  1. My husband is Canadian resident and living in US from 2007 on F-1 visa and now i am applying for him for Green card.Can he keep two PR cards,both of Canada and USA.Still he cannt apply for Canadian Citizenship (because he didnt live there continously as that time limit that rtequired)

In I-864 column 25 there are two options to mark (one is optional).In first one, it says i have filed federal tax .......................... 3 most recent tax years.But i didnot file tax return for 2007 and 2005 as income was zero (didnt work) and in 2006 income was too low.so again didnt file($18.00 tax return)

    So should i still mark on this box.Plus i will attach a wriiten explanation also as per instructions.(low income).So just want to know should i still mark this box.

    You will be marking the first box, it says:

    I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

    As long as you have sufficient current income, which is over poverty line, you will be fine. Just include the last year tax return and you will be good.

    thanks ,but because of zero income in 2005 and 2007 and very low income in 2006,we have a cosponser who is filling I-864 his own.Thats why i am asking that which box i should mark because i dont have anything for 2005 and 2007,but have W-2 for 2006.i have verification letters from IRS taht shows i didnt file tax in 2005 and 2007. and for 2006 they gave me one paper with their stamp on it shows that tota; tax return for 2006 was $18.00 .I dont have any transcrpit of tax return.

I am filling I-864 and my income is zero and we have a co-sponser and he is also filling I-864 as he is not our family member because he lives seperate and we live seperate .So should i mention about his income in column 24(B).I am confused because he is our relative but doesnot live with us so cannt include him as house hold member or just mention N/A.In instructions even they didnot mention about this situation.

    2) His individual annual income is enough (because that fulfilling the guidelines of Poverty)but his tax return is joint with his wife (Her income is not included),because of this joint tax does his wife need to complete I-864A or she doednt need to fill any form.

    3)Household Size : in co-sponser family there are 4 family members (he ,his wife and two dependent children).so to fill form I-864 he should consider only these 4 family members or should he consider that person for whom he is co-sponsering.PLEASE REMEMBER THIS CO-SPONSER IS NOT living with us.His family lives seperate and we live seperate.

    1. Faxed copy of US citizenship document should be fine, make sure it is legible

    2. His wife does not need to fill anything out. His documents need to be the same as yours as far as support documents

    3. Family size is his family PLUS the intending immigrant(s) he is co-sponsoring

  7. Yeah, how can he possibly be making enough money on a student visa? Any student visa I've ever heard of only allows for part time work.

    You may want to consider finding a co-sponsor to ensure the poverty guidelines are met for your whole family. For your family of 4, his income would have to be $27,562. Difficult to do only part time I'd imagine.

    It is not uncommon for someone on student visa to be making good amount of money esp. if the person is a graduate student. I used to make $23k+ (not a lot but quite good as a student) as a research assistant at graduate school. I was on F-1 as well. One of my friends at another Ivy (Cornell) was making 35k+ because his research was jointly sponsored by two universities.

    Also, I believe spouse's income CAN be added to USC's income to prove overall income is above poverty.

    sedation -- go read instructions on I-864 and you would have a better picture.

    I understand this probably doesn't apply to sedation's case because her husband is on loans but just wanted to let you know

    Thanks Kumar, My husband has F-1 andI-94 visa till June 2009 and Tourist visa till 2012 and on student loan for a dental student from July 2007.we are in the limits of poverty guidelines.I didnt do job in 2007 and 2008and not file up the taxes of 2007.So his school loan is the source of income.Please tell me now which forms he should fill and which forms i should fill.

    My husband is Canadian resident and he is in US with me from June 2007 on F-1 visa as he is studying here.He has US SSN also.In June 2009 is our second marriage anniversary and we are trying to get CONDITIONAL GREEN CARD before that.I have filled forms I-130, I -485, G-325 A (from both of us but separately ,do we both need to fill this form).

    But i am confused that for AFFIDAVIT OF SUPPORT which form i should fill ( I-864 or I-864 EZ)as i am homemaker from last two years and taking care of twins and all expenses are on his school loan.Except these two forms do i have to fill I-864 A also or my husband should fill because he is the one who annual household income supports all of us.

    I didn't fill tax return for 2007 and 2008 also,i thought didn't work so i dont need to fill.What should i do now for tax return of 2007 now as there is column for federal tax return income in I-864A for last two years.We are family of 4members(me, my husband and twins).Please help me and send me informationas much as you can.

  9. aren't you on your husband's taxes?

    no,because he is here from 2007 as student and his school gave a form 8843 to fill the tax return now in the end of the school session and it will be zero and there is no column for family.

    You will need to file an affidavit of support. In addition, you will probably need a co-sponsor to file a secondary affidavit.

    So can my husband be my co-sponser as he is living with me and has student loan as his income ,that also completes all requirements of guidelines.And if yes which form he should fill, I-864A.and i should fill I-864.

    Being a US citizen from April 1,09 i am applying for my husband who is living in US with me from 2007 as dental student.I filled most of the forms(I-130, G325A filled by both of us but seperately and I-485) ,but confused between I-864 or I-864EZ as i dont have any income because i didnt work in 2007 and 2008,its only his school loan on which all our expenses depends.(4family members,me ,my husband and 15 mons.twins).So which form i should fill.

    Next i didnt work in 20007 and 2008,so didnt fill tax return paper.But there is column in both forms I-864 and I-864EZ for tax return of last two years.What should i do in such condition.Should i contact IRS in this matter.Please help me and give me some detail information regarding this matter that what type of forms i should fill now and what forms my husband should fill.

    You, the US citizen, should fill out I-864, or I-864EZ. Look at them and decide which you should use. One gives a place for listing assets, basically. Your husband should complete the I-864A since he, as the inteding immigrant, will be contributing ot the support of the family.

    For 2007 and 2006 (I presume) state reported income as 0 (zero) dollars. You may also attach a letter explaining you did not work during that (those) years.

    Privided your husband makes enough money for the familt, I do not think you have a problem. One thing, I presume your husband has some sort of work authorization if not a green card, correct?

    Thanks.But do i need any particular form /application to mention that i didnt work during 2007 and 2008 or just a letter written by my own showing the reason .Yes my husband has work authorization.
