    Thanks for your input. Can i submit affidavit of support on her behalf during her interview?  She lacks evidence of employment and/or the family ties may not be sufficient to show the purpose of her trip. In other words, she is in late 55+ and only teaches elementary school and her hubby doesn't work. I intend to include an affidavit from me and wife to show that we can take care of her when she comes. Do you think this is necessary or how would I do this part?

    It has been a while i visited, and this place/site has helped me tremendously. Thank you ALL that reply to my questions,

     

    I have a question about filing for my step mom. I want to file for my step mom who was later married to another man when my dad she was married to passed away. She later married another man and they had kids together (5). Now, my own mom is not around anymore too, I want to file for her to come and see my kids and probably stay for a while with us in USA. Since I got married to a U.S citizen and I am now a citizen too, none of my family members have visited me and my kids are too little to travel to Africa. I know she got RE-MARRIED when i was not up to years and that is one of the requirements needed for the filing. Any direction or help anyone can render to me would be appreciated - directions, forms/papers I need to submit, Affidavit of support?, how much is the cost etc.

  3. There is no appeal in DV cases.

    This story of the interview sounds odd to me. I'm sure there is more to the story than you have been told...the CO clearly suspects attempted visa fraud of some sort.

    Well, i don't really know the full story but i was there in their marriage. There is no fraud in the marriage.

    I just got a call from home that a friend of mine has been denied visa from wining a DV lottery. Here is the story,him and his wife applied for the DV lottery and won the lottery and on the process had a kid which they added later (no problem). During the interview, questions were asked to the wife, husband and their response in one question was different - that is when did your wife go into labor for the baby to be born. The man gave a different time and the wife gave a different answer - This is where the interviewer stated that they could not determine their relationship and for that denied them visa. These couples are happily married and with one kid. There is no false alarm in the marriage. Just that the dude response on the question asked was different. Can they appeal for this case to be re-opened or use a lawyer - Please what can be done to have this case re-opened. The visa fees have been collected and they don't mind paying again

    Any advise will be appreciated

    Please i would need an advice for the issue a friend have now. A friend of mine filed for K-1 visa for her fiancee to come here, but his evidence that they met within two years prior to filing for her is more than two years old. He traveled to see her in 2009 and filed for the petition in March 26, 2012 and he received RFT requesting that he provide a traveling document that shows he met her from March 26, 2010 - March, 26, 2012 ( which is exactly two years). USCIS also suggested a written Affidavit for him to provide which is very difficult to obtain. Although, the guy just traveled to see her in September, 2012( still there now) and this is also more than two years required?. Do you think, he can provide the document he used to travel in september 2012 as evidence that he met her within two yrs of filing. I am assuming this will not work because of the dates given to provide proof. Please can anyone advice on what to do on this situation? Do you think withdrawing might be the best option or postpone the filing? Any advice will be accepted and thanks for reading.

    There aren't any shortcuts. The former permanent resident, now US citizen, has the advantage and priviledge of petitioning his wife though.

    She can still visit on a tourist visa. A tourist visa is meant for visiting, not staycations/immigrating and since the question has already been asked and the idea has been there, it's considered entering on a tourist visa with the intent to immigrate. Which is a no-go. As I mentioned, the foreign wife may visit however having a US citizen as a spouse sometimes makes it harder to prove less ties to US rather than home country.

    Thank you. I will let them know. Do you know how long it takes since her name was already included during the husband's citizenship time? I was hoping she can come and change status here?

  7. She or the kids should not apply citizenship yet as they are not even resident. You cannot come on a visitor vist with intent to immigrate, especially stranding the kids in the meantime. They should file CR-1 and include the kids. Once approved, the kids have up to 1 year to follow if they are under 21 years old. They will enter as full residents and can then work toward citizenship. In the meantime, while waiting paperwork, they could visit if there is already visa for this... but is best to return and do interview in home country and enter on the CR-1 visa.

    Please i would need an advice on this issue. A friend of mine recently got naturalized and became a US citizen, the wife is in overseas with a valid U.S Visa to visit America again and her name was included on the papers used by him to file for citizenship(Yes, they are married). He just got his certificate today and wondering the best way to bring her wife and the kids involved to America.

    1. Can the wife come back/visit America again since she has valid visa and he will change her status for her as married? or does he has to file for her while she is at her country and wait for her to be approved before coming to USA. Here, her visa might expire and she has to wait until her case is approved.

    2. The two kids are also included on the Citizenship - Can the wife come here first and later they can file for the kids ?

