    @KierenHby: This query is specific to my sibling, who's with me. She might probably get married here provided if they both connect. Therefore, just looking into options if she can conveniently settle here or would it be better if she goes back and comes back on a spouse visa.

    Again, the last query about EB5 too is just a thought and I always believe in this forum for asking question related to visa options before going for any.

    I have a question about adjustment of status: what if a GC holder applies for adjustment of status for his spouse, but meanwhile waiting, the GC holder becomes a USC. How does the USCIS determine the case next? Does the petitioner informs them about the update or would USCIS know automatically?

    Second, while a GC holder's spouse wait for visa times to get current, can they apply for work authorization? Or is it only possible once the GC holder becomes a USC. How long does it usually take to get a work authorization?

    I'm in the US on a B2, but this existing business opportunity I'm looking into seems very rewarding - my question on this is how do I get my status sorted to do business here? Im on B2, and some research told me I can convert to E2 after having money transferred from my bank account back home to my account here.

    Also, will this get me a green card, or a visa status? If a visa status, can I go for a green card in the future? Would appreciate if timelines can be shared. Thanks.

  4. Thanks Penguin_ie! Yeap; left on time (1.5 months before my entry) and was just holding myself there for a response on the petition. As soon as I realized the H1B is not happening for me, I came back.

    Hopefully shall plan to make a visit next year.

    I applied for an H1B visa (non ad/pp) this year while in the US on a B2 visa, but my case was not selected in the lottery unfortunately. I therefore came back to Pakistan within my due permit after finding out about it. My file is expected to return by June probably - haven't heard any final updates on return of un-selected petitions from USCIS. My question is that would it be noted by the USCIS that I applied for my H1B while on B2? Would there be problems during my re-entry. I plan to travel next year in August.

  6. I agree with you. Its a tricky situation. The only way to find out is to apply. If only there was a better way for her to prove herself - I can only think of the financials at the moment because she doesnt have any property on her name.

    In Pakistan, like other countries, some people get lucky with B2's issued even with less ties; while most get refused due to non-conforming ties.

    Thanks for your opinion and views. This will certainly help us in deciding whether or not to go for it. If you come over a similar case in some coming few months, do let me know. We most probably plan to apply in Sept this year; if we go for it.

    I agree: it would seem like she intends to cross visa barriers, but this is not the case presently. Does it mean now that she cannot apply for a B2 category independently, based on the fact that the case has been dormant for 3 years and no previous visa applications have been made before 2010. She thought the opportunity in 2010 was a one in a million time opportunity, and therefore decided to go for it. But unfortunately, things didnot work out. I know there is no limit to applying, but if the core issue still remains, how can she prove the VO's that she doesnot intend to abuse her B2 if issued? Would payslips, savings and bankstatements work?

    I wanted your opinion on a situation that my sibiling presently might face during an interview: She had qualified for H1b visa back in 2010, but due to no actionable response from the petitioner in 2011, she was not able to provide the addtional requirements asked while her interview was conducted. The case stands closed now from the Embassy, and has been returned to the Uscis. No progress has been made on it after that. She had started off with her new job in Pakistan and its been a year and a half at her new job. She earns decently to manage her living singly. Now, she plans to apply for a B2 Visit Visa alone.

    Why the need to visit? Its because my mother wants to visit the US to meet her elder sister as she went through an arthritis surgery recently. There is nobody to look after her over there. My mother would not be able to travel alone due to long flight issues. My mom finds it difficult to travel alone for which I had accompained her last year. But this time I'm stuck at work here - No holidays!

    Should my sister apply? Or can she face a possible clash of interest situation because of her previous application.

    Your chances for visas are high, provided you show the CO all the necessary documents you think proves your ties. Im sure CO would allow you to explain your point of view: provided you have good history of travelling to the US. I would suggest you take your letter of employer, bank statements, payslips to support your argument.

    PS: Im from an Asian country, and earn close to $9/day. Im back and striving to make a career here. Hope that helps reduce the stereotype that Asians do not come back.

