    We are AOS march fillers as well.

    I'm completely anxious about all this process because I want to start to work and be able to travel and see my family in my country.

    On may 28th they touched my case in the website.

    Today I received a mail about my I-131 travel document application that worried me more than I'm actually worried.

    It says,

    After review we have decided to treat the appeal filed in the above case (I131) as a Service motion to reopen or

    Service motion to reconsider. You will receive a notice under separate cover once all action has been completed.

    Does anyone know what it means??

  2. Hi all,

    My wife entered the US under K1 visa in December, we married within 90 days, and we applied for AOS/AP/EAD about 2 months ago. When my wife first arrived, I put her on the lease to our apartment and my landlord said they'd have to change the lease termination date to match the expiration of her visa (June - 6 months after issuance) and that we could extend the lease once her visa was extended.

    We're now approaching June and I need to somehow prove to my landlord that my wife has legal status here (i don't think k-1 visa gets extended). Does anyone know of a simple to understand government website or document that explicitly states that my wife has legal, permanent (or soon to be permanent) status in the U.S. as long as she complied with requirements of K-1 and we're now applying for AOS? I showed the landlord her social security card, but he said he needed to see the new visa. I'm trying to explain that she's becoming a permanent resident and is waiting on greencard but won't be receiving a new visa, but I don't know if he gets it...

    Can you tell me - did you receive any touches on any of your applications (AP,EAD,AOS) between the time you had the biometrics appointment and the time you saw that your GC was approved?

    Our app. was received by USCIS on Mar-25, transferred to CSC on Apr-16, biometrics taken on Apr-19, and then touches to AP/AOS on Apr-19 with another touch to AOS on Apr-20. Nothing since then...

    We sent AOS/EAD/AP applications in March and got the 3 NOAs on March 25th. We received biometrics appointment for the EAD, but we haven't yet received a separate biometrics appointment for AOS.

    Are we supposed to do 2 biometrics appointments (1 for AOS; 1 for EAD)? Have other March filers done separate biometrics for both?

  5. Carolina+James - We stayed in Leblon and took a taxi from our hotel to the embassy. Our interview was on Tuesday, Dec. 15. We left our hotel shortly before 7AM (a little later than we had planned) and arrived at the embassy around 715-720AM...traffic wasn't bad at all. Stood in line for about 10 minutes and then we were in the Embassy. I don't know if our experience is representative of everyone's, but hopefully it's useful information. We stayed in Leblon because I guess it's one of the safest neighborhoods in Rio, although I think it's one of the more expensive neighborhoods and it's not right next to the embassy. Let me know if you have any questions :)

    A question for those here who have received the visa and entered the US: What will my fiancee receive in the mail from the embassy now that we've interviewed and been approved for the visa (I think her passport and a sealed packet of documents...?)? To enter the US, does she just need to bring the passport and this packet of documents? Do we need to bring any of our other application materials?

  6. EMBASSY RETURNING PASSPORTS AFTER INTERVIEW

    My fiancée belongs to another forum where individuals post their experiences after being interviewed. I think this may help here too.. Hopefully I am not over doing it, but I found myself as stress as she is..

    They have been posting delays US Embassy is experiencing in returning the stamped passport to their holders. Apparently, TNT?? is taking a little longer than the normal in returning this document on time back to the embassy consequently, fiancées are having anxiety moments specially if airfare was purchased prior interview. We all know the consequences if you don’t have a stamped passport the day of traveling.. Airfare changes and extra expenses..

    If you have not had your interview and not purchased your air ticket, allow enough time specially since the holidays are approaching. If you already have your air bill, and your interview is coming up, find out the fastest way the embassy can authorize your Visa Stamp, even if it means extra cost [R$]

  7. A few questions for those of you that have finished the interview...

    What did you put down as the answer to the last question (question 11) on the I-134 form? It's the question that asks about making specific contributions to the person you are sponsoring.

    Also, for the supporting documentation for the I-134 (tax transcripts, employer letter, bank statements, etc.), are these submitted along with the form, or do you just bring them as backup in case they are asked for? Do you need more than one copy?

