  1. Regarding the possible political changes underway, I have been scrambling to file I-130's for three adult siblings. Yes it would under normal circumstances take more than a decade for them to receive a chance of coming to the US, but considering the prospective changes, would it even matter if I did file for them? I am worried that if I even spent $535 X 3, and submitted all the applications via express mail tomorrow, that there may never be visas and green cards that come available for them in the future. Does anyone have thoughts on this and is anyone else facing the same conundrum?

Anyway, there's a new bill about to be introduced to do away with I-130's for adult siblings and parents: My question; if I filed for I-130 for siblings and parents (I'm a citizen), before this law comes into effect... would they be in the clear, or would it nullify their application?

  4. Thank you for the replies. I would honestly like to file and get it done, but I am getting the idea that it might be a long-shot that may just work or may not and my plans could be postponed. So really I am still grappling with this, I have everything ready to go and just want to file, but hey.

    How long can I leave the country on a green card? Isn't it for less than 6months though? Do I have to apply for permission to stay out for more than 6 months to avoid losing my residency. Thanks again.

  5. In a week I will be 90 days within time frame of my 3 year residency date and eligible to file for citizenship. (May 6th is the date). I would like to do it and then get my passport as soon as it is done. My wife, daughter and I will be travelling to South Africa in June/July to visit family there and we want to stay until Christmas, but maybe more than 6 months. So personally it seems like a good idea to file right now and not worry about travelling as a resident. Would you recommend it? Would they be able to have the oath and all those things done in time, or could we have them transfer that to the embassy in South Africa? Also, would they do anything with my paperwork within the 90 days before, like biometrics etc. or approve my case? Or would they only do so after the 90 days? Lastly, I did biometrics in July last year, do I have o do it again? Thank you

  6. Hi, It has been 6.5 months since I filed for my removal of conditions. That is with the CSC who are normally quite fast with these matters. We went to the Info Pass and spoke to an officer who said "Nope, nothing yet. Your package is pobably just waiting there for someone to deal with it, anyway you have your GC extended for 1 year so you just need to wait". We also phoned the customer service number since it is beyond 6months, hoping they could get the Service Center to take notice of our still pending package, they did do a service request, but 2 weeks later and we have still not heard anything from them either.

    So now here is my question, since we have been married for almost 4 years, could I just go ahead and file N400(citizenship)? Would they then just be able to consolidate my I-751 with my new application? Thank you.

  7. Hi there. After almost 9 years I will be seeing my family in South Africa, and I will be accompanied by my lovely wife who is also really excited to meet them and to also see my country of birth and upbringing.

    We will be flying out on the 30th of June and will be back on August the 10th.

    But that said, I have a few questions and I would like you kind people to help answer them for me:

    I was approved for my GC on May6, but due to the card production delays (...of '09) I have not received it and had to travel 300miles last week to get the i-551 stamp in my passport. This morning I did get an email saying that card production was ordered again on June 12th, but we will be leaving our apartment here in Oregon at the end of the week to fly to Missouri to visit her family before leaving from there, and thus our mail will be held at the Post Office until our return.

    -Would there be any problem if my card got mailed out before I left the US and I did not travel with it?

    -Would the I-551 stamp suffice as an acceptable travel stamp, especially for when needing to board a plane back from South Africa?

    -When leaving the US, do I need to have go to a customs or border officer at the airport and get some sort of stamp before I am allowed to leave?

    -And when I return, what procedure do I follow? Will I have to explain to them why I only have my passport with the stamp in it or will it be ok?

    -Should I take all my NOA forms with just incase, marriage certificates etc., Would it be helpful that my wife (US citizen) will be travelling with?

    -In a worst case scenario, if my passport with my stamp got lost or stolen out of the country, what do I do then?

    -Do I have to fill out one of those I-94 cards again when I come back?

    Thanks for hearing me out, I know I asked a lot, I am just nervous, and really don't want to be. I want to enjoy this trip more than any other in my life, and don't want something horrible happening that will have me all worried.

  8. Yes... 300 miles. The Portland center is our closest one.

    In regard to 'ERIC-PRIS' that may indeed be true, but the officer said that not to hold hopes up for anything before September, that that would be a reasonable time for us to wait so well thats all to do I guess.Congrats on your stepdaughter getting hers I wish mine had arrived earlier.

  9. Yesterday I had an infopass appointment to get i-551 stamped since my wife and I will be travelling at the end of this month (JUNE) and the GC has not arrived due to the now famous 'delay'. I asked the USCIS officer what the status was on my cards' production, as in, when should I maybe see it since it was approved and orderded produced on MAY 6th. She said it should arrive around September!!! Wow I am glad I made the infopass appt. to get the stamp, cause I had been waiting and fretting like crazy, wondering why it took so long and since prices for airfare have been going up and up, and so before it got out of control we bought our tickets, but then the GC was not showing up.So even though I drove 300miles to get the i-551 stamp and 5minutes later drive 300miles back home, I am happy to have it done.

    That said I do hope for all our sakes the GC production starts moving forward sooner rather than later.

So my GC was ordered on MAY 6 and today I read they are having delays of up to 8 weeks (I hope that is not on top of the almost 4 weeks that have already passed), But my wife and I are travelling on June 20th, and since I am not sure about the timeline of the GC happening and I never did file for FORM I-131 when I filed I-485/I-130 and am now seriously considering doing so.

    I have read the rules of filing I-131 and am not sure if I still qualify to not have to pay the $385 they require, since I am wanting a RE-ENTRY PERMIT and I am a a conditional permanent resident, and I get the impression that only prior to being one you get to basically send copies of i-797 notices and receipts of paying for I-485 etc. But this seems to only be in the capacity of ADVANCED PAROLE?

    So lastly, if I chose the expedited option, how long would it take?

  12. Hi. I am unsure about a couple of things and would appreciate some guidance.

    1) My wife (US CITIZEN) and I recently had our i-485/i-130 interview, all went well and the officer said from that day I was a conditional resident for 2 years, that my GC should arrive in the mail in 2 weeks. Also that I can use it to reenter back in the US and my passport to travel to my country.

    2) I did NOT apply for form i-131 when we did all the other froms, however there are rules saying that if I wanted to then

    I would not have to pay for the i-131 (since the cost is already included in that whole AOS package and that when I did

    apply, to just make copies of the i-797's that I got , and also the GC, and mail it off.

    3) So, I got the "Welcome to the United States of America" letter yesterday, which was about a week after the interview.

    and I am expecting the GC soon, but, my wife and I want to travel to my country in about 1.5 months to visit for a

    month. I know that I should be fine with just the GC when reentering the US and my wife by my side, but I am just

    want to make extra certain. Also :

    - can I apply for form i-131, for a reentry form before I leave or was that just for Advanced Parole and would I have to pay the $300 something fee?

    -If I can apply do I have to send in photos since they have my picture?

    -How long should it take, I intend sending an expedited envelope, and I have done with all the BIOMETRICS etc.?