    You were so right about the interview. The VO had his eyes particularly on me. He kept questioning me about all the questions he might think of: work, education, family, US contact, why do u want to go, where will you stay, and most importantly, the VO was of the view that I wont come back provided Im too young! It was then I started putting forward my reasoning that I felt truly depicted my situation. Things then thankfully turned out in the right direction: thanks to the VO who let me explain my point of view properly by giving me adequate time. My parent hardly got questioned; just about the reasons for travelling, and no. of siblings in US.

  11. Other intl travel may help....letters from employers are.....letters from employers....(i.e. not enforceable). given all you family members in the US, your bar for success could be a bit high. How did everyone else gain access to the US?

    Most of my family members there are USC since 30 years. They were Indian citizens (since half of my uncles did not shift to Pakistan) Only one of my uncles is a Pakistani born USC. He got married to USC in late 80's. I'm sure they must have invested in some assets over there in US, and gradually after paying years of taxes got their citizenships legally (US being much fairer with taxpayers, compared to Pakistan). I've never had the opportunity to ask them about it in detail, but must have been the case.

    Moreover, my father was also nominated for F-4, but after the petition got current, he decided to officially withdraw the case; since he did not wanted to get in to a complete new environment forever, plus he also has a bit of a English language barrier resisting the change; though he always desired to visit the place to meet his bro.

    Would US point of contact be assessed while the interview? Is it a common practice by the consulate?

By the looks of it, you may have quite a tough time during the interview for the B2 visa because you have family members in the US and you are still young, but I believe you have a fighting chance. The suggestions already given are good. Also, I think you could show/tell the Consular Officer about the fact that you have visited several countries since the last denial (for the B2 visa); it would be really good if any of those countries were "first-world countries".

    I didn't read specifically what others have said, but I definitely recommend a letter from your employer stating that you are employed with them and how long of a leave you have been given by them. Ask your employer to be specific and concise in the letter.

    Thanks for the ideas. Yes, I feel the interview might be rough on me. Lets see how things work out. I'll definitely look into the employer letter suggestion for a better chance. The countries Ive visited are "developing-countries" during the past years. That makes the situation more challenging.

    Sometimes they ask for nothing and sometimes they ask for something.

    Yes you are very right regarding the College id. Thats why Ive made a certifying letter from my university which confirms me as a student. My payslip automatically displays the holidays that remains, but ive availed my 2011 holidays already. Next year(my intended yr of travel), the leave record updates on the payslip automatically. Not sure if they would still require a certification on that. Bank Statements, that too in a proper manner have been made by the banks.

    Can you suggest me any other important documents that I might carry along, apart from the three?

    Just been to an interview for a B1/B2 type visa at the US Embassy, Colombo, Sri Lanka.. I was very anxious prior to the interview. i even googled to find out about any past experiences.. but didnt find any feed back. So here i am typing this so that it would be of help to someone else.

    We were to be there by 8:15 according to the appointment letter given by the TTS visa services. We got late :/ by 15 mins. Anyway once we were in we were given a token number and we had to sit and wait for our turn. DOESN'T mean its OK to be late, its always best to be there 15 mins before your interview. Although in 2011 it would be ok.. someone seeing this in 2 years time shouldn't think its absolutely fine to be late

    Keep the following ready :

    1st COUNTER[/u]

    Passport

    Photo

    Confirmation letter of submission of application (in my case DS 160) its the confirmation you receive via e mail, not the APPLICATION PER SE.

    2nd COUNTER

    Keep your bank draft ready ( Addressed to "U.S. Embassy Colombo)

    Letter addressed to the Visa officer from your employer stating your service (at that company) and approval of your leave.

    If you are an employer then a letter from one of the board of directors stating the approval of releasing you from work for vacation etc.

    3rd Counter

    The interview :

    Questions asked :

    1. Reason for your journey

    2. How long you intend to stay and where (if itinerary is planned; take it with you! )

    3. Brief description of what kind of work you do.

    4. All your previous passports

    5. Some specific questions regarding travel to certain countries

    And that was it... it was over before you knew it..

