Hi all:

My wife is interested in bringing her parents to the US, now that she's a citizen. We have one issue, though: her legal name in the US has always been with my last name--her greencard was issued with my last name, and she's never used her maiden name in the states.

What sort of proof can we provide of her name change, given that USCIS is the only entity that ever knew her as her maiden name? Do we request some sort of proof from USCIS?

Your BF is right, it is a waste of money, but not for the reason he thinks. If you're going to get married, get married, and apply for the CR-1 and use the visa waiver to visit each other easily. The K-1 simply adds money for a luxury you already have: being able to visit each other easily. No matter what you do, the CR-1 fees are fees you will HAVE to pay in order to get your greencard, so inserting the K-1 into the mix is a waste of your time. Get married, apply for CR-1 the legal way. If your boyfriend is in the military he'll have a much easier time getting you over here; the system is designed to favor people in his situation.

The embassy will extend the validity automatically while in AP.

The petitioner can email every few months to inquire of the status.

She can call DOS more often for status inquiry.

The senator can do nothing about it.

It will only expire if it gets returned to USCIS, CSC does not reaffirm returned K1 's, VSC sometimes does.

It is not really that unusual to be in longer AP given the country.

Thank you for this. I will be sure to tell his fiancee to e-mail the embassy again to inquire about the status of the application. I was surprised at the length because my wife (his sister) only took 1 month for AP, but we were married and she is a woman, so perhaps that explains the difference in AP times.

Hello all:

My brother-in-law has been in administrative processing for a K-1 petition for nearly seven months now. I understand that this is highly unusual, given that most AP is between 2 weeks to 2 months. I'm a little concerned that his petition has expired because the AP has taken so long.

Is this a possibility? His fiancee e-mailed the embassy three months after his interview and they said that the visa was still under administrative review, without any mention of potential petition expiry. Does anyone have any advice/guidance on what to do in order to move this process along?

Hey all, my wife's case status just updated to show that as of March 18th she's been scheduled for her oath ceremony. My guess is that it will take place on April 17th, because that's when the courthouse said that the next oath ceremony in our city was scheduled. I'll confirm when we receive the letter.

I actually completely agree, with caveats.

I think a large portion of the problem with USCIS is a lack of accountability for funding. Anything that made USCIS more consumer-oriented (tying their funding to the level of service they provided) would absolutely increase responsiveness, processing times, and quality of service. That's how economics work: if they have financial incentive to provide better service, they will.

The issue here is that they have a monopoly, so it could be the case that service as a whole does not improve because there is no incentive for them to improve service on all levels. The solution to that would be to privatize immigration, which would be a nightmare. But if the government held USCIS to base-service standards while the consumer was the arbiter of premium service, I believe USCIS would have the right incentives to improve their operations.

I don't think fairness has much to do with this, as long as everyone was guaranteed a minimum level of service. Paying to GET the visa would be corrupt; paying for expedited processing is a commonly accepted transaction. Assuming we could avoid corruption (and being that other govt. services do have expedited processing without excessive corruption) I think it would be a great way to kick USCIS more money and ideally improve processing times for everyone involved.

My wife aced the interview in Norfolk. We were told to expect an oath ceremony letter in the mail, so that's my only update for now. We need to wait a little bit longer, which kinda sucks, but from here on out it's just formalities.

Just checked my status online and my wife was scheduled for an interview yesterday! We should be receiving the letter soon, and hopefully the interview is in the next month or two. I've read that they can have the oath ceremony on the same day as the interview in some cases; how awesome would that be?!

Has your online status changed?

Unfortunately not. They mailed her the Biometrics letter on the fifth, and we went in on the 20th. The site still says "We mailed you an appointment for Biometrics on December 5th..."

I'm so tired of waiting! I just want her to take the test, get the citizenship, and be done with this. USCIS has been a part of my marriage for too long!

How does EB work? You just show up with your letter and ask to complete it early?

Last time we went for Bio it was a <20 min process; the office was very empty. I wonder if that means we'll be able to do it; it would be nice to get it out of the way. (Her case status updated yesterday to show they'd mailed the Bio letter.)

Thanks everyone for your responses--I'm glad that I'm not the only one who's had to deal with USPS insanity!

After opening the investigation, I called back and they said they'd found the package and it was going to be delivered. I just got electronic notification from USCIS confirming receipt of the naturalization packet. Thank God; the end is in sight!

Did you include form G-1145 E-Notification of Application/Petition Acceptance in your package? If yes, you will get an Email or text as soon as USCIS accepts the package.

