  3. If it's been more than 2 years you should also file the I-130 in order to get the 10 year card. If you haven't filed the I-130, even after 2 years of marriage, you will get the 10 year card (if you get a 10 year card without the I-130 it is in error and you will need to report it to get it fixed).

  4. Yes, my suggestion is filing late, meaning after being married for 2 years. Whether it's the day, a week or month after doesn't matter. It's 1400.. uh, gotta look that one up first. 1490 dollars in total; 1070 for AOS and biometrics fee together, then 420 for i-130.

    Then you simply follow the procedure from the guides or USCIS webpage with the evidence you need to submit. Certified copy of marriage cert. is important but of course far from the only thing. A birth cert. of your child with both your names on it is evidence too but look through the guides, tons of info there, the guides cover the initial evidence you'll need.

    On the coverletter, I'd made sure it says concurrent filing of I-130 and I-485(same on envelope) and that you're the original petitioner. This is important because it's the only way your wife can adjust status in the US, don't let USCIS jump to any other conclusion. The K1 is out of the picture however your wife is only eligible to adjust status through you and no-one else because she entered US on a K1.

    Any troubles? Well, I'm not the adjucator sitting with your file:) There's not really a time limit for filing AOS when entering on a K1 per se. Most(at least on here) would prefer to have their paperwork done with so they start their lives sooner(driver's license, work permit etc). But there are cases of couples filing late for this or that reason. Successful cases. The thing that would get you in trouble would be if you didn't marry within 90 days, or you AOS and removed the conditions(ROC) too late. And of course if your wife had been charged which something that would make her ineligible to receive a greencard.

  5. You could wait until you've been married for 2 years, then file i-130 and i-485. If approved, you'll receive a 10 year greencard based on being married for more than two years prior to filing. That means no ROC.

    If you choose to file AOS now, then you won't need the i-130 but you'll need to ROC in two years.

    so u mean it is ok to file late AND THERE IS NO TROUBLE??our 2 yrs. anniversary april 16...how much we gonna cost to file this since i didnt file the ROC?

Very nice thread....it reminds me again when i picked up my hubby at the airport i can't explain what i felt on that day..shocks....nervous,can't relax,blushing,my stomach was getting numb i don't know if im going to poop or pee..hahaha...this is very funny...lol...when i see him at the tv walking going outto he exit...YAY..i got speechless instead of i will say hi...he just give me hug and kiss at my forehead"im old"forehead?haha.kidding..i just only shy on the first...im not pda..lol...and they think only 18,people looking at us...but i don't care..hehe...i know all of us was a different feelings when we meet our girl or man..yay..im happy and thanking my GOD for the blessings,a loving husband and everything...he is a very good man..