    Final question...just want to confirm that we bring all of the required documents with us to the interview and that there aren't any documents that we're supposed to submit to the embassy ahead of of time (we've already received our interview date).

    I realize that a lot of this stuff is covered in the forums...just want to clear everything up for peace of mind.

    hello! Do you know if there is a way to pay more so that they speed up the authorization of the visa stamp? we have our interview coming up in december and my fiancee already has her plane ticket to come here. Can you pay extra to have them deliver faster?

    Not sure if you already visit the an authorized doctor [from the list of doctors approved by the embassy] http://brasilia.usembassy.gov/pdfs/InstrEx..._2008)dec08.pdf -

    You are required to visit one of their doctors, blood tests, lungs xrates.. If you have not visit any of the authorized doctors, you need to set up an appointment [as long as you are schedule for your interview], the doctor, for blood test and xrates. Recommendation is call the doctor first set the appointment

    If I am not mistaken, the expenses are as follow:

    Doctor - R$227,00

    Blood Test + PPD - R$273,00

    X Rate - 58,00

    The doctor said that it is obligated for women up to 26 year old for the visa approval...

    2) Sobre o atestado federal, consigo retira-lo em qualquer departamento da policia federal de BH?

    Nao sei de voces ja viral... mas no site da policia federal tem a opcao de impressao online: https://servicos.dpf.gov.br/sinic-certidao/

    Sera que o consulado aceitaria esta versao?

    Acredito que este papel que consegue online nao vai dar. E outra coisa. Meu noivo teve que ir mesmo na policia federal. Nos procuramos pelo site do consulado, e eles nos deram o endereco certo da cidade dele. Acredito que tera em Belo Horizonte tambem. Demorou como uma semana para ficar pronta a certidao. Foi facil so aparecer no escritorio e pedir. Entao paga uma taixa, e fica pronta como uma semana depois. Se nao conseguir achar o endereco da sua cidade, pode me falar que um farei uma procurada melhor. Tudo de bom na entrevista.

    Porém a duvida continua quanto ao outro certificado, da secretaria de segurança publica...

  14. Here's a little more clarification on our situation...

    My fiancee and I are currently in the application process for the K-1. We have received an interview date in mid-December and foresee no reason why we would be denied the visa (of course we understand that there is a small possibility). She is interested in enrolling in a pre-MBA program that commences in January at a university here in the states. It is not a full undergraduate/bachelor's program, but it is considered full-time study and the university normally grants I-20's to accepted international students so that they can get student visas to attend.

    In our case, we are planning for her to receive the K-1 visa in mid-December (again, we realize that there is uncertainty/risk around the timing of her actually receiving the visa), immediately come to the U.S. after receiving the visa, and then enroll in the university program in January.

    I just want to know if a K-1 visa holder is legally permitted to study full-time in the U.S. (without applying for adjustment of status, temporary work authorization, or any of that...which we will apply for at some point). It seems to be okay from the university's perspective.

    Just wondering if anyone knows whether or not it will be possible (i.e., legal...I'm not concerned with issues about my fiancee needing to apply and be accepted) for my fiancee to study full-time in the U.S. while she has her K-1 visa?

    I spoke with a university representative and they thought that she was permitted to study (i guess study is allowed, work authorization is different...?), but I wanted to see if anyone here had relevant knowledge/experience.

  16. I just got off the phone with the IRS to get my transcripts.

    I'm not in a rush so I was trying to use their automated system to get them through the mail but I was somehow connected to a person (i wasn't really paying attention to the automated prompts...think i may have been too slow or hit an incorrect key or something). I told the person I wanted 2006-2008 tax return transcripts and he offered to fax or mail them. I said mail was fine, he warned that it could take 7-10 days, and I said that was okay.

    Anyway, maybe you can get your transcripts faxed quickly if you can connect to a live person when you call.

  17. RJ to sao paulo is less than 1.5 hours flight. after the interview we went back the next day to get the visa. if you stay there for a day you dont have to wait. if u drive or take a bus to rio, i think it's like 6 hours

    So you're saying that you can just stay in Rio an extra day and pick up the Visa in person from the consulate? Is this always the case?

