I agree he should mention it somewhere - the cover letter is just as good a place as any - along with a very brief explanation of what happened so it is clear that the submission was rejected for improper fee rather than the petition being rejected (like Penguin said). Much better to get that out in the open rather than having it pop up on someone's computer at USCIS and he has not disclosed anything about it.
Hopefully you already realize that the topic of this thread is inaccurate. The topic indicates that there was a visa denial in the past, which is a big deal. A petition package getting sent back for the wrong fee is not a big deal. He submits his petition first, then the visa application will be yours (although you may work on both together).

Hello and Namaste,
It has been a while since we went through this process, but I remember my husband's Packet 3 got lost in the mail in Kathmandu. Not sure if the process is the same now (probably), but after your NOA2, the petition goes to NVC and they send it on to the US Consulate in KTM. The US Consulate then sends out Packet 3 to the Nepali fiance(e), which contains the forms that the Nepali fiance(e) needs to fill out, including a visa application.
I am the USC (well, we both are now, but then it was me). I followed our timeline and so I knew when the petition left the NVC on its way to Kathmandu. When Packet 3 didn't arrive at my fiance's house within a few weeks, he went to the Consulate and they gave him a new Packet 3. Apparently the first one they sent out to his mailing address got lost in the mail. He even found out it went to his VDC headquarters, but they apparently tossed it. As you know, anything addressed to anywhere other than a GPO post box is at high risk of being lost. Anyhow, when he had finished all the paperwork, he hand-carried it back to the Consulate and they told him to come back the next day for an interview! You will probably not experience that kind of speed, but I don't think the wait is long.
Now that there is online tracking of case status, you may find it easier to figure out when your petition leaves NVC and approximately when you should get Packet 3. Keep in mind that once it leaves NVC, it is under the purvue of the Department of State (another agency that does NOT offer online case status, as far as I know).
My story is just a long way of telling you that you need to track your case as best you can, and may need to pick up and deliver your paperwork at the Consulate in Kathmandu to make sure nothing gets lost.

Wow, USCIS approved the petition without a stamped passport, boarding passes, or pictures together???

So the only proof you have of meeting is that you, while in the PI, bought a plane ticket for your fiancee during the same time period you were there?
How did you pay for your own initial plane ticket over there?
If it was me, I"d make a second trip if at all possible.

Hmmm.... this may seem like a tiny, irrelevant point, but in your original post, you say you were traveling "back" to Canada. Almost makes it sound like you were just visiting PA and now you are going home. I could be wrong, and way too detail-oriented, but if I were Canadian border patrol, that language would send up a red flag to me.
Just sayin'
I think those who are suggesting routinely carrying "proof of ties to your home country" with you as you travel have it right.

Thanks to everyone for their answers and opinions. Jupiter is right... our situation is straightforward... no issues. And he just turned 16.
And I would love it if our situation was: do we spend the $600 on a CofC or do we spend an extra 2 days at Disneyworld this spring? But it's not. The question is whether or not we spend $600 on a CofC or put it in his (too small) college fund.
So far no one has posted an instance where their child was adversely affected in any way by not having a Certificate of Citizenship, so I'm not getting all excited about throwing another $600 at Uncle Sam.

ETA: Oh, and we do travel back to Nepal every other year (which is more often than we can afford!) so that, among other things, my husband and son can see their family, including our son's birth mother. So the passport is a necessity either way.

The answer is: NOBODY.
For my daughter who is 16 and a PR, the officer who interviewed me told me that a Cert. of Citizenship for her is NOT a requirement. He told me the advantage of having it is that if she lost her passport, that would be proof of her citizenship. But, I will get her a passport card too - which will be proof of her citizenship if she lost her passport.
The officer also told me that if I don't have a cert. of citizeship for her, when I apply for her passport, I have to provide evidence of her journey to citizenship. My take on this that, I have no problem with providing this evidence when applying for her passport. I have been providing evidence and more evidence throughout this process, what is hard about providing evidence of how my daughter is eligible for citizenship (when applying for her passport)?
My decision: I will NOT be applying for a cert. of citizenship for her. I am NOT ready to part with 600$ for N600.
Hmmm... I like that idea... getting the passport AND the card. Maybe I'll hold on to the card even after I let him have the passport. Might save us a lot of time if he loses the passport.

I have read this forum for a while and have searched for information on this topic. I have seen, on several threads, inferences that there may be times/situations when a US passport will not be sufficient to prove that a child (who derives their citizenship from a naturalized parent) is now a USC. I have not seen anyone spell out a specific instance where this actually happened. In one thread, someone was asked to provide the name of an institution that they maintained had that requirement (a CofC). They did not return to the thread and provide details. So I am curious.
Of course I want our son to have whatever he needs to get along and thrive in this country, but I also don't want to spend $600 on a certificate that he may never need or use.
So I am asking for specific evidence that ANYONE has ever been told by anyone that their passport is not sufficient proof that they are a naturalized USC, and that they could not do or qualify for something without an official Certificate of Citizenship.

Here is our situation: My husband is a new USC as of last month (yay!). Our son (my stepson) is 16 and came here with his dad on a K1/K2 visas in 2005. We have lived here together as a family since that time. So he is now, also, a USC. So here's my question:
Under what circumstances would a US passport (for our son) NOT be sufficient proof of his citizenship? It works for CPB/re-entry into the US, getting a driver's license under tighter DMV rules, opening a bank account, proving to an employer that one is a USC eligible to work, so who, precisely, would say "a US passport is not sufficient, you need a Certificate of Citizenship".
Has this actually happened to ANYONE, and what were the circumstances?

I am tickled to report that my husband (and derivative son... lol) are now US citizens! We had a nice time at the federal courthouse in Charlottesville. The asst US atty that presented the 52 (!) applicants to the judge told the audience that he was the son of Iranian immigrants and watched his dad become a US citizen when he (the atty) was 10 years old. I think he did a fantastic job with all the names. And the judge was a character! He joke around a bit... a pregnant woman came up for her certificate and he said "Two for the price of one!" and the DAR ladies who were handing out little flags gave her two. He also told everyone that he really appreciated them doing things the hard (but legal) way. It was a really nice time. Feels good to turn that bad boy red. And best wishes for those racing to the finish line!

Wow, I feel for you, going through this mess.
You mentioned in one of your posts that he had several names, or ways of writing his name, and that may have been how he was admitted on tourist visas after having been deported. Please consider listing his various "aliases" in any communication(s) you have with ICE or any other regulatory body, if you haven't already.
That kind of permeability at the US/Canada border was a big problem for all of us before...

Sorry our situation was not clearly stated in my original post!
My husband and stepson immigrated together in fall of 2005. They are both LPR's and my stepson lives with us full-time. My husband is about to take the oath of citizenship next Friday. My stepson will turn 16 less than 2 weeks after my husband becomes a USC. We will be applying for passports for both as we travel back and forth to Nepal every couple of years.
Aaron thanks for the info, and Brother H, thank you for the info and the link. It looks like it applies only if we submit passport applications before my stepson turns 16. So we'll just wait. Interesting though, that kids over 16 do not need this form.
Has anyone ever had trouble getting originals back from DOS when submitting them for a passport application??
And since the one Certificate of Naturalization applies to both passport applications, is it advisable to do them A) together or B) father first, then son (when we get the Certificate back from the first application process)?

We are so looking forward to my husband's oath ceremony next Friday! I have a few questions about applying for passports.
Looking ahead, we would like to get US passports for my husband and our son (my stepson). Our son is about to turn 16 in February. From reading here and on the USDOS website, it doens' t look like there's substantial difference between applying for a 15 year old and applying for a 16 year old, except that the former will result ina 5 year passport and the latter will result in a 10 year passport. Can anyone think of a reason to rush and get the apps in before he turns 16? We have no immediate travel plans.
It looks like we have to apply in person because they are both first-time US passport applicants. It also looks like my husband's Certificate of Citizenship is proof for both of them of US citizenship (along with birth certificate and translation for our son, as well as proof of legal entry, which I assume is his cancelled visa in his Nepali passport) . So should we just hand it over at the post office and hope that all the info stays together??? I am so nervous about giving them the originals of all of those documents, including his foreign passport!!
Are they reliable about returning this stuff?? I can't imagine trying to replace his Nepali birth certificate or passport. We'd probably be soaked for beaucoups bribes.
Last question: they want permission from both parents. Our son's biological mother is in a remote village in Nepal. We have a letter from her stating that she wants her son to go live with his father in the US, but it is not official in any way. Nepal is not party to the Hague Convention. But I have met her and it is clear that we have her blessing to have him here with us. The USDOS says you should/can write an explanation about why the other parent is not present, but I wonder if anyone has submitted such a thing, and if so, what did it say?

