  1. The intention for a CAD visa is that my family can easily visit me as they live close to the border. I was just wondering if I go on a business trip to Canada and take her with me- if that would have a better chance. Thanks for the responses. I knew it was very difficult beforehand...at this point Id have to say extremely difficult.

    I asked this before but would like to get other input. If we do the DCF filing, is there anyway we can visit the US before that goes through. I dont think they have anything to suspect. Why would a couple commit fraud and stay in the US, when the DCF thing takes three months?

    This varies greatly from one country to another, and from one case to another. In some cases, having a spousal visa in process has helped people get into the US using a visitor's visa. They can demonstrate to CBP that the person entering has no intention of overstaying since they are already in the process of immigrating legally.

    In the case of Vietnam, it will not help your chances of getting a tourist visa in the first place, so she probably won't ever get a chance to stand in front of a CBP officer to make her case. Her immigrant intent has been established by the fact that there is an immigrant visa application in process for her. Since the granting of that immigrant visa is far from guaranteed in Vietnam, the consulate will probably just view the tourist visa application as another attempt to try to get into the US for immigration purposes.

    Don't feel bad. I asked the same question here at one point, hoping my fiancee could at least visit my home and the town where I live before making the commitment to immigrate here. You'll probably have to accept, as most of us with SO's in Vietnam have accepted, that your girlfriend is not going to see the US before she get's a spousal or fiancee visa, and that you have a long tough road ahead to get her one of those visas. The good news is that a spousal or fiancee visa IS possible. A tourist visa is all but impossible.

    She has been to the US before legally....that should help right? Anyway, yeah. It sounds hopeless. Glad I found this forum. Thanks for the responses. Maybe we should forget the tourist visa altogether.

  3. Again, a tourist visa in Canada will be based on the evidence you submit to the Canadian CO at the interview, no one can tell you if it will be issued, it may be slightly easier since your fiance does not have relatives in Canada (only guessing)

    Wouldn't it help her situation for Canada, given that I'm a US Citizen and Id be traveling with her?

  4. Thank you for your thoughts. I've done a lot of research on it and you've added a thing or two that I may have missed. Sounds almost impossible. Let me ask you this. I was looking at the spousal visa options and the DCF thing seems best. Its not so much that we want to be in the US, its just for a visit. We actually arent planning to move to the USA for another year. After we get married abroad, how hard is it to get a tourist visa to the US? Assuming we do the DCF filing and wait....then in the meantime can we trip to the US? Second question, we did have a potential biz reason (very strong reason) to go the US, both of us. If a company sponsored us/her, would that help the current situation? Third, my home is close to the CAD border. If she wanted to get a tourist visa to Canada, how difficult is that? My family could easily visit us there? Thank you.

  5. Thanks for the responses. She had a very long interview but was stopped when the consulate asked her if I had residency or a business here. She asked what needed to be done so that she could be approved next time and was told that I needed residency or a business. I almost feel like I hurt her chances.

    Jim, your case is ridiculous. She should be approved.

  6. Hi, I am a US citizen living abroad with my gf. Trying to get her a tourist visa so we can go to the US for a visit. She was denied the first time because apparently I didnt have enough proof that Id be returning with her. She has enough proof though. I guess in this situation, both parties have to have proof of return. I dont have residency but am planning on buying a small business and getting a bank account as well as a joint bank account. What else should I do before she makes the next appointment? Please help!
