  1. SSB,

My wife's interview is on Oct 20th 2009. I got letter from NVC asking to get Pakistani Police Certificate, which I already submitted to them, I had to get 4 Police certificates, one from Karachi and 3 from Islamabad. As per my understanding, PCC is valid only for 3 months and at my wife's visa date these PCC will be expired. So I need to get new PCC.

Is this the same with you guys? Are you going to get new set of PCC?

  2. K-3 and CR-1/IR-1 are completely different.

For K-3, NVC sends the case number to the Embassy or Consulate, and the Embassy or Consulate sends a packet to the beneficiary.

For CR-1/IR-1 after NVC has completed your case review, they schedule an interview (usually between the 1st of the month and the 15th of the month AFTER you get your case complete....if it's complete before the 15th of the month and they haven't scheduled interviews for your country, then you will be scheduled in the same month).

Once your interview has been scheduled...THEN they will send the package to the Embassy or Consulate along with all the other upcoming interviews for your country.

Hope this helps...see LingChe shorcuts (link in my sig) for more information on tracking the package from NVC to the Embassy or Consulate.

    Ling,

    Thanks!

Your guide on CP rocks. You have done a traffic job for others to get benefit out of it.

    Regards

  3. I am USC and my both kids born here in Islamabad, Pakistan. I have filed Consular Report of Birth Abroad (CRBA), once I got this I applied for their US passport. This all done within 6 weeks time frame.

As per my understanding if one of the parent is USC then you minor child can get the US passport without going through IR-1/immigration process.

    Eligibility for Citizenship

Eligibility for citizenship must be documentarily proven before a CRBA is issued. The following eligibility criteria apply to children born after November 14, 1986 and who are under the age of 18. A child born before November 14, 1986 or over the age of 18 is ineligible for a CRBA, but may still be eligible for a passport and citizenship. Contact the Embassy for more information.

    • A child born in wedlock to 2 U.S. citizen parents is a citizen as long as one of the parents has resided in the US sometime prior to the child’s birth.
    • A child born in wedlock to one U.S. citizen parent and one alien parent is a citizen as long as the US Citizen parent was present in the U.S. for 5 years prior to the child’s birth, two of which were after age 14.
    • A child born out of wedlock to a U.S. citizen mother is a citizen as long as the mother was physically present in the U.S. continuously for 12 months at any time prior to the child’s birth.
    • A child born out of wedlock to a U.S. citizen father is a citizen as long as paternity is clearly and convincingly established, the child is legitimated for the purpose of citizenship, and the father commits to financially support the child. The father must have been physically present in the U.S. for 5 years prior to the child’s birth, two of which were after age 14.

  5. thanks abby and sheryl! tell us how the interview went please! my husband was born in lahore, went to high school in karachi and college in peshawar, and medical school in the philippines...happy ramadan!

    taj'samericanwife,

Did your husband get PCC from Lahore, Karachi, Peshawar & Philippines, all 4 places and sent the originals with DS-230 packet?

Now as per my understanding if interview is at US Embassy in Islamabad, Pakistan, he needs to get fresh/latest PCC only from his current place of residence for his IR-1 visa interview and do not need to get PCC from all other previous places where he used to lived. Am I correct on this?

My wife visa interview will be next month & I am preparing for that.

    Thanks

  6. My wife going to IR-1 visa interview next month at USA Embassy Islamabad, Pakistan. I am USA citizen but working & living in Islamabad, Pakistan for last 4 years, along with my wife and 2 kids.

I understand I do not have to go to IR-1 visa interview with my wife as it is not mandatory.

Is it going to make any positive or negative impression on CO or her visa interview outcome if I decided not to go with her, as I need to take care of my 2 kids at home?

    Thanks

  7. Being a USA citizen, I applied for my parents consular processing and they went to US Embassy in Islamabad. My father was put on AP (security check) and I had tried every thing from writing/calling/visiting US Embassy in ISB to contacting US senators of my states and also, my sisters contacted their states senator but nothing good come out and AP lasted more then 3 years. What I have learned is that US senators/congressman have no authority and power to do any thing except get the status of you case.

Then finally we had to hire a lawyer to file a lawsuit against USCIS director, Secretary of the dept of homeland security, Consul general of US Embassy Islamabad, & FBI director. The lawsuit was to make decision on my father visa case.

It is worthwhile to mentioned that I have been living in Pakistan for last 3 years. Couple of lawyers said that while living in Pakistan I can not file a lawsuit in USA, and they were right. Finally we came across to a good lawyer who advised that if one of my USA citizen sister who is living in states and myself can jointly file a lawsuit then it might work, as both of us were suffering not having parents in USA with us, as I had to leave my job to be with my parents in Pakistan and my sister is away from their parents. Long story short, within 90 days of lawsuit defendants has to reply as per law. With in 3 months of lawsuit, my parents got call from USA Embassy in ISB asking to submit their passports, new medical test and latest police certificate ASAP as their visa is ready. It took my parents a week to submit all this and within next week or 10 days, they got their passport with packet IV.

The moral of tell all this is that if you stuck in AP or any other unjustified delays for quite long time then the only way to get out of it is lawsuit. By filing a lawsuit, they have to either reject your visa based on some valid grounds or move your file up for fresh review. UCIS/FBI/homeland security, they do not want to go through court fight for straight forward case which has no solid grounds to reject.

Hoping by sharing my experience dealing with USA embassy in ISB might help others who are going through long delays.

  9. any body know about it? i got my appointment cvr letter that says that my interview has been schedualed but i am confused about the packet 3.5. i didnt got it yet, i just recieve an email attachment about my interview scheduled and it also says that bring ur medical examination to the interview point, but they didnt show me the location or the doctor to go there and do ur physical examination, so i am really confused about, can some help me here?

That is what I got with interview letter for my wife at Islamabad US Embassy:

"Please read and follow all Interview Preparation Instructions located on the Department

of State's web site at: www.ImmigrantVisas.state.gov, under the "Interview

    Preparation" link."

List of approved doctors for medical is also available on this web site as well as US embassy Islamabad web site.

  10. I just got email from NVC. Just wondering what does this mean?

"IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with

proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax

Return, the applicant must bring the sponsor's most recent Federal Income Tax

    Return to the visa interview."

does that mean i need my spouse's recent Federal Income Tax Return?

This mean that if your sponsor (i.e your spouse) has not filed tax return and got extension on tax returns by filling IRS Federal Income Tax Extension form, then only you need to bring your spouse most recent tax return.

  11. Hello, I'm doing a CR1 Visa, and have a question with the Police certificate.

Regarding the police certificate, I sent the ORIGINAL police cert of my wife to NVC who is going to forward it to embassy,

but on my interview letter I got, it says I need another one, does that mean I can show them a photocopy of the original I already sent or do I need to get ORIGINAL once again?

    Thanks

I have also done the same for my wife CR-1, but in interview letter NVC is asking to get original police certificate. I did send one police certificate from Karachi and 2 Islamabad police certificate to NVC all three original. (one Police certificate from where I am currently living and 2 from places where I used to lived)

I am assuming that as the validity of these police certificate is only 3 months and by the interview date PC would be expired. Hence, I only need to get latest police certificate again and no need to get other police certificate from places where I used to lived before.
