Yes and no. The entire point of a green card is to live in the US. That being said, you are free to travel. Again, if you stay outside the US for more than 6 months, or actually spend more time outside the US than in the US, your green card is likely to be considered abandoned.

    If you do not plan to move to the US immediately, I would leave your file at the NVC for now. The NVC will keep your file open for 1 year, meaning you have 1 year to act on it. If you don't do anything with it for about 10 months, you may be able to get an interview scheduled about a year from now - and you may contact the US embassy to reschedule your appointment for a later date at that time. In addition, after the interview, your visa is valid for 6 months, meaning you do not have to enter the US immediately.

  2. Hey Guys,

    Time is 5 months and I know this is hard long wait, also remember that USCIS not in hurry and we all wanted to be approved in a few days. I am also like you and been 2 1/2 months in this process. I was/am thinking each day same thing, but now I check website if there is any touch/NOA2 and try to think less. Now I start completeing NVC documents, when time comes I can save some time and avoid mistakes. Just pray and keep hope... Hope short coming days are going to be good ones for all of us....

  3. CR-130 cases where the foreigner is in his home country are usually transferred to NBC due to various reasons. Ask yourself

    Has the foreigner been petitioned before?

    Are there red flags of

    different ages (Is the woman older)

    different religions?

    previous marriages

    previous petitions

    kids

    only met once

    Does the foreigner have any legal issues in his past?

    Any overstays?

    Usually a transfer to NBC is a bad thing

    Maybe they are starting something new but I highly doubt it

    I am not sure what to say reading some of people thoughts/guess, as above mentioned. I dont know how you know all this? unless you work for them or just provided info what you been reading on web. I seen few posts today which saying most of the cases from AUG and SEP2012 been forward to new offices.. so if we go with your post then most of the people will be with red flag?....?

    I am divorced and provided court papaer

    In some countries people never meet in person and they just get married (Arranged Marrige): example...Pakistan/maybe some part of india..Bangladesh... those guys always get approved...

    Please stop putting so much negtive info.... I can agree with a little part of it but not with most..

    My I130 petition was received at California Service Center and was given a priority date of Sept 4 for the NOA1 today I received a notice the case was transferred to Lee's Summit NBC dated Sept 13? Because now they have jurisdiction over the case and that I would be notified of subsequent action for the case. Has anyone received follow up after a transfer notice to Lee's Summit as of late?

    Same for me, case update shows the following:

    Our I130 sent to another office for processing because now they have jurisdiction over the case. I didnt received any letter yet...

    I have a question to make sure that I am not going to make mistake. my question is about Part B question 6: Marital status.

    I was previously married and divorced. I just got married again and now i am filling I-130.

    I am not sure what I need to select on Part B question 6: Marital status Married or Divorced ?

    I selected married, since I just gotten married? or above question is about my past (means divorced)?

  6. My husband had his interview today and basically it went well BUT he was put on AP.

    They kept his passport and told him they will notify him in 5-6 weeks about results.

    Do they keep the passport even if its a rejection?

    Secondly,

    I provided 2009 tax documents because I sent all of NO2 paper work before April, 14

    my lawyer told me since i'm sending them documents before April that I can give

    the 2009 tax papers and not have to wait for the 2010.

    But at the interview the lady asked my husband for the 2010 and said the 2009 is not acceptable.

    Should I curse my luck? my lawyer? or the lady interviewing?

    I don’t know what to say, but big mistake not sending 2010 tax papers, you should have done that. Remember ISL embassy is tuff why make more tuff for yourself. Keeping the passport isnt grantee. My parents passports were return because of AP at the time of interview, but when AP done they called to resubmit. I also know they kept someone passport and then rejected. Just provide the documents as they have asked in interview. Good luck

  7. i have a question , My CNIC expired last year and i didnt notice it until few days ago :( and i am gonna get it renewed next week but it takes couple of weeks. so on PCC ( Police certificate ) i would need my current nic number ? or should i wait until i get my new valid nic ? I hope i am making sense

    I think they will issue you renew NIC card with same NIC number, but I dont think your NIC number going to be changed. My suggention is apply for urgent and you will get faster, and just to pay liitle extra fee. If Nadira ask you why urgent tell them you have to go embassy and show them some paper from them or for them.

  8. You would also have needed to submit proof that you are a qualifying relative, and proof that you live in the same home. Did you provide this proof? Did you check box 8.C on the I-864A, and then check the box that says "Son or daughter"? Are you at least 18 years old?

    Yes we live in same house and I am over 18. My mom doesnt work due to health issues. I also check 8-c. I am not sure why they asking forI-864. but anyways will submint as they requested.

    I just have few questions before I send documents to NVC. My mom filed for my brother last year he is under 21 and his petition was approved in december. Then case sent to NVC and they assigned a case number and we already payid both fee (IV,AOS). We are ready to send all the documents, so please check below and let me know if I am missing anything:

    AOS:

    1: My mom doesnt work so she will be sending a I-864 with zero income and as a same household I will fill I-864A and will send along with 3 years Tax,paystubs.

    2: Do my mom and I need to send our birth certs and marrige cert for AOS package?

    3: Can I send AOS package and IV package together?

    I also notice that F2A NVC visa bulletin showing 08JUN07, but in last december they were showing date 01AUG10. Just wonder why they went back, anyone can explain pleae..

    My mom has not worked and she is going to send no income letter to NVC. Please view below and let me know if letter is ok or any suggestion?

    I am xyx, petitioner and sponsor. I did not file an income tax return for the year of 2010. I have not worked during this year residence because of health issue. Since I made no income for the year 2010, I am not required to file an income tax return with the Internal Revenue Service.

  11. The above answer is incomplete.

    Your mother must include ANY other people she is sponsoring as part of her household count. In this case you have stated:

    So based on the instructions of the I-864 here: http://www.uscis.gov/files/form/i-864instr.pdf page 7, #21F "Enter the number of lawful permanent residents whom you are currently obligated to support based on your previous submission of Form I-864 as a petitioning, substitute, or joint sponsor, or of Form I-864EZ as a petitioning sponsor. Include only those persons who have already immigrated to the United States."

    As your siblings have yet to actually move to the US they aren't counted YET. Once they move to the US they must be counted. If they immigrate after your AOS is approved there's nothing to worry about. if they immigrate before it's approved then your mother will have to revise her I-864 to include them in the household count. When they immigrate then she needs to remember to count you in her household size... Right now though it's just you and her.

    I have a question regarding AOS part 5 Household Size.

    My Mom has filed for my younger brother and also 1 bro and 1 sis over 21. My younger brother case is approved and we already paid AOS fee.

    My brothers and sis lived outside USA, so my question is when my MOM completing AOS part # 5 household size.

    Does she need to mention my overseas brothers and sister in part 5 Household Size???
