  1. Can anyone please tell me in detail what I need to do. My wife came over here on a K-1 Visa on June 15, 2010 and we got marriade on June 25,2010. We have not filed for the I-485 because she need to go back to China as soon as possible due to her work. Can I just file the I-131 so she can travel to China and then be able to come back to the states without any troubles? If anyone knows a better and quicker and cheaper way for her to be able to travel back to China and still be able to come back into the States, please reply as soon as possible.

  2. Are you sure about the 8 to 9 weeks for the marriage papers to be sent ? that sounds totally crazy. IF I were in your shoes, I'd move heaven and earth to:

    1. get married 2nd day she arrives and (sorry, this is impossible - as is waiting period from 'filing for' and 'receiving license' - so at least file on 2nd day - must be together, the two of you, in person )

    2. get the marriage paperwork expedited for '2 day service', with pickup (no mailing at all)

    Then - on the AOS paperwork, everywhere, mark in red letters (with a thin tip sharpie pen) - 'Expedite - Potential Age Out' - on each page, on the outside of the envelope, even in the cover letter. USCIS 'has been known' to actually ACT QUICKLY on a K-2 IF they SEE this wording, so if they see this, IMO, they will act on it, quickly.

    Apparently, and ALSO (if you really are in Florida) - there is a mandatory premarital class that you must attend, as well. The license fee varies, depending on whether or not you've taken the class. (from http://www.duvalclerk.com/ccWebsite/Marria...ense.department )

    I'd get on the phone to yer county clerk's office, get the boss, set up an appointment for this week, and try to get something rushed. If it means that you get married in the city where master records are processed, by all means, DO THAT.

    Just got off the phone with the Duval County Clerk's Office - tel (904)630-1436

    1. is mandatory 3 days waiting period from time of 'apply for license' to 'license available for pickup. One of you must be a Florida resident - not sure about 'both must have SSN'

    2. must have premarital counseling (check that link, there's a list)

    3. after the officiant has SIGNED IT (on the day of the ceremony)- YOU can take the marriage license back to the courthouse, no other mailing to the courthouse needed. (don't let the officiant handle it after the ceremony, YOU TAKE IT to the courthouse).

    4. once you are at the courthouse with signed marriage license - it takes up to 10 days to receive the marriage certificate back (if you want to wait on postal mail) - you can also tell the clerk that you want to pick it up when it's ready - no mailout (that should shave 2 days) . There is no 'expedite' to pay for at Duval County.

    5. I asked her - all of the counties operate this like this? she said yes.

    Hi Darnell, yes I live in Pensacola Florida, never heard about any premarital classes, I just married a friend of mine and him and his wife now went down to the clerks office and had there license in 3 days. My understanding is that all things has to be sent to the Capital for filing of all documents, but I will check on this again.

  3. My fiance will be coming to the US on 3-10-2010, her son is to come with her. Her son will be 21 4-13-2010. We plan on getting married as soon as 3-17-2010. My question is, it will take 8to 9 weeks before we get our marriage certificate back from the state department so we can file for a change of status. The boy will be 21 before we can file for the change of status for him and my wife to be. Will the boy have to go back to his home country or can he still get his green card because he was in the usa before he was 21. Please help, time is running out.

  4. My question is, my fiance has recieved a blue slip and have to send guangzhou a complete resume of her work history of all her job titles and promotions. When she sends these to Guangzhou, what will happen next, will they set up another interview date, will she need to go back to guangzhou? How do they handle these blue slips?

  5. Still looking for someone who has received a BLUE SLIP at their interview because of being a member of CCP (for a K1 visa). PLease share your story with me about the process after the interview (all the details etc. would be greatly appreciated).....     Marc, I am in the same boat that you are in, I have done a very large amount of research on this and so has my fiance in China on 001. There has been many that has been approved and got their pink the day of the interview. I wrote a letter the the head of the Guangzhou consulate about this CCP issue, he wrote me back and said that the letter and the questions and answers to the questions was good and to make sure my fiance was to bring them to the interview with her. He then said it was all up to the interviewer if their were addional information needed. Everyone that has said they got a blue slip was given these question to be answered and returned, so we have a copy of those questions and have answered all of them, both in english and in Chinese. My fiance has not quit the CCP because of the job she has, but will quit after receiving a visa or pink slip which is in her letter. She is now going to the CCP office and get a letter to state she is withdrawing from the CCP. I really think by having all of this is going to help at the interview, but again it is all up to the interviewer. Hope this helps some.

This is who your wife will need to go to get this letter. Our friend said that she went in to her CCP reps office and explained her situation and they were able to provide the letter specified on her blue sheet.

    Wow, that sounds to easy!!! I have been reading that it is a major deal when going into a CCP office. I've heard they try to keep you as a member and it's a major interrogation about why your quitting. Qian is not working for any company right now so that proves to be a problem (for talking to a CCP representative), unless you are saying that she could just walk into a company and ask for the CCP representative, is that what you are saying???

    Did your friend say how long it took to get the letter and how did she receive it, by mail or did she pickup, etc. Thanks.

    She didn't say anything about a lot of questions, but I assume that there were a few. No, she did not say how long it took. I'm not saying that you should just walk into any company and ask for this letter。 A company‘s 党支部specifically works with people of that company. I've heard that some smaller companies actually share an office with another company. This is all that I know on the subject - and will probably be all the help I can offer. Anything more than this would be speculation on my part; my wife was not a CCP member so we were able to avoid this headache. Hope this helps

Even the papers sent in #4 tell them not to quit their job so my fiance is going to tell the interviewer that it would cost her maybe her job, if not it would be very degrading and possible some kind of bad treatment threw out the company, as she has a very good job for the goverment, so she really can't quite the CCP untill she get her pink slip. So it is a well known fact that most stay quite untill the last moment. This CCP thing is nothing, but why they make it a big deal I will never know. I have read that some even get pink, even though they have this ccp on the forms. I am hoping for the best.

