  1. this person has to be crazy (for lack of better terms). I was going to say he will probably get a RFE for incorrect fees and could just forget about sending it in again to end the process, but when I read further its looks like he is trying to correct the fees.

    You guys are totally mix up, if your wife wants to go back home then send her back home and stop wasting USCIS time. This time and space could be used on other couples who are eager to get this process over.

  2. I went on a interview today at a bank thinking the process would take a month or so and by then I would have my work authorization but to my surprize they want me to start in two weeks.

    I know I will not have my documents by then because I havent even received a biometric appointment yet, so my question is...will it be a problem if I start working now considering I will receieve my documents in a month or two. The employers is fine with it because I already have a SSN and would just have to provide the work authorization paper onces it comes in.

  3. My husband has received approval for advance parole, and would like to make a quick trip back to Cuba to visit family while waiting for his AOS interview. We were a little aprehensive about using the AP after reading the disclaimer on the form. "Parole into the US is not guaranteed." Everything that I have read on VJ would make it seem that it isn't really a problem.

    However, when talking to an aide for our congressman, she was very emphatic that we should consult an immigration lawyer before leaving the country on the AP, since there was a possibility that he wouldn't be able to get back in.

    My questions are to others who have actually used the AP or know someone who has:

    Can you tell me how that went for you?

    The paper says that AP is to be used for "urgent humanitarian reasons or significant public benefit". Were you questioned when you came back about why you went? Or does the fact that the AP was issued mean that this issue has already been decided? Basically, I was wondering if they would deny him re-entry if they thought his reasons for leaving weren't serious enough.

    Has anyone used the AP to return to Cuba? How did that go?

    Can someone with info on this give feedback. I am seeking info on this as well. I a friend who just receieved his greencard told me that his lawyer told him not to leave until he got his greencard even though he had the AP, which I found strange because the AP is for travel. But I guess its better to safe than sorry. i dont know if I can stay here another 3-4 months without going home.

    Me and my husband had our AOS interview Feb 23, 2010. The IO asked us just verification questions which we were able to answer. The IO proceeded to ask us the yes/no questions. Then the IO asked for supporting documents of our marriage. We provided her with numerous documents. At the end of the interview the IO said that we will receive a decision in the mail by the end of next week. She took I-94 during the process of the interview.

    Can someone tell me if that was good or bad. Please help!!

    Sounds good to me as well. Everything sounds standard. U shud recieve ur greencard in the mail in no time. Congrats

  5. lol.. I didn't even see there was a Luckygoat until I scrolled through the thread and noticed someone referring to an earlier comment by you. Thought process was "I'm such a lucky cat to have met my wonderful hubby!"

    Anyway, my timeline is:

    02/04/2010 Sent package (I-130, I-485, I-765, I-131) by USPS Certified Mail

    02/07/2010 Package delivered at Chicago Lockbox

    02/12/2010 NOA1 notice date (for all 4 forms)

    02/don't remember when/2010 NOAs received in mail, same day as bank account shows checks cashed

    02/22/2010 Biometrics appointment letter received. Walked-in to ASC to request rescheduling due to conflict with school (wasn't sure when they would reschedule it to if I sent in the request through the mail). Was given next morning as rescheduled date.

    02/23/2010 Biometrics done

    02/24/2010 Waiting, waiting.... and registered to VisaJourney!

    lol, lmao. my thought was "ill be one of the lucky ones that have this all over in no time"....and the goat came from my hometown. lol.

  6. Hi! I'm a February filer too. This is my first post (although I've been lurking for a while).

    Looking forward to hearing everybody's updates! (Will post my timeline later when I get the time.)

  7. You're not alone! I can relate... My husband is extremely confident that I will find a job but I'm still scared because Michigan has one of the highest unemployment rates in the country. I have a Bachelor of Science degree in Psychology as well as a 2nd undergraduate degree - Bachelor of Arts in Multimedia Arts. I had a year to go left to finish my 2nd degree but I went on a Leave of Absence when my husband (then fiance) met and I never went back to finish it because we filed the I-129F petition and got approved.

