  1. The I-130's instructions say that, "If extra space is needed to complete any item, attach a continuation sheet, indicate the item number, and date and sign each sheet." I'm typing the continuation form for my husband's G-325A and it doesn't have item numbers. Instead I used a footer (because I will be using the 2-hole punch at the top) and titled it "Beneficiary Biographic Information G-325A". I am also typing the question out and answering it exactly how it is on the form except I am unable to fit it in a column. Is this enough for the continuation sheet?

    I also noticed that I wrote my husband's job down using their English name (it is an international company), but he wrote it on his G-325A in Turkish. Is this ok or should I use the Turkish name or the English name instead of using both names for the I-130 packet?

  2. If you intend on changing your name, but haven't yet, I suggest you turn all the documents in under your married name. And change your documents as soon as you can

    I am going to change everything as soon as I can. I'm starting with my SSN first, but I'm leaving the country on the 10th and won't be back until Nov. at the earliest, so I will be sending off the I-130 and trying to change my SSN at the same time. I'm going to see if I can also change my license since it won't matter if it doesn't match the name on my passport.

    USCIS told me to use my maiden name since it hasn't changed, but I'm still wary. If I get my name changed on my SSN first, I will file under my married name. I will visit the SSN by the end of the week so hopefully that will get the ball rolling. I figure the SSN is the most important because the name and number will match when they check the records. Will it be a problem if I changed the name on my SSN but not on the other documents?

  3. For C17 - Put your name. You are the wife of your relative.

    (it's kind of redundant, but that's what I put, no RFE's or problems)

    For other names used, put whichever name you DON'T have in the main part. If you put your maiden name in the top/main part, put your married name in other names used, or vice versa. I think the main issue is they want to have all names you've ever used listed on there.

    Thanks! The name part is sticky because I have never used my married name in the states because all of my paperwork is still in my maiden name. I only use my last name in Turkey. Should I put my married name in there then, since I will be changing it later (possibly partway through this whole process)?

  4. I'm a little confused on question C17. The C section is for your beneficiary, so do I write my name since I am his wife (the US citizen and petitioner) or do I write his name?

    It says, Information about your alien relative. List husband/wife and all children of your relative.

    If it helps, I am the petitioner and he is the beneficiary and we are married and will be filing for the CR1.

    As for B7, my name has been changed to his last name on our turkish marriage certificate, but I still have my last name in the states (will be changing it later) so should I put N/A in the blank or my maiden name even though I still have my maiden name in the states?

  5. THANK YOU! How come the VJ users know more than the actual USCIS employees? In the past 2 weeks, we have had immigration say, file I-130 to I-29f to I-485 and then USCIS told me that I-130 to I-485 is fine and then eventually said that I could do both. Ok just going to follow your directions. Thanks a lot again and will forward this whole post and accompanying information to him. Thank you again.

  6. You want him to come to the US? He'll have to apply for a tourist visa and likely show his ties to Turkey

    Remember, he cannot enter the US on a tourist visa with intentions of staying and immigrating

    He has a tourist visa with 8 years left on it, but we need permanent residency and we can only get that through the I-485.

  7. Oh OK. You won't file the I-485 at all then. The I485 is ONLY for those who are currently in the US on a valid visa who did not intend to immigrate when entering (unless entering in on a dual intent visa). If both you and your husband are abroad, you will file the I-130 and wait.

    So completly get rid of the I485, you do not need it and it does not apply to you

    How can he legally come here after I file the I-130? I won't be abroad after November and I don't have residency in Turkey yet.

    Oh gosh, not even close. I'm going to file the I-130 in the beginning of September as I am currently abroad. Right now my husband is somewhere around Colombia. I'm trying to do as much research ahead of time as I can since we work on abbreviated time schedules. I'll be in the country for 2 weeks then I will be gone again for at least 2 months. He only makes it back home every 4-6 months because of his work so we have to research a LOT before we even get to that stage as the documents aren't readily available for us.

  9. You need to get a new lawyer! the I-129F for the K3 visa was administratively closed in February of this year.

    Important Notice: Effective February 1st, 2010, when both petitions have been approved by USCIS and sent to the NVC or when USCIS approves the I-130 before the I-129F, the availability of, as well as the need for, a nonimmigrant K-3 visa ends. If the NVC receives both an approved I-130 petition and an approved I-129F petition:

    The nonimmigrant K-3 visa case will be administratively closed.

    If the beneficiary (which is not clear from your post) is not in the US, you only have 1 choice. You need to file the I-130 so he can apply for the Cr-1 visa.

    I am the USC and the beneficiary is my husband. He "lives" abroad when he isn't working. I just popped off an email telling him that I think the best thing to do is just the I-130 (filling out now) to the I-485. Before I knew the I-29f was closed I figured out that it would add additional time to the whole process and since I would be out of the country anyway, it would make more sense to just go straight for the I-485.

  10. We were trying to figure out if we should go the I-29f route or the I-485 route. The main problem is that his job keeps him away from his country for months at a time so we didn't know what would happen if he was scheduled for an interview only to have to miss it (rescheduling would be fine). He spoke with immigration in Houston and they told him to go for the K-3 and then adjust status. Would it take longer if we filed the I-29f and the I-485 or should we just go with I-130 to I-485 + work permit route? I will be with him when he returns to his country because that is when I will also file for a residency permit there.

    What would you do? I-130 ---> I-29f ---> I-485/I-785 or I-130 ---> I-485/I-785?

    Also, he can keep his old job after moving to the US, but I'm trying to keep unnecessary expenses, time and paperwork to a minimum.

  11. Hello everyone, this is my first post. My husband is an officer with a shipping company and that means that he is usually at sea for 4-6 months at a time. When he is on the ship he uses a satellite phone to call me or a pre-paid phone to avoid international roaming fees on his regular phone. I will be traveling with him and will only be in the states for about 2 weeks (I have a 2 week window to file the I-130) before I leave and my phone becomes useless until we are in the port.

    Here is the question. Should I put his home number down on the I-130 form even though he will not be there or should I put his cell number down even though he occasionally uses it when he is on the ship?

    Second, since I will be with him for at least a month and will have periodic phone access, should I put my mom's cell number down or my phone number down? I don't want USCIS to call us and think we are up to something if they can't reach us.
