hello VJers i don't know if this is the right forum to post this but i really need your advice, this is not about me but about a friend that really need help and advice now, here's the story, my friend is under IR1, last week of last month we were so excited in our group talking and so excited about her flight, she supposed to fly going to US last june 5th, her husband was telling her he's going to send her money so that she have enough for her flight, they were both so excited her husband told her he's going to carry her at the airport and will spend the rest of his life with her and grow old with her, BUT a week before her flight her husband suddenly died, her world turned upside down she didn't know what to do and still don't know what to do now, i felt the pain she felt she wanted to hug her husband but can't, after 2 days she flew to US instead of june 5th so that she can see her husband, but it took few more days before she seen her husband, the question is i know she will be getting 10 years GC under IR1 visa, but her visa will expire on August 19th, now that her husband is dead she don't know how to get her GC, is it automatic delivered to her after few weeks or in definite time? or is there another process before she gets her GC? what if her visa expires and she didn't get her GC yet what will happen to her? she really don't know what to do and her mind is really messed up plus she really don't know anyone there in US, plus she can't get online because there's no internet on where she is now, only a common friend of us is telling me about her situation, i don't know what to answer to her question that is why i posted here, please i am so worried about her and i know she don't know how to face life now alone

Sorry to hear that sis...That is very sad.... Even her visa will expire on August 19, still her visa is good for 1 year prior to Port of Entry. That's what the Immigration Officer at the airport told me. Her GC and SSN will arrive at his hubby's address(more or less 1 month) Nothing to worry sis as she don't have anymore paper works to do or to process as long all entries at her GC at SSN are correct. I choose my husband to be my agent for DS-3032 form.. Now my question is.....is it okay if I will be the one ( the beneficiary ) to send the DS-230 IV packet to NVC, instead of sending the documents components for IV packet to my husband then my husband will forward it to NVC? any idea pls vj memebers....Thanks
Yes, you can send your DS-230 Packet to the NVC... But make sure that your husband send his AOS Packet First....

any fees needed to be paid before interview @ USEM? from what I understand we have already paid for it during the NVC stage which is the IV bill am I correct? please enlighten me on these thanks mucho!
You're all set sis after paying everything at the NVC stage. No more payments at USEM or anywhere...

Count me in...NO need a lawyer. If you don't have major problems with your documents. VJ is very helpful.. I am CR1 too..Everything went well. You are right, he will be a PR when he arrives her. Got my GC, 21 days after I arrived and received my SSN 8 days after I arrived.
Our Visa category was CR1 when we submit the petition but when my visa issued we reached our 2 years wedding anniversary so my visa category was automatically became IR-1 and had my 10 yr GC.
CR1 is less than 2 yrs married.
IR-1 is more than 2 yrs married.

The packages are not reviewed together and do not stay together during review. That's why the cover sheet address is to a different department in each cover sheet. If you want to send at the same time, place in separate envelopes and mail to the two separate addresses.
I agree with you that they will go to different department for review.
But we didn't mail it with separate addresses. We had 2 folders ( DS-230 packet and AOS Packet) put in one envelope and mail it to NVC at New Hampshire and everything went well.

all i have is marriage certificate from Mexico
and pictures. i have phone records from text messages
but not from call logs as we use Nextel to talk because
its so much cheaper

What you had now is good...you can add receipts of restaurant, gas (only my idea)...
we don't have call logs either...TRy to give them photos of both of you with her or his family and friends...

what if i did not send any Evidence of a Bonifide Marriage with my I-130 to USCIS??
would that be a problem? or will i get a RFE?
my case is currently in Initial Review at uscis csc
i am already married and filed for a CR-1 Visa
RFE is very possible ( just pray and hope that no RFE)...because evidence of a bona fide marriage is a must for the petition but you can always send them the documents that they needed, of course it is another delay.

We sent both packet together..So, they can review them together and nothing will be misplace.
I am sure you can send your DS-230 first if that's what on your hand but you will receive an email from NVC requesting for the AOS Packet...
Yes, you can include a cover letter according to the content of your packet and you don't need to staple them.

