  1. Unless there are around 7 people in the household, 39k should be sufficient, so no need to get the other years involved.

    Unless you live in Alaska or Hawaii...

    We are five people in the household...I know that I only have to provide the most recent tax return....I was just wondering if it would help since his income varied so much in the last three years. If they will not make any problems than I just send in the most recent one. Why are they want to know the income from all three recent years?

    One short question regarding I-864A.

    My wife’s dad will fill out I-864A, cause my wife is a student and does not have any income yet (we live together with my wifes parents).

    He is self-employed as a truck driver and his income varied a lot during the last years.

    In 2007 he made $29,655 (he was sick in this year and didn’t drive so much), in 2008 he made $77,321 (good year) and in 2009 his income was $39,861 (business was slow).

    Should I attach just his last income tax return from 2009 or also from 2008 and 2007. I know that only the most recent one is a requirement and the other two are optional. Is it better to provide all three income tax returns, since his income varied so much during the last years or does it not matter?

    I am filling out all the papers for AOS.

    I have a question regarding I-765 form.

    The instructions say on page 6:

    Required documentation:

    "2. If you are mailing your application to USCIS, you must also submit:

    B. A copy of your last EAD (frint and back). If no prior EAD has been issued, you must submit a copy of a Federal Government-issued identity document, such as a passport showing your picture, name, and date of birth; a birth certificate with [...]

    C. you must submit two identical color photographs of yourself taken within 30 days of filing your application."

    I am sending form I-765 together with I-485. The instructions of I-485 say that I need to send in two photos of myself. So it will be four in total: two for I-485 and two for I-765?!?!?

  4. You are not ALLOWED to have him complete an I-864. He MUST complete an I-864A because he LIVES with you. You will cause more trouble than it's worth by not following the instructions.

    Also out of interest the person who replied to your post isn't "newbie" that's their status in terms of post count. Just like my name isn't "little miss", It's "Vanessa&Tony"

    Household size is explained in the instructions, so is the majority of the form. Read the forms again, AND their instructions, then post your questions.

    I was reading the instructions but I am still really confused. It says on page 2:

    "How to count household size? Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support."

    The instructions also say on page 2: Who completes and signs form I-864? A sponsor completes and signs form I-864. A sponsor is required to be at least 18 years old and domiciled in the United States, or its territories or possessions. The petitioning sponsor must sign and complete form I-864, even if a joint sponsor also submits an I-864 to meet the income requirements."

    "What if I cannot meet the income requirements? If your income alone is not sufficient to meet the requirement for your household size, the intending immigrant will be ineligible for an immigrant visa or adjustment of status, unless the requirements can be met using any combination of the following:

    - Income from any relatives or dependents living in your household or dependents listed on your most recent Federal tax return who signed a form I-864A

    - [...]

    - [...]

    - A joint sponsor whose income and/or assets equal at least 125 percent of the Poverty Guidelines."

    On page 3 is says: "Who is a joint sponsor? If the person who is seeking the immigration of one or more of his or her relatives cannot meet the income requirements, a "joint sponsor" who can meet the requirements may submit a form I-864 to sponsor all or some of the family members."

    As far as I understood this, my wifes dad can be my co-sponsor and fill out I-864.

    If it is easier to fill out I-864A and if it does not cause any trouble I could just do this.

    But can my wifes dad fill out I-864A, even if my wife does not have any income and no federal income tax return form?

    Are both ways possible???

    What should my wife mark for question 21 on form I-864?

    a. Enter the number you entered on line 10 ------ "1" - me

    b. Yourself ------------------------------------- "1" - my wife

    g. If you have siblings, parents [...] ---------- "1" - her dad

    The houshold size would be 3 people if she fills out I-864 and her dad I-864A. If her dad fills out I-864 as a joint sponsor, the household size on his form would be 5 (him, me, my wife, his wife and two daughters - mentioned as dependent on his federal tax return). This would mean that if he fills out I-864A and not I-864, the poverty line requirements could be easier to be reached (3 people compared to five people).

    What would you guys recommend????

    Did someone had the same problem????

    I was reading about form I-864 in the forms. My wife is still a student and has no income. Therefore I think it is better that her dad will also fill out form I-864 as a joint sponsor.

    As I mentioned the property guideline states that you have to have an income of $32,237 in a household of 5 people. My wifes dad had an income of: $39,861 in 2009, $50,434 in 2008 and $29,655 in 2007. So in 2007 he did not meet the guidelines requirements, what does this means? Do I have to find another joint sponsor?

    I would appreciate it if someone could help me out.

    I have a question regarding I-864.

    I just finished my MBA before I came to the U.S. with a K1 visa.

    My fiancee is still a student and does not work.

    When we were filling out the papers for my K1 visa, she filled out form I-134 as my sponsor stating that she does not have any income. Her dad also filled out I-134 as my co-sponsor.

    Is it the same process for the I-864?

    Does my fiancee has to fill out I-864 as my sponsor and her dad as my co-sposor?

  8. Hi everyone!

    I am just filling the papers for AOS and for some documents I have to write down my A-number.

    Looking at my NOA and my NOA2 I just realized that I have two different A-numbers.