    I have advised him to ask the wife to come back to America while they stay here to finish other processes and file for the kids later? I needed to confirm this and this is why i am writing.

    Any help/answer will be appreciated.

  9. Rumor has it that Abuja is easier. It is pretty hard to get a visa so it is not a suprise. You don't use an 130 or a affidavit of support for a visitor visa. Does she have obligations at home of any sort ?

    Man..the rumor was fault. I used affidavit of support because i was trying to show that i can take care of her when comes here. She is 73yrs and aged and do not have any obligations at home? what do you mean by Obligations???? do you mean anything doing or have that will make her come back?

    My mother-in-law is not coming here to stay and i wonder how they think that old lady will stay here? What're they thinking?

    I must tell you i don't know what to do now because all my hope was that she will be given a visa considering her age, you know?

    I guess i was wrong in my thinking. God help me because i really want her to visit me b/4 she is no more.

    Hello guys,

    Bad news today as early as 4.50am of US time. My mother-in-law was denied visa to visit her grand daughter in U.S.A under the section 214(b. I am asking how she obtain this strong ties when she is a widow, never worked (except farming) and have no bank statement except the ones the sons give to her. I intend to apply next month choosing another location and i don't know why they should have denied her visa. She is aged and 73yrs of age. Please guys advise because i don't really know what to do next. I applied at Abuja Nigeria and i want to try Lagos Nigeria now.

    Any advice or help will be appreciated.

  11. Form I-130 is for an immigration visa. In addition, a person cannot file an I-130 for an in-law.

    Your MIL will have to file for a visitor visa on her own. You can send her an invitation letter and provide financial support for her. Whether she can get a visitor visa will depends on her strong ties to her home country to overcome the presumption that all foreign nationals entering the US have the intent to immigrate. She has to qualify for the visitor visa on her own.

    It has been a while i came here. First, I would like to ask everyone how is it going? Hope everything is going on well?. Good news, after marriage/wedding in 2009 Decemeber, my wife migrated to U.S.A immediately with me. We had our daughter December, 03, 2011. Now it is time to invite her mother-in-law. My question is this.

    My wife does not work and i, the husband is about to file 1-130 to bring her mother to visit(not green card, just visiting). I don't know if i'm doing the right thing or not or whether if i can invite her mother? even though she is not my mother, but in-law. I'm a U.S citizen and my wife is a green card holder. I have filled out the form and provided an affidavit of support for her coming. Since my wife's mother is not my mother, can the husband invite her? Please i would need an urgent reply for this and this will be appreciated. Her interview day is next month.

    Longest time...sorry guys i have been running around for the wedding preparations. The good news is that we're all set and the Lord is great always. My fiancee Visa was successfully picked up on NOV. 27th without stress after passing the interview on November 20th.

    I,m so great for everyone that contributed to my questions here and i will remain here to complete my Journey once she comes.

    does anyone knows if the banks statement needs to be writen in a letter format or just as a regular bank statement with the date of openning in it?

    also, does the co sponsor has to notarize the I-134 or just sign?

    Visit the Bank to get the statement and for the 1-134 it needs to be notarized. You can do that in any of the DHL office/Center. Hope these help

  19. Got an interview date o, Praise the Lord, Nov. 19..... I actually got frustrated this morning and I called Eleke at 7am my time and the guy said he cannot provide me his name but to give him our case# and he promise to email me, so I checked my email and there it is. Praise the Lord

    If you have been waiting for at least 2 weeks, I think you can actually call Lagos directly. All the best

    @ JOLEX who gave you that info that you need to wait for the interview date before medicals? .....i don;t really know the procedures and that is why i,m asking those that have been there......let me know please because i don;t want to send my fiancee all the way from East to Lagos and she get there, no medicals is done .

    Does the Lagos Embassy ever reply to emails?....or just waste of time.

    I have called DOS and i was told no interview date yet...though the file is in the system.

  21. Hey Guys... I hope everyone is doing alright with their respective stage....

    for the ones waiting for NOA2s have you called to place a service request???

    for the ones on AP... I hope it goes fast... really fast... to your respective embassies!!

    for the ones who are waiting on the packages to arrive the embassy... use the DHL tool it works like a charm!!

    for the ones in Packets 3, etc.. make sure you have the paperwork ready... and try to get as much as possible done before you get the request to send them...

    On a personal note, I suggest to all of the people who are planning to work/study here in the US when you move... try to get all your school, work, etc paperwork taken care of... before moving here... because later is more work to do... and if you have to translate documents... you can negotiate with the translator of charging you a lower rate per sheet if you give them more stuff to work on...