    I am not even hoping to find a job related to either field (for one thing, Psych grads in the Philippines don't have board certification yet). We've just filed our AOS application so I'm still waiting for my EAD / green card. In the meantime I'm trying not to worry. I'm just doing my best to stay positive and I definitely won't be too picky when I finally do look for a job. If I don't find one that I like, I'll take what I can get and just keep on looking until I find one that I do like. ^___^

    Wow thats a very positive attitude. I am trying to convince myself that I shoudl take whatever I find as well...although it is going to be hard for me coming from a very successful career in banking. I am just really really nervous. :( I cant to get me EAD and start hunting.

    Thanks... that helps. However about your point about waiting for 2009 1040EZ, I understand that its not mandatory to send in tax return for 2009 since the due date is 15th April. Won't a 2009 W-2 be sufficient? I can't get the 1040EZ form without actually filing the tax return, correct?

    Ok I get what your saying I thought the deadline pasted already for 2009. I know nothing about tax but I am almost certain people were flocking to beat deadlines. IDK. Either way you should be good.

    We are just about ready to send in my AOS package, and I had the following questions:

    1. For supporting documentation for I-864, I have my husband's tax transcripts for 2008, 2007 and 2006, copy of his 2009 W-2 and his recent six months pay stubs. Should I still try and get a letter from his employer? or are all these docs sufficient evidence. Has anyone not submitted the letter from employer and been ok? A letter from employer isnt required. You should be fine with those doucments although it would be safer to wait for 2009 1040ez considering that most recent is required and the last 2 are optional.

    2. Our household size is 2, and in the section where it asks for our annual household income, I have only mentioned my husband's income and not included mine even though I am on a valid H1B visa and working right now. I figured since my husband's income is sufficient for filing the affidavit of support, I can just mention his. Is this fine? Yes, this is perfectly fine

    3. How do people generally submit the package? Do you put the I-130 and I-485 package (including the I-131, I-693, I-864 and I-765) in separate envelopes and then put everything in one big envelope that gets sent? Can I send the package USPS Priority mail? i had two seperate pockets in one large envelope. What I did was put the I130 firms and relevant documents together with one big rubberband (seperated docs with paper clips within the rubberband) and I did the same with the I-485 package including the I-131, I-693, I-864 and I-765 (seperate each form with paperclips). And mines was sent USPS priority mail.

I have gotten two Intervew letter for initial interview, one notice date is 02/09/10 and another one notice date is 02/16/10.these two IL are same but except interview date, one is 03/17/10 and another one is 03/24/10.I sent AOS package on 12/30/10. is this normal? should i go for these two interview.

  11. Hi all... It's been a while since I've been here. I hope this is the correct place to post this question. My apologies if not.

    My husband (US citizen) and I have plans on permanently leaving America and moving to Australia (where I am from) late this year/early next year. I am on a conditional green card which will expire early February of 2011. Our plan is for me to leave in October and he will later follow when his visa stuff is sorted out. Is it legal for me to just up and leave for home without filing for the 10 year green card? Do I have to notify the USCIS when I leave? I plan on doing so anyway... But is it absolutely necessary? Would like some advice.

    Yes it is perfectly legal for u to up and leave (probably what the USCIS wishes all of us do) but it doesnt make complete sense to do such a thing. I am sure your mind is already made up but you never know what might happen. Suppose the USC hates Austrila and wants to move back? Then you will have to go through the whole process again. Any logical person will will complete the 10 green card so he/she can have a choice.

  12. If you leave the united states to go back home, and you know that when you re-enter the US your intentions are to get married, then there is a problem. If you left the US and you know you want to get married then you should have applied for a fiance visa before entering. From you statement its obvious that you knew you was getting married when you enter the US. Just don't let the immigration officer know that because it is fraud.
