    The reason you were denied.....because you did not send them evidence???? you said.......that only the forms were sent?

    That's right, Thom thought the forms were all what he had to send, w never check about the letter, the evidence, etc...

    I'm sharing this to no one else make the same mistake like us... It sucks to be waiting a lot of time and then just get a denial because that means more time, more money, more frustration...is just horrible!

    I'm so tired and sad...

    They didn't send evidence of having met in person during the past two years. Then, they didn't respond in time to the request for the missing evidence. The combination results in a denial. It's more efficient to simply refile with the necessary evidence.

    It's not clear to me whether the lack of evidence was an oversight or that they actually had not been together in person within the two years prior to filing the petition, but the result is the same either way.

    Well about we didn't respond in time to the RFE is because we never got any request, just the email about the NO1, the 3 touches before the denial and the denial email... that's all we got...

    Thom and I we have been together since September 7th 2007 till now, last time we were together was this last August 19th-23th, we have a lot of evidence, we made a big mistake because we didn't investigate before sent the papers what we needed... Thom just sent the forms... yea big mistake!!! and trust me I'm paying for that...

    What did you guys decide to do? Are you filing the appeal/motion to reopen, or just going ahead with a new I-129F?

    Thomas says we going to make the motion and then wait to see what the Uscis decide, if they say we still have to appeal, then we going to refile... We have been thinking seriously about cross the border but I'm afraid...

    I'm tired to be checking, investigating... I can't do nothing...He's the only one who can make all this...

    Thanks Stephen!, your girl must to be so happy to see how much you care about this, for all the things you are doing to be with her... That's so amazing... Everytime I check your comments, Dgard or Richard and I see how much you are involved on this to get your women by your sides is so touching and makes me cry, because you let the world know they are the most important persons in your life and that's what almost all the women wants..

    I just registered here and are trying to find helpfull information for my case.

    I found my soulmate through eharmony dating.

    the problem is that i am in the UK and she is in the states.

    I will see her in September for the first time but we both feel that we are meant together.

    i was born in Germany then moved to the UK in 1974 and been there since.

    My love wants me to stay forever, but i only go over with a visa waiver program.

    What should we do next.

    Should we get married quickly to help with the processes or would that be a bad thing to do

    has anyone got advice for us.

    Yeah, what Richard said!! I do believe in soul mates, all of the things that you have described and all of us here are in our long distance relationships and have had limited time together, just because of distance. BUT, I think that almost all of us have managed to spend some time together to see if things work. Think of it as a test drive, or a "taste drive" if you will. I had many, many bad dates before I found Lars. Some of them started out as just chatting on the internet about real estate, or other mutual interests but then we we actually met......uh.....NO F'n WAY!!! What I am saying is try it out before you jump in and make that big commitment.

    I'm in it to win it, and I am sure you are too. The difference is I have spent a few years living with my SO so I know that he farts while he sleeps but denies it the next day; I know that he also snores; I know what to feed him at night to cut down on the first problem; I know if I put it in front of him and put a fork and knife in his hands, he will eat it, no questions asked; I know what size his clothes and shoes are; I know his parents names and where they were born, what their dates of birth are.....his sons too.....

    Hey - the rest of you guys, please don't tell Lars that I told you he farts in his sleep. He refuses to believe me and I don't want to embarass him!

    So agreed with you guys!!! :thumbs:

    You never know if he/she is really the one after you spend time together, share things, there's nothing like the feeling that you know exactly what can make him/her smile and what to do if she/he cry or is down.

    P.s. Don't be worried Missy, I won't tell nothing about Lars... ;) I think I do it too, because in my all 5 senses I always run to the bathroom to do it but sleeping I'm not sure...lol

    Well I back from my vacations saturday afternoon with my baby girl and Thom, we spend a great time there, after 5 months with out see him for both of us was really amazing be together again... the worse part is when you realize your love have to back and you will keep in your place with out the presence of the person you love.

    Huatulco is beautiful I really recomended go there guys.

    Yesterday was the last day of Thom here in Mexico and in my home, now I'm wondering how long is gonna take to see each other again... Is amazing can feel his arms hugging me, yesterday when I let him in the Airport and we say good bye I got this horrible feeling of sadness...

    Today is a new day and I back to the reality, life goes on, so I'm starting living my life as the usual...missing him and he is like me...

    After all this drama...lol... I wanted say hi guys and tell you I hope you all get finally your NOA2 (Richard, Degard, Stephen...my beautiful and amazing friends) all you guys of my VJ family, I'll be praying and crossing my fingers to see you happy Brothers and Sisters...

