?

    Actually we have only been married for 2 yrs this past Sunday.

    Thanks Anna! I've started the necessary paperwork for the withdrawal of petition and anualment and since he still has a year and half left before removing conditions I'm going to assume by then USCIS will have all the necessary paperwork needed for whatever they have to do.

    I need all the prayers I can get and mostly I'm trusting God to handle the situation. :-)

  6. Hey Guys thought I would give you guys an update you guys can read it here :

    Since then I've been told and thanks to FB I've found out that the OW (other woman) is pregnant and that they've bought a vehicle and renting a house togather. I guess deep down I was still hoping in that my marriage could be salvagable but its obviously not. So during one of the many arguements that we had he said he wanted to be friends but stay married. Yeah my reaction was likd ####### are you talking about he said he cared and loved me and that he would be forever greatful for everything I've done for him. A week later he's going to text me do you want me to look for a lawyer or do you want me too. All in all guys I had already talked to a lawyer and since our marriage was never consummated, we have nothing that even proves that we're a couple, and he's obviously not impotent (sorry guys) my lawyer said that I could get my marriage annualed due to fraud with that being said he would be out of status and that USCIS would place an order of deportation on him. Obviously there are more steps in this process but he did say that becuase it would be an annualment due to fraud that he would be automatically barred from ever entering the country again.

    I'm over the crying spells and yes it hurts like hell because I believed every lie that has ever came out of his mouth, but I've come to realize that I need to take care of me. I also have a great family and friends that has stuck by my side as I go through this whole process. I believe that God has a purpose in this whole situation and if it didn't work out its because he has something better. :)

  7. Sorry "Missing-my-amor" but I was also thinking the same. Are you sure your husband entered the marriage in good faith? How long has he been seeing this other woman? Whether you believe in divorce or not, the fact remains that your husband wasn't honest and faithful to you. I mean just the fact that he moved away from you just a month after you were finally able to be apart. I hate to say it but it does kind of sound like he only used you to get a green card. :( I would divorce him and do everything I could to make sure his green card got revoked. Once the divorce is final, make sure to report it to US immigrations so they know that he is no longer married to a USC. Good luck!

I wanted to think differently and like I said we both agreed for him to move states so that he could find a job (he couldn't find one here), and like I told him from the beginning I don't want to be lied to, cheated on or used and he has done all 3 so yes I'm still fuming. Oh but get this he still says he wants to build a life togather and what not. :ranting::ranting:

  8. Sorry to hear about what you're going through. After all that time and effort you put into having your husband join you in your country and he does this... :(

    From your post, I understand it that you are considering divorce and wondering what that will do to your husband's green card and chances of staying in the US?! If you get divorced before adjusting status, your husband needs to prove to US immigrations that he entered into the marriage in good faith and that it ended due to natural circumstances. In my opinion, moving away from you and cheating on you just one month after entering the US on a spousal visa is NOT gonna look good to US immigrations. Hopefully someone with more knowledge about this topic can give you some more specific information.

    I really don't want to consider divorce because I wasn't brought up that way. But I also don't feel like he should be doing that. I mean we both entered into this marriage in good faith, but on his part its showing me something totally different (sigh)

  9. I would say that if they are 'just friends' now, then he wouldn't have kept that a secret from you until you found out on your own. I don't want to say, but I think he's cheating on you.

    But before making any decision make sure that the reason of your suspicion is correct. Sometimes our eyes also get cheated.

    So sorry for the loss of your time for a person who didn't turn out the way you expected.

    I hope you are able to find out the truth quickly.

    Sad part is that I have pictures of them togather being a very nice big happy family

    You signed up for the I 864. Assuming he has a 2 year GC then he would need to file to remove conditions after I presume divorce.

    I meant removal of conditons sorry for not clarifying that.

  10. My husband came into the US last August with a CR1 visa and everything was fine and dandy until a month into him being here. I had always told my husband that it would take awhile for us to get everything into order so that he may find a job in the state in which we live. So a month in half into him being here he decided that he would move to another states in which his brother and sister in law live, which we both agreed to and that I would join him when he had us a place to live. Well in October I got our phone bill which is just under my name and I started seeing this certain number keep popping up as text messages so I questioned him and he said it was a work number. I took it upon myself to call that number and sure enough a woman answered and yes she admitted that they did have a relationship. I entered this marriage because I love him and wanted to build a life togather but now I'm really left wondering if he did. So of course I was PISSED OFF!!! Anyway guys my question is what or how does all this affect the visa process since we basically just lived togather 1 1/12 mths and he has never sent money to help out except once for a car battery, AND yes I have proof that he is seeing someone else although he DENIES everything and that they are JUST friends also the only thing that we have togather is that I added him to my account ( bad move I guess) and that we filed taxes togather??

  11. Hey guys!! Its been a LONG time since I've been on here and a quick update: hubby made it home in August and he's currently working out of our home state, and there are currently no plans in moving back, so I will soon be leaving my hometown and family to join him up there.

    Now my question is since my husband is on a CR1 visa (2yrs) do we have to file taxes together or can we file them separtely? I have always been told that we should file together since he is on a CR1. Which would mean either I make the trip up there or he makes a trip down here and with the weather being crazy it'll be tough.

  12. Hey guys! As many of you know my husband is finally home!! Well, a week into him being here I'm grandmother in Mexico has passed this morning and we are making plans to drive into Mexico for the funeral. Our question is the only thing that we have is his passport with the CR1 visa in it. Will that be enough for him to come back into the US or do we have to wait until his gets is physical green card card in the mail which will probably be another 3 weeks??

    You must bring the following items to the visa interview:
