  1. Thanks! I'm definitely filing for CR-1.

    I'm reading up on it a little by little and it seems like they all go to the I-130 form. But once it goes to NVS, it's considered as a CR-1 right? So confusing because K-3 and I-130 itself, as what I have read already, are two different types of paperwork but they are generally the same. Then came the CR-1 which is also almost the same.. Just a small questions that's all..

    I know I asked but I want to be clear on these two..

    1. The only thing I'm worried about right now is my income. Not sure how that works. Do they want to know how much you have in your savings/checking account? or do they just go by deposits and annual income?

    2. The G-325 forms. I understand they will need my wife's medical report since she's is coming to the US. But why would I need to submit mine also? and if I do, I have no records of mine. I guess I should go to the clinic I used to go to when I was little and see if they still have my records available? Let's say, there is no records at all.. I would have to go and get tested for a new record?

    One last thing, my wife has been talking to a agent in Vietnam. He's pretty popular in the area for helping with paperwork over in Vietnam. Which she wants him to help her do her paperwork for a small fee. I don't mind paying for it since it's not much at all. She says he helps out from the day they file the paperwork, till the day she goes to the Interview.. Speaking of interview, I plan to be in Vietnam during the interview.. That should be a plus right??

    She is, and her family is traditional Catholic.. Having a wedding without having it down on paper work? No gonna happen. I want to be 100% married to her. We have already talked about it. It's now just getting to the paperwork part.

    I been reading around and saw lots of I-130 forms done. Even on the time lines. So it looks like the best bet for me is to file the CR-1 forms?

    I have to marry her in VN because she has no family here and it would be better to have the wedding in VN where her whole family lives. So k-1 is out of the question. She is also still finishing up her language schooling so I want her to stay there and finish what she started before she met me. It's better for her to accomplish what her parents paid for instead of just dropping it. I guess it's a Vietnamese idea of mine. Hehe..

    So yes I was born in a Indonesian camp... Its the little island above Indonesia. Back in 1992 our house was broken into and most of our important paper work was stolen. I can't remember if I had a birth certificate from Indonesia or not. I'll ask the parents for sure. But I would guess no, since it was on a camp.

    I know you said not to worry about the other two forms right now but Im the type of person who wants to have everything 100% until I submit anything.. But it's cool, I still have 11 months to gather as much info and paper work as I can. I have been considering hiring a person who has dealt with this before and I have been told by all of my Vietnamese friends that I should get someone to do my paper work since they know every detail on how the system works. I do not mind spending the money for it. And I also have family support.

    I'll rest my brain for a bit and then get back into reading up on the CR-1 forms...

  4. First off, the story...

    I got divorced back in 2009. I moved home with my parents since I'm the youngest. Early last year, my cousin introduced me to his friend which is now my girlfriend since January this year. I just came back from VN on the 14th of this month with tons of pictures and video. I did propose to her so everything is true...

    So it looks like I'm good on evidence. I'm planning on going back again the same time next year in May for my Grandma's 1 year anniversary of her death. Ever since I left VN, I, my mom, my girl's mom, and my girl, have been talking about marriage. So the next time I go back, I'm definetly getting married.

    The only thing I'm concerned about is my employment. I'm working under a temp agency. Have been there since January of last year. Making a little over $18,000 annually. I make enough to pay off all my debt with extra month for savings. But recently I have not been putting anything into my savings account because I'm trying to get everything paid off quickly. So yeah my bank account only has enough for all my debt, and exepenses. I noticed on the I-134 form, it says I have to include bank statements. Are all these neccessary or do we only need to submit our W-2 forms? Do they look at how much money you have in your bank account? or do they just go by income? Next month I will find out of I get the permanent position and a raise. If that works out, I know it will help me bunches but for now, I'm going with what I have. Should I, or should I not get a co-signer? I couldn't find any info on co-signers. I talked to my brother before and he said he is willing to help me. Also on there it says you can use other

    As for the G-325 form. Is this form only for my girl? or do I have to submit it too? I read the instructions and it said in there both of us have to have it. But I want to be clear. I'm not sure if I have any of my medical records, and I'm not sure how to obtain it.

    One more thing, I don't have a birth certificate. My dad left VN on a boat to Indonesia and I was born on the camp. 2 Months afterwards we were in the US. But I do have my U.S. Citizenship.... So I'm wondering if it's possible to submit the I-130 form without my Birth Certificate...