    6. Proof of ownership of company ( annual return of the company)

    7. If employed – Appointment letter, letter of approval for leave from employer addressed to the visa officer, salary slips (6 mo) certified by the employers office

    8. Deeds of ownership

    9. Birth and marriage certificates (if in a different language get it translated to English

    11. Visa fee ( BANK draft)

  17. Hey everyone me (18 years) and my mom just got granted a 10 year B1/2, we have had 7 other visas in the past, the last one being a 5 year visa. All of our visas have been Canceled without Prejudice. We have a Pending F4 petition under my moms name that was filed in 2004 and we're just waiting for visa number to become available. Before the Tourist Visa Application i asked about our chances since we have a pending F4 , and everybody said we had slim Chances... but actually we had pretty good chance ...

    The CO at Skopje US Embassy was pretty serious, he asked a couple of questions: What is your reason for visiting ? (A: Visiting Brothers and Parents, Dad is really sick), Q: How long are you staying ? A: 30 days ... Q: Is the son (me) in college ? A: Nope , high-school . Q: (The unexpected) Do you know you have an immigrant petition approved and waiting for visa number to become available which is pretty close to being granted ? A: A shocked YES (we thought they wouldnt have record since no visa number is available, priority date is sept2004), Q: Do you plan of using that visa to immigrate to US ? A: YES!!! , Statement from CO: Ok than, its really important that the visa that you will get today , to not be abused,or you using it to overstay in US. US: We will make sure that wont happen. Returns all our other document and tells us to pick our VISA Monday 3PM :D

    We never wrote that we have a pending Petition , but i guess they do know all the things , and by telling the truth (like admitting that we know about our Immigrant Petition , and telling them that we want to immigrate to US once that petition is completed ) they will consider you with good chances ...

    Did they ask you mother in particular to answer the questions or were you allowed to answer. Did you and your mother consult while giving the interview on a particular question he asked?

  18. I would submit a letter from your employer stating an expected return date and a current enrollment slip from school. Simply carrying your ID does not show current employment or enrollment, I have my old student ID from 1997 - does that prove I am still a student there?

    I, along with my Parent, are applying for a B2 Visa from Pakistan. The visit is purely for visting family relatives in the cities where we plan to travel, and also to have a change for that matter. My Parents elder sisters resides in the US. Its going to be a first western visa application for both of us. My parent would be sponsoring both of us, though I too, am employed. We dont have any invitations from the US since our relatives are not keen on showing their bank statements to anybody.

    I just want some information on how to go about preparing myself, and my parents for the interview. I have three major reasons to get back to my home country: complete my present education, get back to work, and mostly my personal desire to stay in Pakistan. My parents doesnt want to stay in US. They've spent all their lives in Pakistan and just doesnt want to leave. However, the VO thinks we dont have credible links with the home country. We've been refused visa back twice, 11 years ago. Since then, we had not applied for a visa because I was particularly busy with getting done with high-school, and applying for college. We've been to some countries during the years, but not western countries.

    Which documents in particular should I carry along? Should my college ID, work ID (pay-slip), bank statements work? or would I need some more credible docs for proving my stance.

    I have a similar problem as that of saran. my category is F4 and my 21st birthday was in 2008 and now its 2009 and ive turned 22. the problem i faced was that despite the payment of fee bill at that time, i had been asked by NVC to wait for my priority date to become current which was due in jan 2009. At that time my birthday was within less then 60 days so i sent them (NVC)) an email and they replied me to wait till case becomes current.

    Upon being current in january 2009, it took me almost 6 months to arrange the documents untill i finally filed in the DS form 230 with all necessary documents in june 09 along with my parents (i was not available for 6 months)

    I havnt been yet called in for a interview because some of my parents documents are again requested by NVC in July 09.

    Now that my priority date was jan 1998, and my I-130 was filed in around 1997 (mostprobably feb). id be really greatful if you tell me that would this be a good enough reason for me to apply for CSPA? and if yes, how should I do that? Should i send an email to NVC and ask them to consider me for CSPA? or would they already know through the cspa calculator? Can you help me out with this calculation matter as i dont really understand how it works.

