  1. the space between marriage #1 and #2 is not too close so that is a good thing, but i am worried about her entering in the U.S and the next month she was already making previsions to stay here. That is going to look like her intent was visa fraud. I think you guys should be ok, just be prepared to have your whole interview based on this situation. She needs to get all her dates together and be ready for the interview. They can tell everything from their end, just how much visas etc she applied for so she needs to confident and truthful.

  2. I agree with you. I don't think there s any problem with sending in all three of the leases with a brief explanation regarding the year your wife was not on the lease. As far as the tax transcripts go there is no requirement for you to file jointly, only that you file as married. Many people choose to file married "filing separately" due to financial considerations.

  3. Hey guys my wife and I still have a little ways to go before sending our application up to remove conditions but we are getting things together early and i have a few questions.

    In our 3 years of marriage we have had 3 different leases. Our first and current lease have both our names on it but our lease in the second year just have my name on it. This is because at the time our income together took us over the maximum income requirement for the apartment we lived in, so I just went on it alone and then once she stopped working, I added her onto there when we renewed the lease. In the package I wanted to include all 3 leases with an explanation why my wife isnt on the 2nd lease but my lawyer is saying only send the 2 lease with both of our names and if we get a RFE for missing 1 year of lease then we send it in with an explanation.

    He is telling us to do the same with the tax transcripts. My first taxes i filed married but seperate because my wife wasnt required to file but our newest taxes we file jointly. I wanted to include both but he is sayin only send the one that we file jointly and if they ask for a RFE then we send in the other that I file seperate.

    I understand that you don;t want to point anything out to give the officer doubt but at the sametime i want to send in an error proof package with out any RFE and be upfront with everything.

    Whats your thoughts?

  4. Your case is not out of the processing times yet. There is a section above "Processing Times" where you can check what cases are currently processed by your local USCIS office. Your case will be out of the normal processing times if you see that your local office is processing cases that were submitted after the date you initially submitted your AOS application. Typically, if 180 days pass after the AOS interview and still no decision, you are definitely out of the processing times.

    yea i called a 1800 number and they told august is out of my processing time for feb filers. Im not stressing...Ill just schedule another info pass later on. I just wish we didnt have a request for more evidence becuz it just pro-long the situation.

  5. Since I wrote a letter to the IO who interviewed us. Today, I got a respond from a different officer telling that my case is actively processing however they need additional review. It says in the letter that I have to call them or make an infopass if I dont hear anything from them after 6 months. Hopefully, we get an approval before 6 months.

    What was ur initial reason for writing the officer again? Because you didnt hear anything from them after u sent it in? I cant believe they actually responded to you. how long ago was ur interview?

  6. hey luckygoat we had the same case. we had an interview last month and after the interview the officer gave us the paper ( Continuance for I-485) want us to send more pictures so we did send it after 3 days and until now we haven't heard any news. Yesterday we did an Infopass and the lady said our file is still unreviewed and we have to wait between 30-60 days again. She dont even know if they got all the pictures that we sent in. So what we did we wrote a letter to the officer who interviewed us and follow up our case, we also attached in the letter the proof of delivery from USPS.

    Did the officer gave you the letter that says "Continuance"?

    Not he just gave us a request for evidence form for some affidavits and promise to send us an approval letter once sent. We also did the confirm delivery thing. But talk awhile to send the affidavits in becuz we were waiting for one from my family back home....but we did send it with in the time frame. I think it take them awhile to start back on a case when more evidence is requested due to all the new cases...so im not really worried. keep me posted on how it goes for u. Im so sick of checkin my mail box everyday

Luckygoat, I am so sorry that you have to go thru this! did you consult an immigration lawyer before you submited everything just to make sure it's correct and complete?You need to keep scheduling infopasses and if it doesn't work...google senators in your area and contact one of them in this matter.     Thanks for the advice. Me being a smartass did everything myself even tho my friends advised me to consult with a lawyer and have a lawyer present at th einterview. Im still very optimistic tho. I will schedule another appointment next month if I dont hear anything. And I think we can wait another 2-3 months before really goin further to the senator etc.

  8. As some of you may know we had our interview last month and was requested to send in affidavits by the 5th of the month, which we sent in before time. However, we didnt notice until after the interview that the officer added I-601 waiver needed on the request for evidence form. We had establish during the interview that I didnt need a waiver because I wasnt ineligiable based on an arrest but he said that he would have to confirm with his supervisor. I dont know whether he just added the waiver on there in case I did need it but we didnt submit a waiver.

    So we went to an info pass to find out more information and they were unable to give us any help so the only thing we could think of was writing the same address again, although it stated that all evidence must be sent in at once. We submited a letter stating why we did submit a waiver, and evidence showing that am still eligible based on section 212 classes of aliens ineligiblity and didnt require a waiver, as well as the affidavits that we had sent in previously.

    what are you guys thoughts....I know its only the 16th but we havent heard anything yet?

  9. My wife received yesterday a letter from USCIS for request for applicant to appear for initial interview of the case I-485. for june 28, 2010. She is in Russia right now and she will be back on the 28 of june (Advance parole). What do i need to do to reschedule?, What are the steps? i called USCIS and they said that they need to speak to her so they can go and reschedule even though i told them she is overseas right now. Help anyone please. Thanks

    why cant she come back a day ahead?

    Do not reschedule ur interview, it does not look good and u'll be lucky if u recieve another appointment this year if u reschdule.

  10. During the interview the IO asking additional documents to send in before giving the decision. The IO gave me a paper what documents that I need to submit with due date to continue my AOS processing.

    I already sent what the IO was asking.

    Questions:

    1. How long would it take to process it?

    2. Will the same officer will handle my case regarding the additional document required?

    Please post your experiences regarding additional documents needed during the interview and how long it took you to wait for their decision.

    Hey I have the same experience. I have to send in additional information. But I think that it is going to the same officer because the address has attention officer smith on it. What documents did they ask for?

  11. Had the interview yesterday and was approved.

    The IO had a serious look on his face the whole time except on maybe one or two occasions, when my husband cracked a joke. He started off by going through our application and verifying our names, address, etc. Yes, he did ask all those questions on that checklist, and of course I said "no", but he was staring at me so intently that I felt nervous and almost like I was guilty of something. ("Yes, I guess I am a terrorist! I'm sorry!") We showed our joint health insurance, life insurance, mail addressed to both of us, and a stack of pictures (collage style). He really looked at the ones of the courthouse ceremony. We were really nervous (at least I was), so I guess we were pretty stiff and our loveydoveyness didn't show much. However, I think our affection for each other came out when he asked us how we met and then we helped each other tell the story, laughing and joking throughout it. We'd hardly finished it when he turned to his computer and printed out the removal of conditions paper and said we were approved.

  12. I had my interview this past couple days and the IO did not even ask about affidavits. He did wonder though why we had a small wedding. I think they like to see that families are involved. I agree with the previous poster - add additional affidavits - if you have brothers or sisters - add them too.

    Also, my AOS interview IO asked for additional documentation. I asked him if I need to address the additional document requested to him specifically. He said no. I wonder if the same officer reviews the documents that they request or it just goes into a pile and anyone can just pick up the work from there...

    thats a good question. i wondered as well if it would exactly go back to that exact officer