  5. If you owned your business and on your tax paperwork, you showed loss. Will that count against you? will that give us a RFE or Red Flag?

    I only had my business for half the year last year and I worked right after that. The total income is well over $20K which is above the poverty level?

    Also, lets say, I made $8k working for a business, and I have a $20K car.. How do I calculate the car as an asset?

  6. Hey guys,,

    I was born in Indonesia. I think I was born in a immigration camp. Anyway,, I have no birth certificate what so ever, but I do have my citizenship and the place of birth is Indonesia. But there is no city or town.

    On the I-129 form, I put Indonesia on the "State/Country" box. Under "Place of birth" should I put indonesia again? or do I leave it as "unknown"?

  7. The point of question 10 is to determine what proof of US citizenship will be acceptable from the petitioner.

    If you were born in the US then tick "Birth in the U.S.", and leave the rest of question 10 blank.

    If you are a naturalized US citizen then tick "Naturalization", and provide your Certificate of Naturalization number in the box immediately below the tick box. Leave the rest of question 10 blank.

    If you were born in a foreign country, and acquired your citizenship through a US citizen parent, then tick "Parents". In this case, if you have a Certificate of Citizenship in your name then tick "Yes", and provide the certificate number in the box immediately below the tick box. Otherwise, tick "No". Leave the rest of question 10 blank.

    Okay so I was born in Indonesia. When my dad received his Citizenship, me and my sister automatically received ours because of my dad. I have the certificate under my name though. So do I still check PARENT? and put my info under that? or do I put it under Naturalization?

  8. I'm in the same situation. I'm going to ask my father to co-sponser. I understand that he is liable till my wife is a citizen or AOS. Either way it really doesn't matter to me, because my dad owns his own business and as a elder, he loves his kids. I have a very understanding father, but I would love to be able to be liable for the AOS myself. Hope goes all well for ya...

  9. Unless you admit to drug use there is not going to be any "test" anyway. I don't know of many that even have admitted to any use of drugs get tested. If you've used drugs at any time in your life though, which you would answer yes to at the interview (that's where they ask the question), then you'd be inadmissible and would submit a waiver.

    Thank you for your response! There is no drug use in my past, so from this point of view I will not be telling a lie :innocent: Well unless you count blueberry muffins filled with poppy seed, like that episode in Seinfeld :)

    Both parties have to have medical records or only the fiance?

  10. Sorry guys if this question has been asked many times but i cannot find the answer.. I was filling out my form(petitioner) on I-129F and on question number 10 regarding citizenship.. I marked birth in the U.S. and there's a question that stated "Have you obtained a certificate of citizenship in your name?".. Are you just going to answer that question when you marked "Parents" or do I still need to answer it when I marked Birth in the U.S.? Thanks guys!

    I'm kinda stuck there too. I'm naturalized, but I"m not sure wether I should check "parents" or not?

  11. I'm not sure where to post this, but since this is really for K1 applicants like myself and everyone posting on this K1 Forum. If this is in the wrong forum, please move it for me! Thanks!!! It would be nice if we can meet up in person for some hands on help.

    As I am filling out the paperwork, I know for sure that I read it over and over and over to make sure it's right. But with someone who has done this before to look over your papers, it would be a lot less stressfull gathering paperwork and submitting forms.

    So my question is.. Is there anyone in the Austin TX area who has filed their I-129F packet, and already received either NOA1 or NOA2, who would like to help me out and others out if there is anyone needing it???

  12. Did your dad claim you as a dependent on the tax return he filed last April? If so, then his household size should be 4 - himself, your mom, you, and your fiance. If he didn't, then his household size would be 3. Yours would still be 2 - you and your fiance. I'm presuming neither you nor your dad have any other dependents they support, nor paying child support for kids that don't live with you, nor have signed an I-864 Affidavit of Support for somebody else in the past, etc.

    On the G-325A - it's FORMER husbands and wives, and not FORMAL! :P

    The G-325A is a general purpose biographical document. It's not specifically just for fiancee or spousal visas. Since you're applying for a fiancee visa you should NOT be married, so "Husband or Wife" should be "NONE". Your ex-wife (or ex-wives) are listed under "Former Husbands and Wives". :thumbs:

    This past april I filed as single, since I was working for Fox TV Station and divorced. I just recently started working with my dad after the middle of April when I moved back to Austin, TX. I wasn't living here, but now I am. Sorry for the vague descriptions. Anyway, I do have another dependent to support. Child support for my baby boy who doesn't live with me. doh i'm getting confused again!

    After I read over the guide, it helped a little, but I needed more detailed info. Your info helped a lot. But one last question about that. I was kinda confused of the household size. It's just me, mom, and dad. Since dad is going to co-sponser, will he only put down that he is supporting 3 people? (Dad, Mom, and Fiance?) or (Dad Mom and Me?) Or does he put down household of 4 that he is supporting. I guess Unless I'm supporting myself, he only puts down as 3 which includes my fiance. So in that form that he fills out, I have nothing to do with the form he fills since I'm supporting myself? Which I am supporting myself. Sorry if I confused you, but I'm confused myself..haha

    Otherwise, looks like I have plenty of proof and the right paperwork. I'm filling out everything as I am typing now.

    Oh BTW! I'm stuck on the G-325A form. It ask for Husband/Wife, then under that Formal Husband/Wife??? I filled out the formal husband/wife because I am divorced. Otherwise, the top part of that which asks for Husband/wife, do I put my fiance's info on there or do I leave that as "none"??

    Bringing my old post back on topic.

    I've read and read. Looks like I'm stuck with the Income Taxes. I have my tax returns, but I'm not sure if I reached the $18k level. (that's if it hasn't changed) Anyway, I can't even find good info on co-sponsering. Since I'm living with my parents, I'm sure my father will most likely agree to do co-sponser. If someone can nicely explain to me or point me at the right link to it.. it would be great help as I am going to fill out the paperwork soon. Once I figure out if the co-sponser will help. I also found a thread that explains you can combine income, both you and your "fiance". but I'm still stuck with information.

  15. Venus, I have both tax paper works and they are filed from 2008. Both my business and my work at Fox tv station. With both added up, it does not meet the requirements of $18k a year. The new job here with my parents, I just barely started 2 weeks ago. I'll post the rest when tonight when I get back online. gotta go to dinner..

  16. sigh*,,, all the headaches are now relieved. I really appreciate everyone help even though I briefly studied different guides on here.

    So No Lawyers it is!!

    Well, No lawyer or not, we are changing plans. I don't know what will happen within 2 1/2 years. Long story short, she's still in school for RN nursing in Sydney. She'll be done by the end of 2011. Hopefully she will pass her exam to enter US Hospitals and apply for a job Visa. In the mean time while working at the hospital (if all goes well) she will find a sponser and hopefully get a PR. If it works that way.

    Looks like I'll have a long journey!

  17. Oh one other thing, I had a business and solt in the middle of last year, so half the year I didn't make much because of income loss. The exact time, I aquired a job at our local Fox TV station and only made $8500. Is it 100% neccessary to show proof that I made atleast $18k that year? Now I am working with my parents, and they are paying me every 2 weeks cash because we both run the store. Pretty much I'm getting a small part of the income and it equals around $25K a year. Is there a way my dad can do something to show proff that I'm getting paid and able to support my future wife?

  18. Thanks guys,, We are going to go by the rules in the book. Get married within the 90 days of the K1 visa (Lets hope it will go smooth). I'm also going to be hiring a lawyer who can help me throughout the process. Make sure I don't make any mistakes. I'd rather pay the money for someone who is experienced and save time, than trying to figure this out myself. We want her over here ASAP. I know it'll be a long and "infernal" process. but we are both commited to doing so.

  19. Hello guys, new to the forum.. I met my fiance, wife by heart, on February 5th, and we started dating on the 8th. March 30th she flew to Austin Texas to see me and we had a wonderful time for 3 weeks. We decided it would be best that we marry so we can start our life together here in Austin. So my question is, We've only been together for 3 months and 2 days, is it possible that that our application will be denied because we've only been together for 3 months? I'm planning on flying over to Australia to meet her again in a few months for more evidence. We are going to do our best for her to come to the US with me and start our life together. I wish it was this easy, After reading a few posts, I'm starting to get iffy about this happening, but i'm thinking positive that it is going to.