Can I go on with the CFO seminar even if my visa hasn't been delivered yet? I'm just worried that they might not be able to hold seminars for the upcoming holiday season. I wonder if I can go attend the seminar and just go back for the sticker once I have my passport with the visa already.
Yes, you can attend the CFO seminar without the Visa yet. just bring the documents needed.

I took an advance medical because I am worried for my X-ray and if I will undergo a sputum test it will another months of waiting and delay. Good thing, I passed the medical. So, I took my medical after I received my case number. Medical is good for 6 months. I will be having my interview on January, that's 3 months after my medical.

We got the NOA2 already..My fiance told me to go for the medical examination even if I havent receive the letter from the Embassy..Is it ok? Will I be permitted to have the medical? Please answer if you have the same experience. Thank you.God bless.
Yes, you can. Just bring a copy of your case number along with required docs like passport, 2x2 picture and payment.

i just want to ask if how long did you wait for the NVC to mail you ur interview date..plsss...i sent my DS230 part1 and 2 already nov.19,2011..i just want to know how long shud i wait..thanks in advance:)
in our case we submitted the docs both AOS and DS230 last Nov.14 (overnight). We received an email from them on Nov.21, asking my husband to send a new I-864 form because we filled out something unnecessary..We sent the form back the next day, Nov. 22....
Our case completed on Nov. 25 and we received an email of appointment on Nov 29.
You will get yours soon.

I am not K1 but I read a timeline of someone who just met online for few months (less thans 6 months). The guy visited her for couple days and when he back to the States, he filed the I-129f. They have the fastest timeline I've ever seen. From meeting online to visa issuance is only almost 12 months with their case.
So, I guess you will be fine. Just show send them any docs, pictures of you had together. Latest pics might be very helpful.

My wife needs a bank draft made out to the Government of Hong Kong S.A.R. payable in Hong Kong Dollars. The bank of Hong Kong only issues bank checks to account holders. Our bank in Philippines BDO told us they do not issue these kinds of checks in another currency.
How can we pay Hong Kong government for my wife's police clearance? What a pain in the butt this has been. We wasted my last day in Manila trying to find a way.

If she have friends in HK she can ask them to pay the PC clearance on her behalf. Regarding bank draft try BPI.

We never called USCIS. We got approved within 90 days including saturdays and Sundays.....
I even not think about it after we submitted it because I marked 5 months so we will not be stressful of waiting. But surprisingly it was earlier than we expected.

Thanks guys! What other payments are charges for the applying for all of it? I know you pay $420 for the I-130 filing fee. Any other more payments or costs?

MEdical Fee @ St. Lukes - P9,387.50 pesos (Depends on the Exchange Rate of USD)

Yes, the man you talked is right....I-130 takes 3 to 5 months to be approved (In our case, it's 90 days - CSC). Then, after approval they will forward it to the NVC which is usually takes 1 month to get your case number. After you will get your case number you will submit your Affidavit of support packet and he will submit the DS230 packet. If there is no problem with your documents, your case will be complete 7 to 10 days after you completed the documents. Then, NVC will schedule you an interview which usually takes place 1 or less than a month after your case is completed (It depends on the consulate too, if there are more slots open for interview.)

Hi Paul,
Send her in Iloilo and I will meet here and start gathering her documents. I am close to the Port where the boat from Guimaras dock. I can pick her up there, if she wants too. I am renting a small room here in the city which is $3 dollars per day, I guess it is isn't bad for her to stay here as well while we will be doing the paper work or she can stay in our house for a while. The reason I didn't stay in our house because its noisy there.
. And my husband wanted me to rent a room to be a in a quiet place while preparing for my visa, that's why I am here.

I live in Iloilo City and I live very close from NSO ( walking distance) where she can get her birth certificate as well as from DFA where she can apply for a passport, 1 jeepney ride from NBI. If you want too, I can help her in acquiring those civil documents.

Hi, Its not that hard to get a Philippine Passport as long as you have the documents required. She needs to go there personally as her picture will be taken electronically.

Hi,
Honestly, I don't have any idea about NOA Touched. All I know is 3 to 5 days after you sent your Petition Packet you will receive an email of Receipt from USCIS as well they will sent the Hard Copy of NOA1 to your Hubby's address. I agree with other VJ'ers . Once you will get your NOA1, register it at the USCIS Website to track Case..
