  1. I called USCIS and they told me that they are running security check. I have a very common name, infact, I was detenied at the airport last month because they have another person with the same name and birthdate as mine that has an order for arrest.

    Is there a way to learn if my name has been cleared or if it is under review? By the way, I am the petitioner.

    I know a VJ couple from April Filers that got approved.

    There's absolutely no pattern at all with USCIS...

    keep calling, keep asking if it is already assigned to an officer

    If we keep calling will that affect the case in anyway....meaning "this person calls too much so will stick it to the bottom"

    A big fat YES!!!!!!!!!!!! Once a petition is pulled case the petitoner called, it is NOT put back in same place they pulled it from.

    When we call USCIS, most of time the rep. (no matter at which level) will pull up your computer record and tell you the status from there, not your phisical file folder. So I believe that calling the USCIS should not have impacted your chance of being processed.

    USCIS is so unfair to the CR1/IR1 filer these days, the processing time is more than their goal of 5 month now. K1 is said 5 month.

    I don't know what else to do other wait :crying::crying::crying: so frustrating :angry::angry::angry: !!!

    I only posted what Washington DC told me.

    I spoke to an officer and then another higher level rep that when you call it is just an inquiry and your case doesn't get pulled from queue. It is just looked into from the computer. They also told me that calling doesn't affect the case status.

    You brought me peace of mind. I was afraid that I committed a mistake because I called to inquire last week, and thought that I put my self behind in the queue. I sure hope that you are right. I faced up to many challenges in my life, but this journey is the most demanding from an emotional point of view. Being apart from your love ones is so hard, and knowing that there is nothing that one can do to fix that, is even more depressing. I wish the best outcome for all of us

    I submitted my petition on March 17, and I am still waiting for my NO2. I am concerned because it seems that USCIS has not processed/approved any petitions in the last 4-5 weeks, with exception of some expedites, in fact the petition before mine was approved on May 28th and they haven't approved any other petitions after that. I called customer service, but I got the scripted answer posted on the web. How can we find out when USCIS will start processing I-130 petitions again? Is there a phone number, besides the customer service number, where one can get in informative and accurate answer?

  4. Well the good feeing I had today was blown away, instead of NOA 2 I got RFE.

    I called USCIS and RFE was issued May 2nd, but still not received in mail today. But I think I know what it is, I sent in a copy of marriage license, and not the Recorded/Filed with courthouse. And that is okay, Im ready to send to them overnight.

    Funny part when I realized what I did, as soon as I got NOA 1 I sent them the recorded copy of marriage license with my NOA 1 copy, guess they USCIS never matched it up.

    Oh well, that is where I stand.

    Well... at least somebody at USCIS did something else than staring at your folder, they took the effort to open it and review it. I hope that soon you, and the rest of us, will be out of this limbo. Good luck.

  5. I filed two I-130 forms, one for my wife and another for my stepdaughter. I want to be proactive and prepare the I-864 and the DS-3032 (deliver by email) forms for the next phase of the process, but I have a couple questions.

    1. Should I use the I-864A or I-864EZ? I am not sure because I filed two I-130s. I have a full time job, and also a small business, however most of my income comes from my job.

    2. I will ask my wife to email the DS-3032 form to NVC. Since my stepdaughter is only a child, should my wife send the DS-3032 on her daughter’s behalf? Or, I should send the DS-3032 email for my stepdaughter?

    Hi, I try to answer your question:

    1. You'll use I-864. You can't use I-864EZ cause you'll sponsor more than 1 intending immigrant.

    2. You're the one (petitioner) who have to e-mail a DS-3032 for your step daughter.

  6. Get your tax transcripts, that way you cover all the bases.

    If your self employed, you would just have the tax returns you sent if you don't use the transcripts.

    You can call the IRS and they can fax them to you within 20 mins or so. (it's free)

    The transcripts are not available for returns we just filed a few weeks ago (i.e. tax return 2008), are they?

    I filed on March, requested transcripts, for years 2006-2008, on April 13. Received the transcripts on April 22. So they should be available for you.