Got a call this morning from an IO regarding the confusion about the oath ceremony... they have scheduled my alien husband
for his oath ceremony on Jan 20. I changed the list below but am adding this comment because several things impressed me about how this was handled:
1. They admitted that someone at USCIS had made a mistake (by telling us to come back for the oath later the same day of the interview)
2. They apologized at the time, in a message on our voicemail a day or two later, and again today.
3. They called to tell us when/where the new date was, even though they will be sending the info in the mail.
4. The IO who left the voicemail message also left a phone number!!
5. The IO who left the voicemail message (also the same one who called back today) volunteered that he has been through this whole ordeal with his wife, and was therefore empathetic. He was.
All in all this snafu with the oath ceremony has been really refreshing!

Oh wow... I just went to change the list and realized we don't have anything to change yet (DUH), but I also noticed pkash had their interview yesterday, too! Maybe we were there at the same time!!! I hope it went well for you!

The IO in Fairfax was very nice and went through his application verifying basic info, then asked him all those questions about breaking the law and being a communist and blah blah blah. I had been up in the air about what to put on the app about serving in the military if asked. My husband said he would, and that's what we put on his app, but when she asked the question, I chimed in, "he's willing to serve, but I'm not willing to let him!". She got a chuckle out of that. She then asked him to read a sentence in English "Where is the White House?" and write the answer "The White House is in Washington, DC". Then she gave him his little civics quiz:
What is an amendment?
What is the capital of your state?
To what are we showing allegiance when we say the Pledge of Allegiance?
Which countries did the US fight against in WWII?
and I forget the other two...
Then she congratulated him and said he passed! And then she said he could take his oath that very afternoon! Could've knocked me over with a feather. But it turned out he couldn't because apparently the county we live in is out of their jurisdiction for oath-taking. I have no idea how that could be, but we have to go to Charlottesville, VA for the oath. Who knew? Has anyone ever heard of this before???
Anyhow, as we were leaving, she complimented me on how thorough and well-organized our applications were, which was very nice. And she mentioned that she really enjoyed a paper she saw (it was actually in the ROC app... interesting that she had that there, too, I guess) where I had had our son write 30X on a piece of paper "I will not kick the soccer ball towards the house"... LOL because he broke one of the window several years ago. I told her it was proof that I was parenting... hehehe
All in all a good experience! Thanks for all the help and support, you all!!

I have heard a few stories over the years about people who were coming in on K-1 visas and either wore a wedding band or referred to their partner as "my husband/wife" when being questioned by CBP and got themselves into hot water at the POE. Don't do either of those things (or, as someone has already said, act like a terrorist or try to smuggle drugs in... lol) and you should be fine!

I am suprised there are not more people advising the OP to contact his USC fiancee and urge her to contact her Senator/US Rep immediately (they all have immigration liaisons) and ask them to contact the DOS and request to keep the package at the Lagos consulate for further review.
Is that no longer the best first approach, given that the denial is only 3 days old as of today?

Well I wouldn't take it personally. Maybe someone peed in her Cherrios that morning, or maybe they have instructions to be @$$holes every 10th interview. Or maybe someone in her family just died, so better yet, answer her hostility with compassion. Could be anything and may not have anything to do with you. Just be cool, shepherd your application through the process carefully, and give them what they ask for. You're almost there! Best of luck...

Yes, the DV application (which is NOT a visa application) asks for basic info (name, birthdate, birthplace, etc...) and passport-style photos for applicant's spouse and all un-married children under 21 years of age. I believe all of these family members are eligible to accompany the applicant if they "win" the lottery and are successful in the visa application process that follows.
The plot thickens: I now see from my research that polygamy, while common in practice IS ILLEGAL in Nepal. But apparently after a slap on the wrist, both (or all) marriages are recognized by the govt of Nepal. Sounds about right. Nepal has some great laws, but most are not enforced at all, or are enforced selectively on those with no power /money to protect themselves from arbitrary enforcement (ie, the lower castes). Guess that's similar here and everywhere when you get right down to it.
At any rate, I think this fellow needs to just get the divorce (or legal separation at a minimum) before even applying for the DV lottery.

DV 2015 Nepal - nephew tricked by shysters?

My nephew notified me several hours before noon on October 1 (EST) that he had already had someone submit an entry into the DV lottery in Nepal on his behalf. I know this is wrong on several levels, and he totally jumped the gun on me, so now I am trying to figure out what the damage is. My understanding is that the DV 2015 lottery did not open until noon EST on Oct 1. Is there any way an application could have been filed in Nepal earlier than that time, or is that the exact time the site went live?
The reason this is critical is because if more than 1 application is filed for any one individual, they will both/all be thrown out.
He was also told (not sure if it was electronically or by this shyster) that his confirmation number would arrive in 2 - 4 weeks. Sounds like just enough time to trick a bunch of others and then split. I haven';t found out yet if he paid this dirtbag any money or not.
Any advice?