    When I was filling out I-129 I wrote down my old A-number from my old OPT card (I was studying in the U.S. in 2006 after that I was able to work in the U.S. for 1 year, therefore I have an A-number). This number is on my NOA. The NOA2 has a different number.

    Should I just write down the A-number from the NOA2 on the documents and don't worry about it?

    Does anyone also has two different numbers?

  9. I just opened a new post before I say that one.

    There is another dishonest civil surgeon, which is recommended by the USCIS website.

    I called him today regarding the I-693 form.

    I read some posts here and I am pretty sure that I don't have to get a whole medical examination again. On the phone they told me that they can not just fill out part 2 - Nr. 5 Vaccination information and part 5 the Civil Surgeon Certification on the I-693. All information in Part 2 have to be filled out they told me, therefore I have to take the medical again.

    I had my medical examination in January 2010 and I have a brown envelope which states “Do not open this envelope – it contains a copy of your medical examination. Please provide it to USCIS when requested in conjunction with your adjustment of status.”

    My guess is just to send this envelope and find a Civil Surgeon who will fill out just Part 2 - Nr.5 vaccination information on the I-693. I also have form DS-3025 proving my vaccation record.

    The doctor said that the USCIS will not except it and that I will get just in trouble if I don't do a new medical examination in the U.S.. The cost for everything would be $430! I really think he just wanted to make money and tries to rip me off. I just said thank you.

    Can someone give me please some info about it!

    Also, do I need to send in the CD which I received after the medical examination in Germany?

  11. Hi guys!

    I have a question regarding filling out I-693.

    I have to fill out Part 1 and a Civil Surgeon has to fill out Part 2 and 5, than seal the form in an envelope and I have to send it with my other papers for a adjustment of status to USCIS.

    When I received my K1 visa there was already a sealed envelope inside with a note:

    “Do not open this envelope – it contains a copy of your medical examination. Please provide it to USCIS when requested in conjunction with your adjustment of status.”

    Question 1:

    Does this mean that I don’t have to fill out I-693 and get it signed by a civil surgeon?

    Or do I have to send the sealed envelope that I already have and also the sealed I-693 from the civil surgeon?

    Question 2:

    I just have to go to the Civil Surgeon and show him the I-693 form including the DS-3025 form and he will sign and seal it or do I have to take some more medical tests?

    Question 3:

    How much does it cost?

    I am already in the States with my K1 visa.

    I want to get married in California. There are two different marriage licenses here: confidential and non-confidential. Which one do we have to obtain?

    Also, if my fiancee changes her last name already in the marriage license application we don't have to pay anything extra (expect the $50 fee for the marriage license). Or is there also a fee for changing the last name?

    She could also change her last name later. Does any one knows how much this cost?

    I am from Germany and I am finishing school right now.

    I will move to the U.S. in May (K1 visa).

    I will have a German diploma degree "Diplom Kaufmann".

    I was going to school for 11 Semesters. I did three internship (each one betwenn 3 - 6 months full time) and a study abroad program for 2 Semesters.

    Is it necessary to convert my degree? The school will give me a English translation, is this one enough when I apply for jobs in the U.S.?

    There are some agencies which are offering a service to convert foreign degrees. Which one could you recommend to use? How expensive is this process?

    I hope that my degree equals an american "Master degree".

    Does anyone had experience with this?

    I have a question regarding the work permission.

    I was reading a lot of different stuff in the forums about it.

    I will be coming to the U.S. with a K1 visa.

    Do I get a work permission directly at the boarder?

    If not do I have to apply for an EAD card while I am sending in the papers for AOS?

    How long does it will take until I get the EAD card and how long is it valid?

    Does it mean that I can not work for the first few months while I am in the U.S.?

    I just got my K1 visa :-)

    …I have some questions regarding the next step (adjustment of status)

    1) I am from Germany. Do I have to sign up for “ESTA” (Electronic System for Travel Authorisation) or is it just for people who are travelling without a visa?

    2) is the fee for the I-485 (adjustment of status application) $1010?

    3) how much is the fee for a civil surgeon to certify my vaccination history?

    4) for the I-864 (sponsor document), do I have to provide the same documents as for the I-134 which I turned in on the interview day?

    5) by passing the boarder (port of entry) I will get a work permission for three months (EAD card). When do I have to extend this card (how long is the processing time)? For how long is the new card valid?

    6)After sending in the I-485 form, how long do I have to wait until I receive the green card?

    7)After how many years can I apply for naturalisation?

    8)If I want to take some classes at a university, do I have to pay the local fee (which is way cheaper than the fee for exchange students) since I will have a green card?

    the reason why I still want to be "gemeldet" in Germany is because I have an insurance here, which I can use for the U.S.

    ...

    I just finished my master and I hope I will get a job in the U.S. pretty soon.

    Until than I want to keep my German insurance "Auslandsversicherung".

    Therefore I think I need to be "gemeldet" in Germany.

    Can I let the registration office in Germany know that I don`t live there any more, after I move to the U.S. or do I have to go to the office in person?

    I haven't been in Germany since 1994, but since I still have an apartment, I'm still "gemeldet" which, by the way, is necessary to keep your Personalausweis and German driver license "legal."

    so can I be just "gemeldet" in Germany and don't inform them that I am leaving the country or do I have to give them a notice.
