  1. 7. Have you EVER not filed a Federal, state, or local tax return since you became a lawful permanent? Yes/No

    I am sorry as I asked this before. I'd like to know from people who passed/know well about this part on the form. When you are NOT required to file Federal, State, or Local return, did you answer YES or NO to this part. I got a free phone consultation with two different lawyer and they gave different answer. So I'd like to hear from this forum experience. Thank you!

  2. Ryna, sorry to ask in your post. I read that since you live in FL you habeas no income tax. My situation is that based on MT state tax law, active duty military pay, for residents of MT who enlisted from there, is exempt from income tax. Since my husband's sole income is from there, so there is no tax for him thus we did not file the state return. Does it mean we answer with "No" for the question if I have ever not file Tax? We never missed filing Federal tax.

    In 2009 and 2008 I filed a joint return with my husband for Federal Return only, but not for State as according to the Montana State law, active duty military who enlisted from Montana is exempt from income tax.

  4. I am married to a service member, the same person who sponsored me, I have had my green card for over 5 years, I have never traveled outside the US since I became LPR.

    The things I need to send in are:

    1. Copy of my green card

    2. Two passport-sized pictures

    3. Credit Card Authorization form as I intend to pay with credit card.

    I send ONLY those along with the completed N400 to Nebraska Service Center.

    Please chime in if these are all I need.

    If I want to apply for citizenship based on my five-years residency, do I need to include the paperwork needed for filing Based on marriage to US Citizen such as marriage certificate, 3-years tax transcripts? I still am married to the same US Citizen since I came here, but since I have lived here for more than five years I would like to file based on five-year residency.

  6. Hello, I am planning to file for citizenship next year after I get my tax return, hopefully. I have been here in the U.S since September 2009 with IR1 Visa. I am still married to the same U.S citizen too. He is in the military, USCG. I have never been out from the country either since then. In 2010-2011 I was receiving WIC as that time my husband was attending college, but he was still in the National Guard, not active duty, and I did not work. Is receiving WIC a bad thing that might make my application get denied. I asked this cause I am unsure if WIC a means tested benefit or not. I hope someone from this forum can help me. Thank you!

  7. I have been reading and observing some of the post in this US Citizenship forum. Right now I am confused thinking whether it is a better option to file for citizenship based on 3 yrs marriage or just wait after 5 yrs. The reason is I thought that this citizenship stage should be more simple than ROC stage (for the 3 yrs application). We don't have to send evidences like we do in ROC. Apparently I found some people submitted or got requested by USCIS to have to submit more papers than what are asked in the N-400 application form instruction. :unsure: So my question is, to those who have gotten their US citizenship without any bad record in their background and have simple case, do you think it is better to apply based on 3 yrs or 5 yrs to avoid all the hassles?

  8. NickD, wow, looks like your wife's experience in naturalization was almost the same as the ROC. I mean, I thought Naturalization, even though based on 3-yrs marriage, will be more simple and less documents to be submitted. I guess David-and-Mae is right, it really depends on the IO. Anyway, I see that your filing location is at Nebraska Service Center. Did you send it over there because of you're in the military? Anyway, thank you for sharing your experience and responding to my post :)

  9. Hi, I am still one year more to be eligible for naturalization based on 3-yrs marriage but I have a question about the checklist of documents that need to be submitted. My question is if this marriage is the first time for both me and my husband, all we need to submit is just the other three items (#1, #2, #4)right? cause I am kind of confused that the heading clearly said "send the following FOUR items" and it doesn't explain if the USC spouse have been married before or not.

    1. Evidence that your spouse has been a U.S. citizen for the last three years:

    Birth certificate (if your spouse never lost citizenship since birth), or

    Naturalization certificate, or

    Certificate of Citizenship, or

    The inside of the front cover and signature page of your spouse’s current U.S. passport, or

    Form FS-240, “Report of Birth Abroad of a Citizen of the United States of America,†and

    2. Your current marriage certificate; and

    3. Proof of termination of all prior marriages of your spouse-divorce decree(s), annulment(s), or death certificate(s); and

    4. Documents referring to you and your spouse:

    Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or

    Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or

    An IRS tax return transcript for the last three years.

    I really appreciate if anyone can clear this up :)

  10. Yaaaaaay :dance: this morning I got an email from USCIS that today, Sept 7th 2011, they ordered production of my new green card. I am so happy :dance: Now I can relax and wait for my baby boy to pop out this late october :P Well, I will post again when I receive the card in my mailbox. Thank you so much to all the members that have helped me throughout this process. I wish all the June filers to get their case approved soon as well.
