  1. Guys,

    I have airline tickets purchased to travel to Canada for the X-mas holidays with my wife and brand new baby girl (She's due in two weeks!).

    I just received an extension of my TN visa (company filed I-129 via mail) last week and I was wondering if I submit my I-130, & I-485 with the I-131 AP docs on 9/24 am I cutting it too close? I plan to travel on travelling on 12/22 and returning in early January.

    I don't know how to check the processing times at my local office but I live in San Diego so the closest will be Chula Vista, I guess. Does anyone know how I can check to see how long it will take to at least get my AP document approved?

    As well, I have been married since last November and I am on a fresh TN that will enable me to stay until July of next year. Is there any danger of the agent seeing me with my family when I return to the US and not allowing me to enter on my current TN?

  2. Guys & gals,

    Tomorrow I plan to submit the I-130 & I-485 packages. The fees schedule that I have found is as follows:

    I-130 = $355

    G325A = $0

    I-485 = $930 + $80 (Biometrics)

    I-693 = $0

    I-864 = $70 to Dept Of State

    I-765 = $340

    I-131 = $305

    In my I-130 package I assume that I will make a money order payable to USCIS.

    In the I-485 package, do I make a money order payable to the Department Of State for $70 (Is this even necessary?) and then to the USCIS for $1,655 (Total of all other fees) or do I have to make a separate money order payable to USCIS for each form that requires payment?

  3. File I-130 and I-485, then you will maintain your status.

    My understanding is that if I file the I-130 & AOS, once my TN visa expires I am ineligible for work in the US until I receive employment authorization documents which could take as little as 30 days or as long as 90 days.

    Can someone please verify that this is the case? I'm getting nervous here that I may have to quit my job of 10 years as they cannot have no one employed in my position for an extended period of time.

    A lawyer has recommended that my company file an I-129 for extension of stay. Is there any chance that USCIS will know that I am married and deny the I-129 filing?
