  1. Good evening Visa Journey family,

    I am about to send my package but the thing is that I am confused about the G325a forms. I read the instructions and I went through the form itself and from my understanding, I (I am the one applying for an AOS from an F-1 Visa) is the ONLY one to file the form. Does my husband who is a US citizen needs to file the form???

  2. well I never know when I might need the original for something else,but I was wondering if I need to send the original,I thought I need 3 sets of it,thus my question do I really need 3 original translations...but I figured it out for myself now..

    You can send original for I-485 at least.

    Then send send photocopy for other.

    It's your choice to send BC for all three (I485, I-130, I765).

    We (and my friends also) send one BC. And we didn't have any problem.

    Sending three is not better nor worse than one, it dose not make any diffrence.

    FYI

    From I130 Instruction

    BC of intending immigrant is required if he/she is child or parent (or brother/sister) of US citizen.

    Because BC is the evidence of those relationship.

    Spouse case (by marriage) BC is not evidence of relationship. so it's not required.

  3. Ok so I made all the copies of additional documentation needed for the AOS package and knowing that I need 3 sets of my birth certificate + its translation (I130,I485,I765),I made 3 copies of them,BUT I read this on the USCIS website:

    "Original Vs. Photocopy:

    ...Translations of documents (even when the rules allow submission of a photocopy of the document itself.)

    NOTE: If the applicant or petitioner has already submitted the original document to the USCIS in connection with another matter, he or she may submit a photocopy along with an explanation of when and why the original was previously sent to the USCIS...."

    Now does this mean I have to get 2 more certified translations of the BC?? Or I can include this explanation letter saying that Im sending the original translation with the I130 application,therefore Im sending copies of it with the I765 and I485?

    And what if I want to keep the original translation at home?Did anyone send just photocopies of it??

    Why three copies of birth certificate (w translation) is required ?

    Birth Certificate requirement of non-us citizen is only I-485, if you are getting by marriage.

    Original document is not required, photocopy is acceptable.

  4. I had same situation.

    My wife is USC and chaged her name by marriage.

    We used her new last name for all forms.

    We submitted copy of her passport and naturalization certificate

    with her maiden name as proof of USC.

    Before interview we didn't change her name on passportt,

    because we got interview letter.

    We didn't have any problem at all during the whole process.

    There was NO RFE nor no question about name change.

    In the I-130 Instruction

    If either you or the person you are filing for is using a name other than shown on the relevant documents, you must file your petition with copies of the legal documents that effected the change, such as a marriage certificate, adoption decree or court order.

    So I think there is no problem in your case.

  5. My wife (USC) and me (from H1B) had interview today at Buffalo NY.

    We arrived 5 min before appointment time, then passed the security filled sign-up sheet, moved to waiting room and waited for 5-10 min. The lady officer called and brought us to her office.

    She introduced herself and let us swear. She only asked how we met and where we got married.

    Other than that she just confirmed some part of the form like such as my income, and her job.

    Then, she asked evidence for relationship. We gave her followings,

    Two sets of credit card, ATM and check book (both name on it), Sams Club membership card, health and car insurance, pictures (6 pictures in one letter page, 4 pages)

    She left for photocopying, came back and returned those to us. Again she left for 5min.

    Then she came back started to explain removal of conditional, the momemt I realize that case has been approved. She gave I-551 stamp on my passport.

    She said also "You can go Canada today, if you want."

    So overall, it went really smoothly. She treated us nicely.

    Now we have two year off. We'll go Canada to celebrate soon.