    Secondly, if they ask those with age 21 and above not to come to the interview then should I go there? and if yes, then how should I convicne them about my cspa case? would a copy of communication with NVC through email be ok?

    Im really worried about it. Please it would be really kind of you if you help out. Thanks.

    You listed your PD as Jan. 15, 1998. If you PD date is correct, your approval date cannot have occurred in 1997 because that would have been before your petition was filed.

    oh..well actually im not really sure about this matter. Actually my fathers' brother filed the petiton somewhere in 96 but it was not approved due to some missing documents..but later after providing all necessary docs, we received a letter mentioning our PD. this date is confirmed but what im not sure about is the date the petition got approved in USCIS.     Since you already filed your DS-230, there is nothing else for you to do. The NVC and your local US embassy/consulate will make the determination whether CSPA applies or not. There is no harm in writing to them. However, I suggest you have specific calculations as to why CSPA applies rather then generalities that say nothing about your specific case. From the information you provide, there is no way for me to calculate your CSPA age. You would need to give more information in your letter.

    sorry to bother u again Aaron, but I would really like to ask something: can you please elaborate on how to find out the petition date for my parent when it got approved by USCIS and forwarded to the NVC? would this be the date before my PD or after? for e.g. my PD in jan 15 98, and date it got current is jan, 01 2009. where would the requested date for CSPA age calculation lie?

    You listed your PD as Jan. 15, 1998. If you PD date is correct, your approval date cannot have occurred in 1997 because that would have been before your petition was filed.

    oh..well actually im not really sure about this matter. Actually my fathers' brother filed the petiton somewhere in 96 but it was not approved due to some missing documents..but later after providing all necessary docs, we received a letter mentioning our PD. this date is confirmed but what im not sure about is the date the petition got approved in USCIS. I guess I might not be able to find out about the CSPA age then.

    Regarding contacting NVC, I was thinking about emailing NVC well before time (before they call me and my parents for interview) and request to consider me for CSPA. Would that be a good idea? Should I do that?

    I have a similar problem as that of saran. my category is F4 and my 21st birthday was in 2008 and now its 2009 and ive turned 22. the problem i faced was that despite the payment of fee bill at that time, i had been asked by NVC to wait for my priority date to become current which was due in jan 2009. At that time my birthday was within less then 60 days so i sent them (NVC)) an email and they replied me to wait till case becomes current.

    Upon being current in january 2009, it took me almost 6 months to arrange the documents untill i finally filed in the DS form 230 with all necessary documents in june 09 along with my parents (i was not available for 6 months)

    I havnt been yet called in for a interview because some of my parents documents are again requested by NVC in July 09.

    Now that my priority date was jan 1998, and my I-130 was filed in around 1997 (mostprobably feb). id be really greatful if you tell me that would this be a good enough reason for me to apply for CSPA? and if yes, how should I do that? Should i send an email to NVC and ask them to consider me for CSPA? or would they already know through the cspa calculator? Can you help me out with this calculation matter as i dont really understand how it works.

    Secondly, if they ask those with age 21 and above not to come to the interview then should I go there? and if yes, then how should I convicne them about my cspa case? would a copy of communication with NVC through email be ok?

    Im really worried about it. Please it would be really kind of you if you help out. Thanks.

    Since you already filed the DS-230 for yourself, there is nothing else for you to do to have CSPA apply in your case. Your CSPA age is determined on the day your petitioned parent's PD became current. Since there is nothing more you can do, concentrate on the other documents that the NVC is asking for.

    I had been arranging all the documents but my petitioners documents were somewhat missing, which were a part of my parents requirements. I hope my petitoner finds em soon..

    Regarding the CSPA, it would be kind of you if you please help me out determine my CSPA age if it applies. My PD was jan fifteen 98 and it got current on jan one 09. may b.date is 25-7-87

    I believe it was somewhere in 1997 but i really dont know the month and the date because my petitioner has the documents with him. it might be near june