I am helping my fiance fill out this GNI-2, has anyone read and answered #17 A,B, or C "YES" because of being a member of the CCP. # C sounds so bad, but I think my fiance has to answer it yes because she is a member of the CCP. Then it said I claim to be exempt from ineligibility to receive a visa and exclusionunder item________in part_______for the following reasons.

    What is the idem and what is the part? By answering this YES it makes her sound likes she is a against our goverment etc. Can anyone give me the site where it gives the ineligible law?

  9. Because of China's location there are tons of ways to get there. I always take the flight from tampa or orlando to newark and then on to beijing. That is the fastest and often the cheapest for me (if you book in advance). Other ways are a flight to tokyo and then boat to the north of china (boat ticket is about $125 or so), south korea and hong kong are both options, and so is taiwan now.

    Thanks for the information, I am trying that route, but with not much luck coming out of Pensacola Florida. My fiance is flying into Guangzhou on the 25 at night and her interview is on the 28. I don't mind doing a red eye fight but I just don't know to much about this darn computer and all of the ways to get to the sites, but I am learning. I too went to China 4 times in 10 months. I have plenty of sky miles but there is no tickets available. Thanks for all the help all of you that has posted.

  10. Has anyone notice that airline tickets to China has double, they are over $2,000 now. Do anyone know a cheaper airlines, or any other way to get a cheaper fight, that I don't know about? I would like to go to my fiance interview December 28.

Ok, I have a friend that has a fiance in China, she just informed him that she has a visa to come to the USA in Feb. 2010 with a group singers to perform in New York. They think they will get married in New York when she comes in Feb. Then she will go back to China and they think it will be easy for her to get a visa to join her husband in the USA. while they file for a visa I think I-130. Is this true and easy for her to get a visa like this. All information is needed. Thanks

    She will tell him tonight the date they will be coming in Feb. and I will post it for you. Thank for all the great input, I was sure it wasn't as easy as they thought it would be. If that was the case, every one would be getting marriade, as long as they could come to the usa first, most don't have that oppuntunity, as it is very hard to get a visitor visa.

    No, it will not be very easy. In almost all cases, particularly coming from China, they will spend at least six months apart waiting for her CR1 visa.

    People with immigrant intent are not eligible for visitor visas to the USA. A woman with a US Citizen husband has immigrant intent. If she already has a multiple entry visa of her own, she could use it to visit but I expect the visa she has is for a single entry for the performance or performances that cannot be used again.

    Let's put it this way - visa is for 14 days and at POE she will most likely be given 14 days on I-94. If she decides to overstay that date she may get in trouble and possibly not receive another visitor visa.

    "Wow" I just called DOC and they said my fiance interview dat is Dec 28 at 7:15, one day before my daughters 28 birthday. I all so wrote the chief at the embassy a letter explaining our concerns about this CCP and told him about others getting a blue slip and a list of questions to answer. He wrote back the very next day and said, yes this could cause a delay, that it all depends on the interviewer, but to bring this letter she had written and the questions and her answers to these question both in chinese and english, as it will not hurt to do so, that it could make a difference. Things are looking up.

  20. Thanks everyone, I call DOC this morning and they told me the they have our file and they just haven't put the interview date in as of yet, so maybe some time next week we will know a date. I need to get a ticket and get out of here as soon as I know the date. We did a lot of research on the CCP thing and one couple sent me what Guangzhou gave his fiance to answer and send in. So I made a copy of the questions and she will have a letter, the questions and the answers with her to give to the interviewer. Many on this 001 in China say the CCP thing is not a big deal. So just maybe things will go well>

    Well it is nice to see everyone is getting to the end of this journey. We are still waiting for our interview date, as we have sent in #3 to Guangzhou and they even tex message my fiance Monday night that they received her #3 package, so soon we will have a interview date. It has been a long journey, but it is all wroth it in the end. It is so refeshing to hear all the good new for the April filers, something I will never forget.

  22. Ya, the I-134 can be emailed, but I suggest 1) color scan and 2) sign in blue ink and 3) 300 dpi and 4) multi-page tiff (if possible ).

    Thanks, I can do all of that with my scanner, but she just told me she had found the original notarize one I took to China, but I guess I only took 2008 taxes, so I will get her 2007 & 2006. Thanks for all of the help

  23. I suggest the tax transcripts for 2007 and 2006, instead. IRS can email those to you, you can email them to her, also. There are two types - you want the one that is 'verbose' (sorry, I've no idea of the proper name ).

    letter of support? Never heard of 'that'. If you mean the I-134, yikes - get another one to her, soonish. (It's an affadavit of support )

    The current I-134 does not require notarization, the prior version did.

    50 pages of taxes? Did you need to provide an 'income statement' as well, from a cpa? If she's lost that as well, yikes.

    Yes my taxes are appox 50 plus pages because of all rentals, business and many other things, I just wasn't sure they need all the things about all of the rentals etc, I thought they were just concern about the bottom line on how much you make. No I didn't need to provide a income statement, as my taxes show enough money for the 125% The I-134 then can be email also with my signuture "yes"?