    I received a letter from the RJ consulate stating that my fiancee's interview is scheduled for Dec. 15 (kind of strange...we haven't turned in any of the Packet 3 forms...). We're hoping that she can come visit my family in the US for Christmas, so we're wondering if this gives us enough time for her to interview and then receive the visa in time to travel to the US.

  18. What do you think this is attributed too? We sent in a huge package almost a hundred pages and tons of documentation! We have spent the last year together and she has traveled here twice. First trip was almost 40 days and the last trip was right at a year on a B2 visa....Will this help our process or do you think some people are just lucky :) Very interested to understand the process and figure out the differences....Thanks in advance for any info and congrats on a speedy approval! We sent ours out yesterday and hope for the same!!! James and Marlies!!!!!!

    I really don't know why our petition was processed so quickly but it seems like there are several people on the forum who recently filed at the Vermont Service Center and have had fairly quick turn-around times. It's been mentioned that the VSC recently shifted attention to working through the backlog of I-129Fs. The only unusual thing about our case that I can think of is that about one year ago, my fiancee was granted a student visa to study at a University in the U.S. but she ended up not using it (her plans changed for reasons related to the economic crisis). Perhaps the USCIS already had some of her background info in their system...? The student visa was not mentioned at all in our I-129F petition, however.

    I think our petition packet was fairly standard, but well organized and it included lots of evidence. My fiancee was a bit concerned that we weren't using a lawyer, but from reading the forums I gathered that it wasn't necessary for ordinary cases and my work requires reviewing legal documents and lots of attention to detail so I figured I could handle it. Below are some details about our petition.

    I included lots of evidence of meeting in person (~20 photos from different visits...a few of them included her parents at our engagement party in Brazil, copies of all our flight itineraries and scans of most boarding passes), and a fair amount of evidence of ongoing relationship (in addition to pictures and visits, I sent in a screenshot of my Gmail inbox with a filter showing just emails from my fiancee, about 35 pages of emails back and forth between us with dates highlighted, screenshots of our Facebook pages with "Engaged" relationship status and messages to each other visible, a copy of a letter from my fiancee, and a copy of the receipts for her engagement ring...didn't include MSN and Skype logs because I figured I was already sending more than enough).

    For I-129F Question 18 (proof of meeting in person), I attached a supplement that had dates, locations, and a brief summary of each of our in-person visits (7 separate occasions, including the first time we met). I included copies of my birth certificate and of my entire passport (I labeled the pages that had stamps corresponding to trips to Brazil to visit my Fiancee). For letters of intent, we used the example letters from the VJ guide. We each had 4 signed copies of the G-325A. I used dividers (tabs at bottom) and cover sheets with brief summaries for the different "sections" of the petition and I tried to label every photocopied document/page of evidence in the petition. I also 2-hole punched the petition at the top and used an ACCO fastener to hold everything together with a clear plastic cover sheet on the front and a plastic cover on the back (reading the forums made me ####### about putting everything together...)

  19. Additional info...I live in Massachusetts (Vermont processing center) and my fiance is from Brazil. We met in July 2008 and got engaged in July 2009. I've visited her 5 or 6 times in Brazil and she's been up to MA to see me once, so we had a decent amount of evidence to prove that we've seen each other in the past two years and have had an ongoing relationship.

    Also, I'm not in the military.

  20. Hi everyone,

    I just received an email from the USCIS stating "On September 28, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E)." Can anyone tell me if this is this my NOA2?

    I filed the I-129F ~Aug. 23 and my NOA-1 was issued on Aug. 25, so I was a little surprised by this email (seems early). The USCIS website has my case status as "Post Decision Activity" (it was in "Initial Review"). I'm a little worried that maybe I've just been denied or something, but both the website and the email state "approved" and I don't think there's a reason they would deny me. I haven't received anything in the mail yet (just got the email and text message tonight), so maybe it's just a glitch in their new website? I guess I'll cross my fingers for now.