    I'm still on the journey, this week we going to send the papers, this last weekend we got together all our evidence, we going to make the motion and wait for indications of the USCIS... if they still say we have to appeal, if they say our option is appeal then we going to refile... any way...

  9. So you missed the RFE submitting date?

    But - if you refile - yes, you would have to put "yes" since you actually filed the first one (but was denied).

    I would actually appeal the denial (if you have the correct proof that you sent in for the RFE). Also - can you prove you didn't receive the RFE's? (like they sent it to the wrong address or something?)

    We never got any RFE, none email or hard copy, we called a lot of times to Uscis and the only thing they said is that our case was in process that we had to wait... That's it..

    Then we got the 3 touches before the denial... I mean one July 31th, August 1st, August 2nd and then in August 4th the denial...

    A friend got a denial too and his lawyer recomend them about refile because the appeals can take a lot of time to get approved and can be more expensive.

    What to do?

    You must provide primary and secondary evidence that you have met in person in the two years prior to filing the petition. Not sure why they chose to deny rather than send an RFE, maybe because there was nothing at all. DID you meet in person in the two years before filing the petition? If yes, and you have proof, then an appeal could be of some good. If you did not, an appeal will be a waste of time and money...you do not qualify. Your only option woul dbe to get together in person, document it well and re-file. You would answer "YES" you have previously filed a petition. You would not need a waiver as you do not have an approved petition within the last two years, but I would include a cover letter explanation when you re-file.

    Well before file we hadn't 2 years we had just 1 year and 6 months, now we have 2 years, so after all the comments and search I think refile is the best option...

  10. Linda, did you and Thom see each other in person between March X, 2007 and March X, 2009 ("X" representing the exact day in March 2009 when you filed your I-129F)?

    If you did NOT see each other in person during that 2- year period—or do not have primary evidence to prove it (see the VisaJourney K-1 guide)—an appeal is not an option. You must refile. Answer "yes" on #11 on your new petition, and attach a supplemental sheet with the pertinent dates and reason for denial. A previous denial for lack of evidence should not prejudice a new filing in any way, as long as you provide plenty of evidence in your new petition.

    If you DID see each other during the aforementioned 2-year period AND have evidence to prove it, you can appeal or refile. The appeal will be more expensive, but MAY (or may not!) be faster. People who've been in the same position can offer far better advice in this regard.

    We start our relationship talking by messenger August 14th and we met in person in September 7th, since that day Thom start visiting me, we talk almost all days by phone, skype or messenger till today.. we have a lot of pictures together, with my babgygirl, with my family, I even talk with his mom by phone, we have videos about he have been here in my home and some other places we had visiting, a few museums tickets and air plane records, bank account records about the pay in some hotels we stayed, restaurants, his time stamps in his passport... I don't know what else I need....

    This friend told me this about the motion:

    What you may not know & they dont tell you is you can file a " motion to reconsider". The fee for this is zero.

    A motion is simply a letter explaining you are asking them to look at the case again because you left out some important evidence that would effect the decision they made in the case. Attach to the letter a copy of the denial. Send copies of all evidence you should have, would have sent before. Make sure that info has your case number & his SS number on it.

  13. i would go with the appeal for now, i think it might be quiker that re filing..even though they charge you over 500 bucks.......damnnn, just dl the form they want you to download at get the evidence that they need....good luck

    You must answer yes to this question. If memory serves me correctly theres also a question regarding having been denied, you must answer yes to that as well, it wouldn't hurt to also include your denial letter as a seperate sheet as supporting evidence for question 11.

    I'm afraid that if we say yes they denie me the visa again...I don't know what to do :unsure:

    If I were you, I'd PM one of the more knowledgable members.....Pshbrk, GaryandAllah....BobbyUmit or RebeccaJo. To me, they seem to know the most and are always happy to help. I would NOT post just a general question out there in K1 land.....I did that once or twice and the advice was confusing and ultimately, wrong. Just send one of them a Private Message and I am sure they will answer the best that they can.

    Just going on the face of your question, I would say that the answer is yes and then you can attach a piece of paper explaining what happened. You shouldn't be penalized.

    I already sent a message to Mr. Pshbrk but he told me I have to post this to get help from the people who works here or know more about it and because if I sent this as a message I'm like hiding important information that a bunch of people would like to know.

    I'm afraid that if we say yes they denie me the visa again...I don't know what to do :unsure:
