  1. I apologize in advance. I am sure this has already been covered but I did do a search and also read the FAQ but I am still confused.

    My wife's CR-1 was approved and she entered US on 9/25/2009. Her conditional-removal application was approved on 3/22/12 (4 days ago).

    Per the citizenship requirement, she will have to be a Permanent Resident for a minimum of three years before applying. Now, does this "three-year" count since her entry to the US or since her conditional removal?

  2. My wife's CR-1 expires on September 25th, 2011. We qualify to apply for removal of condition on June 25th, 2011. Will we be ok to travel out of the country during the last week of June and 1st week of July? We will apply for removal as soon as we return back. Please let me know if you see any problem with us traveling.

  3. I have read the documents/threads and just want to confirm that I am right.

    My wife entered US on 09/25/2009 and received her GC about 10 days later. We applied for her SSN and should be here in the next 3-4 days. As far as I know, we are done for now until 90 days before her CR-1 GC expires, right? We won't have to do anything until then. Then, within 90 days of her CR-1 expiration, we apply to remove her conditions. Please let me know if I have this correct. Thank you in advance.

    I am sorry if this has been posted before. I searched but couldn't find anything. My wife's board exams are over and she's finally coming here to be with me. :)

    Once she arrives, we will be moving to a bigger apartment within the next month. We are going to use my parents' address for her greencard and ssn. Will she have to fill out any form at the POE or what is the process?

  5. i am filling I 864 only for my spouse i am USC and applay for IR1-CR1 visa , i do not anderstend part 2 - who is principal immigrantis that my spouse , and part 3 8. do i check yes or no and part 9.

    Your spouse is the principal immigrant, so, yes, his/her information would go in Part 2. You also check Yes and I am sponsoring the principal immigrant named in Part 2 above in Question 8.

    Question #9 would be checked if you are sponsoring more people besides your spouse. It will not be checked if you are only sponsoring your spouse.

  6. My wife does not have a a hospital issued birth certificate.

    How have people gotten around this situation? Can anyone share an example of birth certificate that has worked with NVC? It will be specially helpful if it's a Nepalese birth certificate.

    Per NVC's website:

    Birth Certificates

    Each applicant will need to obtain an original birth certificate issued by the official custodian of birth records in the country of birth, showing the date and place of birth and the parentage of the alien, based upon the original registration of birth.

    The certificate must contain the:

    Person's date of birth

    Person's place of birth

    Names of both parents, and

    Annotation by the appropriate authority indicating that it is an extract from the official records

    Unobtainable birth certificates

    The applicant's birth record may not be obtainable. Some reasons are listed below:

    The applicant's birth was never officially recorded.

    The applicant's birth records have been destroyed.

    The appropriate government authority will not issue one.

    Please obtain a certified statement from the appropriate government authority stating the reason the applicant's birth record is not available. With the certified statement the applicant must submit secondary evidence. For example:

    A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)

    An adoption decree for an adopted child

    An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parents names, and the mother’s maiden name.

    Note: An affidavit must be executed before an official authorized to take oaths or affirmations. More specific information is available from the NVC.

  7. How long usually does it take for NVC to complete the case once they receive DS-230 package? They already reviewed my AOS package.

    I'd say about a month or less if there is no RFE. In my case, it took about 38 days but that's because I had an RFE.

    Wow your NVC process is taking a long time. Did you get AP? I took me 2 weeks from receiving my packages to case closed and that was with an RFE. So it could be faster if you don't have any mistakes and have everything together.

    Well, my NVC process is already complete (see my timeline)! ;)

  8. Thank you guys! I just reviewed her itinerary again and it is actually three hours which should be enough (hopefully). :)

    Due to my profession I fly on a regular basis so I have seen it all. All you can do is go with what you have scheduled. What occurs on the day of your flight can never be planned for. Bad weather, delayed flights, aircraft repairs, world events...........you name it and it can happen. If a delay occurs you just have to roll with the punches, hope for the best and expect the worst.