I did. The problem is, the package clearly hasn't been delivered yet (I sent it via Certified Mail so I can see its tracking status). It should have been delivered 3 days ago (on Monday). I don't want to wait a month for USPS to figure itself out (particularly during the busiest mailing season of the year) if I can just submit another package and not let USPS's idiocy hold up the process.

What I don't want to do is send the next package, have it accepted within 3 days (what should have happened with this package), and then a month down the line USPS finally delivers the original package, and USCIS freaks out because they now have two identical applications and decide this means they need to cancel both and somehow deport my wife. (Yes, I am being hyperbolic, but let's be fair: USCIS does some crazy things.)

USPS doesn't really lose mail that often. I bet the package is misplaced, sitting in a box somewhere, and it will turn up shortly. It's not like it's in the trash or at the bottom of someone's pool. I would be as patient as you can be (your package will be found). Nov 21 was just a week ago.

I have very little faith in the postal service right now. It may be unwarranted but I'm extremely frustrated, considering how close I am to being finished with this.

In any case, I wasn't planning on sending the new packet today or anything. I'm just wondering how long I should wait, and if (should USPS find the package eventually and deliver it) USCIS will flip out upon receiving two packages. I may give USCIS a call about this, but wanted to see if anyone here had been through something similar / had any advice to give.

So I assembled my wife's packet last month, made three copies, got everything ready, and waited until November 21st to send it off.

I sent it on Nov. 21st via Certified First Class Mail. And USPS promptly lost my package. I have opened an investigation but as of now their tracking information hasn't updated since the day I sent it, and they cannot locate the package. Which is awesome. I'm just freaking thrilled.

So here's my question: when can I send another copy? Can I do so at all, or do I need to wait for USPS to locate the package? I don't want to mess up anything with USCIS, but I want to get this naturalization process started ASAP so I can be done with immigration *forever.*

I guess we have no other recourse. Could you tell me how long did it take for your NOA2 to arrive?

I was lucky, and received mine in ~70 days. A bunch of us who filed in June 2009 all got approved at once at the end of August/beginning of September. I contacted my Congressperson because I submitted the I-130 days after Ahmadinejad's re-election, and my wife lived in areas where there was significant unrest. To be clear, that made no difference to anyone with whom I spoke: despite tons of media coverage and several killings, USCIS did not care in the slightest. I don't even know why they have an expedition process.

thanks Guys! It's reassuring! That's why I think some lawyers are useless! The provide inaccurate information!

It's my impression that contacting them makes no difference at all. I wrote letters, contacted my Congressman, and none of it made any difference. I was told my wife's case couldn't be expedited / was in normal processing times literally days before she was approved.

I'm sure at some point it makes a difference, but for me it never seemed to have any effect.

No, he cannot, as roughly a dozen people have stated. The AOS is a binding contract; the only way it can ever be cancelled is if the green card holder loses their greencard or becomes a US citizen.

That being said, Volkan, your father-in-law needs to understand that this form obligates him in exactly the same way that Form I-864 does. He is signing a legally binding contract saying that for as long as you are an LPR, he will financially support you. There is no material difference between a co-sponsor and a joint sponsor when it comes to legal liability; the I-864A is just a simpler form to fill out. If he believes that the I-864A somehow exonerates him from this responsibility he is mistaken and should have this perception corrected immediately.

When I filed for my wife, I was a student, and as a result I did not meet the income requirement. However, I lived with my parents at the time, and so my father filed an I-864A as a household member who was related to me--and in fact I had to provide proof of this relationship via my birth certificate. I was *not* a dependent on my father's income tax return, and that had no bearing on my application. We were approved without any issues.

If you look here at the form I-864A's instructions, it says very clearly:

For purposes of this form, a "household member" is:
A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;

The intending immigrant, in certain circumstances. (See "How Can the Intending Immigrant Be Considered a Household Member"?)

From my personal experience and my understanding of the form's instructions, as long as the co-sponsor lives with the sponsor (your wife) and is a blood relative, you will have no problem using form I-864A. If I am mistaken I would greatly appreciate someone's explanation of why, because this is exactly what I did to bring my wife over.

It is benign in the sense that the name is going to be recognizable, probably with only one additional initial (Jane Maidenname Doe = Jane M. Doe), but she will have to contact the SSA and notify them about the name change eventually. As far as I know, SSN always remains the same.

Yeah, I'll just handle it all in one fell swoop--citizenship prompts the same notification requirement, so it'll be a good chance to get everything properly set up.

I cannot wait for this to all be over; it's going to be legen--wait for it--no more immigration ever-dary.
