finally got oath letter for June 6

if it helps I also interviewed in Dallas on March 4th and got the exact same answer. When I asked why the cldnt make a decision they said that my file had been lost. I believed that until I came here and found many people who had been told the same thing. When I last went to an info pass appt they told me to wait 120 days.

dont listen tp that lost your file pack of lies. I fell for it until I came here and found every n400 intervieweee who got a decision cannot be made was told about their lost file!!!!!!!!

Needless to say just thinking about it is depressing.

I have never even had a traffic ticket.

Since I arrived in the USA 10 years ago I have only received a parking citation when I had gone to a college to see an advisor and didnt realize visitors needed a sticker. paid my $20 and that was it.

Well your file needs to be reviewed by a supervisor. This is often caused by a troubled past/history of the applicant.

Just had my interview passed the civics test & was handed a paper that saaid decison cannot be made. When I asked my IO he told me a story about how my file was lost. I actually believed it until I logged into VJ and saw 2 people with the exact same story including the lost doc part.

Is this a a new thing that they just started. Are the really losing documents

Is there anyone this ever happened to who can tell me whats going on please.

Update: My wife passed her interview today -- sort of. She passed the civics test and everything else, but she received a "decision cannot be made" verdict because there are some documents missing from her file. They need to be retrieved from some government storage facility and then she will be sent a letter for the oath ceremony. This will take another four to six weeks. This is a bit annoying, mostly because we had expected everything to be over today because Fairfax does same-day oaths.

I had an interview of friday and they told me the exact same thing they told your wife. Gave me a form on top it says passed test at the botttom says decision cannot be made\. I asked IO if you lost documentation why not put approval pending bla bla which was an option on the form. He replied with the lost document story and said because of that only a supervisor could approve so he would need to review my temporary file since the original had been lost. I DONT BELIEVE THAT STORY. but what can you do. I guess just watch the mail.

I had to go through that And I remember wondering why me? I had seen other people write," I only sent a picture of us and a xmas card and thye had approvals".

Most pple say you have nothing to worry about if your marriage is bonafide but truth is you never get used to having immigration in your life. More so after 3 years of marrige you have more detail to try to remember and you dont know if you will get the one psycho IO who will ask you "what did you have for dessert on labour day in 2008?"

Advice is prepeare for the worst and hope for the best. I prepared exactly like I did for my first interview. go to www.***removed*** they have some question there you can use to jog your memory.

I prepared like crazy and the interview was a breeze, but then again I was 7 mos pregnant and looking it maybe she felt sorry for us..

The letter clearly states that you can file a waiver because it was dismissed without prejudice.

Just get your act together and file a new i751 as divorced but with a bona fide marriage in the beginning. Hurry & do it before September 10th.

When you filed did you get a NOa?

Do you have a case number?

YOur first step before even a lawyer should be to find out your immigration status....If you have a case number the do it online if not set up an info pass appointment....

I think your husband is very aware of your fear of USCIS and is throwing that in your face to hurt you but until you understand whats happening with immigration then you will go around in circles...

Since you filed your i751..... if you dont have a case nummber call USCIS 1-800-375-5283 and tell them every story until you speak with an immigration officer..... It is very frustrating.....theose guys are trained to get you off the 4n asap & they will tell you give us your details & we will do a service request....Hang up & call until someone transfers you to an IO because in your situation you may be too scared to go into the office for an appointment ( even though I dont htink the would arrest you or deport you) but I know I`d be scared to go into the building.

Hang in there all those whose wait has been too long

Your divorce from your husband is not really a big problem. Divorces happen everyday and even IOs know they can be spitefull hance the creeation of a whole industry calles Family law with courts and stuff because people esp former lovers can end up worst enemies.

your biggest problem is the 9 month gap in the expiration of your GC. Bcoz removal is filed 90 before you actually had 12 months to do it and can you explain why you failed to file ypur i751 in that time because a)... your relationshio was still ok & you wld have filed it joint or b).... you were in trouble & would have looked into a waiver filing.....

While you were genuinely married I am sure you had some paper trail & friends that knew you..get that together and ask for affidavits from any mutual friend or relatives that can vouch for you that will take care of the husbands vendetta... BUT not the 12 month gap .....Not to pry in your biznes but what was the reason you didnnt file an i751......

Maybe someone misunderstood I didnt mean to impose my feelings on her or sway her one way or the other.

I made it clear that I didnt agree but if she was in my state I was going to give her some names of lawyers that I heard heard about!!!

The ultimate choice is hers!!!

Most lawyers will never tell you when your case has no little hope for success. They simply take your money then when you get a denial they tell you there wasnt much to go by anyway. I have been to info pass appointments that were more informative that $150 consultations with lawyers.

A lot of the waiver filers here can give her advice about nasty and spiteful divorces and what to do to guard against the reparcations they have on immi status....

I am anti immigration lawyers!!! I PERSONALLY dont think they do for you anything that you cant do for yourself esp with the suppport of VJers..& I have heard too many horror stories

However I if you do fell a need for them you have to inform us of your state and city

Sorry to hear about your ordeal my friend I know how frustrating it is to get here day after day & hear about approvals & question wwhy they havent touched your paperwork.

To help you we may have to ask a few details ,,, not prying into your affairs but thats how you get advice on VJ

1. You mentioned second interview.....Does this mean in connection with your i751 you had 2 interviews or your AOS was interview #1 and i751 interview #2?

2. How did the interview go?

3. Have you heard from them since? if not how long has it been?

4. What kind of evidence did you have......from waiting a year I have learnt about sooo many other evidences outside the usual that you can take... the bigger the file the less the stress.....

I survived my wait becoz of some pple here who just cared for a stranger they will probably never meet..... We will help you work it out.......
