  1. So my husband was refused his CR1 visa 12/15/09. 

    -----The applicant has been found eligible under section 221g on the immigrant and national act. This section prohibits the issuing of the visa to anyone who’s application does comply with the INA or regulations issued pursuant there to. We will return all case files to the NVC who will than transfer the case to the USCIS......The USCIS will contact you as soon as they receive your petition. Please do not contact the embassy regarding this case. It could take up to six months for the case to be forwarding.---

    I was so upset and mad because it took a year and a half with the NVC and that was with rushing it to be scheduled. They told him our marriage was fake and someone must have paid me to marry him. So I go to the embassy and demand to speak to someone. After about an hour a man came to the window and said he would review my case. He said he was second in charge. He called me in the room behind glass and just grilled me and demanded the marriage was fake. This was my fifth trip to Ghana. Now after the Nigerian boy tried to blow up the plane it will just be harder to get a visa. They will think all Africans are extremists. I must of watched this man deny like 50 visitor visas while I sat there. When I flew and passed back threw Amsterdam the questioned me and asked my husbands name and if he hates America, don't get me wrong all passengers were being asked crazy questions. I am ok with this cause I want to be safe from radicalists. But I am so fed up with the embassy I am ready to give up on my husband. I love him very much but I am so stressed all I do is worry and spend money. Now I only wonder how long an appeal will take! More time. More money.

  2. Please let me know how it went. I just returned from Ghana. My husband was refused 12/15/09. I went there thinking it would change their mind. The man at the embassy advised me our marriage is fake. They told me to go home. While I sat there waiting I must of watched at least fifty visitor visa refusals as well. I have a lawyer now and will be waiting for it to be returned to the USCIS to appeal.

    After almsot a year in a half my husband finally had his CR1 interview in Accra Ghana on December 15 2009. They were just plain mean to him. They told him they knew our marriage was fake. Going on to say that I must have been paid to marry him. And evidently were sending it back to the USCIS for denail. They did not even look at our evidence. He even had a note from my medical doctor about my health. We have used that to get the NVC to rush the interview since Ghana is slow as snails. I am flyng to Ghana tommorrow to go the embassy they can arrest me or whatever but am not leaving until someone talks to me.

    1,where did you meet your fiance?

    3,who does she leave with?

    5,when did you meet -again ?

    7,how did you stared with her ?

    ans-we met online on a social networking website on the 24 of december 2008 last year .

    8,CO-doesnt she have anything to do on christmas eve ?

    ans- i dont know .i smiled and he smiled back .he then went through my phone records

    9,CO-is 305 her area code ?

    ans- no she she has a 386 area code

    CO-well her number doesnt appear on the phone bill

    ans- i always use magic jack to call her so it show the majic jack number which has a 305 area code

    10,CO-do you always communicate through email alone?

    ans-no

    he then glance through my emails

    11,CO-do you always talk about visa ?

    ans-no we talk about others things more than just a visa .

    then typed on the computer ,he always type something each time he asks me a question.

    12,CO-who is mike .......?

    ans-i dont know

    he then said well mikes........name appears on her addresss then he tuned around talk to his co worker and then told me to have a sit and wait.after 10 munits he called out my name and said to me all we need right now is for you to go and find out who is mike..... and let us now the reason why his name appears on her address ?he then gave me a white sleep of paper to return in january and dont forget to bring your passport thats what he said last i then asked him do you need anything more he said no thats all we need,i said thank you and left.

    SO now whats next do you think is a good sign that i will get approve and what will i do now since my fiance used her cousins name to rent the apartment .what document do i need to present ,any advice will be appreciated thanks .

    Good luck to you! They did not approve my husbands in Ghana today. It is a terrible day for me.

  5. the action to take will all depend on exactly what the 221g states. if they were requesting additional information, then you will just have to find a way to provide exactly what they want. failure to do so will result in the case going back to uscis like ours did last year.

    if they are stating that your case will immediately be sent back to the uscis, then you will have to do everything you can to keep the case there, ie contacting your senators/congressmen.

    also, consider getting a well-qualified attorney.

    in the unfortunate event that your case does make it back to uscis, then start collecting evidence to rebutt the consular findings. the reason i say get on that immediately is because uscis only gives you a small window to turn in a rebuttal to any notice of intent to deny or revoke (NOID/NOIR).   7. My husbands CR1 visa was denied this morning in Ghana. They gave him a letter stating it was due to Section 221G. The Ghana embassy told him that I could appeal this in ten weeks. The kept telling him over and over that our marriage must be a fraud even though the lady said we had more than enough evidence. So is this a mean it was denied or administrative review? Am I out of options? I am completely devasted right now! Do I need a lawyer at this point or should I just give up because after almost a year and half of being apart I am just lost. Please advise and thanks. :angry:

My husband was going to highlight all the calls and if the Embassy did in fact call they would hear it is a calling card.

    Any thoughts I would appreciate. Thanks

    My calling card shows the number I dialed and keeps a record for me. I am asssuming yours is doing the same? And OH CONGRATULATIONS!!!

    Ahhh! No darn. Mine does not keep a record log because you can buy them anywhere. Just african cards. I am praying everything goes well for us Tuesday. Thanks. And good luck to you and yours as well.

  10. ok so this may sound dumb but I am moving and my husbands interview is coming in December. Do I change my address with the NVC and USCIS. The only problem is USCIS website and phone reps do not even show they approved the case and sent it to the NVC. I just want to make sure he gets everything sent when he arrives.

    Where is your case right now? If interview is in december then i guess it should be with NVC. Call the NVC operator and they might do it on phone itself. I was able to change my spouse address easily on the phone itself at NVC.

    The NVC has sent it the Embassy as my husbands CR1 interview is Dec 15. The case doesn't go back to the NVC does it? Doesn't it go to the USCIS for the card Permanant Resident card? Im so cofused.

  11. Ok I need some more of everyones advice and guidance. My husbands CR1 interview is in December. Once he gets here do they mail him his green card and social securtiy card? If so how long does that take? If not please point me in the right direction.

    Also what is the next step when the cr1 expires in two years what do we do?

    I am also planning on moving but I do not even know who to change the address with beacuse isn't the NVC done with everything? I am sure in two years we file again for something else. Can someone please help me here. I would apprecaite it !! Thanks

So I just emailed my Senator who s helping and copied the consulte in ghana asking for the date so I can fly back over there. How do they typically give you the expetite dates. email phone ect??

    Also I am wondering my husband just got a great job there. What if I wanted to more to Ghana with the CR1 approved would they just revoke it if he did not come here and instead I lived there in Ghana for a while. Two good things happened in one day we are wieghing the options.

    Could the CR! still be valid for when we want to come back to MD?

    Any advice I would love from you experts!!! Thank you!!

    where u send the letter for expedited the papers?

    It means we need a Congressman and senator to help for expedited?

    The reason for my expedite is that since ths process has began i am always stressed wth hypertenson and i am bipolar and with my weaking heart. My doctor fears if this goes on any longer I am at a high risk to die of a heart attach, etc etc etc. Took a month and the NVC finally just said it is approved to be expedted. My doctor provided the proof as well. I wrote my Senator many months ago she has been working with me to get this done. Ben Cardins office n Bmore.

    Yes I just did mine, and you do not have to use his income you file your Federal manually send them in to TX with the W7 form to request an ITEN with the proper documents to verify his idenity. I used my husbands copy of his passport notorized by a foriegn notary of his country. They will process it and send them back with the ITEN and then you write it on your state taxes where the SS # would go and file state last.

    I refused to file single because I owed. I got money back married so it made sense. The ITEN is a hassle tho and your husband has to sign that and your tax returns.

  15. IMO, the Consulate needs to see the approved expedite request prior to the interview. Also, IMO, the Consulate would make the scheduling - they have to see their own calendar, yes? IE - 'where can we squeeze you in'..

    But - if there's no 'decision' on the expedite, perhaps it was just forwarded to 'be in the casefile', or the Consulate will now contact the beneficiary, and set up a phone call??

    I'd call back, ask if the expedite was approved, or not approved. NVC phone ppl are NOT the casefile handlers - feel free to ask for a supervisor to review the casefile.
