GC holder doesn't need to file I-131 for re-entry permit, the GC is sufficient for re-entry into the US.
but my husband got one good job offer in canada due to which he has to stay for a year and half from USA.Any suggestion.
-
how long it will take for biometrics once USCIS received I-131 for GC holder(for re-entry permit).

OUR case is:
Me and my kids are US citizens and My husband is GREEN CARD holder since August 2009.But he is PERMANENT RESIDENT of CANADA also.According to Canadian immigration if their PERMANENT RESIDENTS lives in CANADA for upto two years , then he/she can get residency of other country. We moved to CANADA in Sept. 2009 as our family lives here. Now my husband works in USA AND CANADA both as Dentist. He crosses border every week with Green card and PRcard to enter in USA AND CANADA respectively. We all are living in CANADA right now and he has applied for our PR card as well(hopefully by end of April we will get that).I am not doing any job here.He can apply for his CANADIAN CITIZENSHIP after one and half year.
He is filing for tax for both USA AND CANADA from last two years( together HUSBAND AND WIFE).we both have driving license of WA(USA) also, but not CANADIAN and our cars are also USA license plates. As both vehicles are on my name and i have temporary status in CANADA i cannt transfer vehicles in Canada(i dont want to do that even). We both have bank accounts in USA AND CANADA.and mailing address of USA(relative's address where he stays while on job) and CANADIAN address where we all live(own apt.).But we live in USA address only for 2 nights/week(when he has his job during week).
Now we consult one lawyer and he told he cannt keep two residency. My husband's job in CANADA is better than USA one,(But he is doing this job under someone),but he wants to open his own clinic in USA and we all want to live in USA.but still he didnt get any good deal.We dont want to caught on USA border or in any other problem related to GREEN CARD.Lawyer advised us to apply for RE-ENTERY permit(TWO YEARS),but i think if we do that it will show USA immigration that he has PR card of canada.Again therz trouble. As we dont want any problem.
Another option is SURRENDER GREEN CARD.Lawyer said to surrender GREEN CARD and take visitor visa.Continue with PR CARD .once you will be CANADIAN citizen ,i (wife) can reapply for GREEN CARD without any trouble.
But we didnt ask him,
1)after how much time of surrendering green card i (wife) can reapply for Green card for my husband.
2)Is it better to surrender Green card inside USA or outside USA.
3)If i apply for GREEN CARD again, which one will be much easier remaining inside USA or outside USA.
OR REENTRY PERMIT IS BETTER OPTION
PLEASE HELP US.

thanks, but i called indian embassy and they said photocopy of indian passport will help to cancel passport and that was only to get visa for india only. But i am asking that for PIO or OCI, is indian passport mandatory or embassy provide some document for PIO or OCI later on. Cause applying for visa and PIO or OCI both process in seperate departments.Hi,Couple of months back, I applied for PIO. I received it in just a month since the time of application. Depending on your frequent travel abroad, entirely upon you to decide to apply for either OCI or PIO.
OCI is a 3 months process.
PIO is only a month.
You mentioned that you have lost your indian passport and do have a photocopy, please consult your nearest Indian Embassy for more information, as the Indian passport will be cancelled. Wish I could help you more on it but I am not sure if you have a photocopy
Good Luck!

OCI is better than PIO. You should apply for OCI.

After I became an US citizen I got my tourist visa from Houston. Basically I had to go there early in the morning and give my Indian Passport and a letter saying that I am surrendering my Indian Passport. Then in the evening they will return the Indian Passport back to you after stamping on the first page of the Indian Passport saying that it is Cancelled. So basically they cancel the Indian Passport and then return it back to you and they put a Tourist Visa in American Passport.
However, since in your case you lost the Passport, I am not sure how you would do it but contacting the Indian embassy would be the first thing you should do. They have a phone number listed on the website. That number is always busy but i kept calling and finally got someone to answer from Indian embassy after constantly trying for a couple of hours. Or if you live close to one of the indian consulates you should pay a visit cuz it would be a lot easier to find information from indian embassy if you directly go to their office.
thanks a lot. i called Indian embassy and they said photocopy of indian passport will work and that i have with me.

You are misinformed. US citizens do not need an Indian passport when applying for a visa to India. You are now a US citizen, and you don't have an Indian passport anymore, just like about 285,000,000 other US citizens. Forget that you were an Indian citizen once; you are now American.
but according to indian embassy,if indian citizen get foreign citizenship then one must have to submit his/her indian passport,so that they can cancel it.But i didnt do that, because i also came to know about this today. and i got my US citizenship last year and now want to go to india.
-
Did you look online at your local Indian Consulate? They will have the application online and other requirements. You could also make a phone call on Monday to ask directly.
What you really should do is apply for an Overseas Citizenship of India (OCI) card, then you can leave to India whenever you want and stay as long as you want, no visa required.
but applications for OCI are accepted from residents of the following States and Territories: New York, New Hampshire, New Jersey, Maine, Connecticut, Massachusetts, Ohio, Pennsylvania, Puerto Rico, Rhode Island, Vermont and the Virgin Islands. and i live in CA.

if you have an indian passport why can't you just USE your indian passport? Why do you need a visa? I don't understand...
but i lost my indian passport.which i must show in visa office to have indian visa for first time on US passport, acc. to rules of indian embassy.
-
Actually if you have your US Passport you mail it to the indian consulate in San Francisco and I got my 10 year visa on my passport in about 2 weeks or so. I think it was sooner then that, but it was a long time ago.
Star
but i raed in instructions that if i am applying for indian visa for first time on US passport i must show my indian passport.
-
DO YOU HAVE USA Passport?
yes i have
yes i havebut i have read that i must show my indian passport if i am applying for indian visa first time on US passport

i am a canadian permanent resident and married to US citizen in canada in 2008.I was a student at that time in USA.Now i am back in canada and looking for a job as dentist and no income for timebeing.I want to apply for my wife and my twins(US citizens) for canada. But i dont have any income right now.can i still apply for them because i am not fulfiling the requirements(finacially) as the sponser.moreover nobody is here who can become my co-sponser.
So you're applying for Canadian immigration, correct? For CIC, you do not need income, you just need to prove the ABILITY to earn income.
so is there any form or application to fill for ability to earn income.
What we did is was have my husband's employer sign a letter staying his income and how long he had been working there.
Since you don't have any income at the moment, I would suggest sending a copy of your DDM, a few copies of your resume and associated cover letter/email, and maybe 3 or so years of tax returns plus ROE/T4 to show that you are capable of earning income.
What is DDM.
I meant DMD, sorry.
I dont know DMD even
r u talking about my dental degree
