  1. When you consulted the lawyer? if that last year, she/he is right... Previous years, K3 is faster than CR1. But I read on their website that they make changes with CR1 process and it started this year. I-130 approval on previous years takes how many months before it will approve. But this year we noticed it only takes 3 to 5 months,except on complex cases. So, stick with CR1 and you will be fine. They have the K3 before because I-129f is faster to be approve(That was on previous years not now). But now, I-130 and I-129f having almost the same period of time of approval, so K3 is useless.

    You ask how many months after I-130 your wife will get a visa? If your documents are ready and complete (affidavit of support, civil documents,etc ) its about 7 to 10 months. In our case, supposedly its only 7 months but we lack one more document to be submitted at the NVC, so I don't an interview schedule yet.

    It is okey to submit a photocopy of your marriage certificate, birth certificate, copy of passport, etc....But your both Biographic Sheet (you and your spouse) must be and have an original signature as well as the I-130 form itself.

    I'm getting confused about the process of my spouse K3 visa, i have submitted I-130 as instructed by visajourney 2 mths ago CSC and they sent to me the i-797C,

    what to do next and can i send I-129 now ?

    Hi, I am a wife of a US citizen but we did the CR1. You said you submitted the I-130 and you received the i-797C. It means that the USCIS received your application (petition packet) and its under process. As what I observed this year CR1 works well and you don't need to submit the I-129 form. You will received another Notice of Action from USCIS 3 to 5 moths after the day you received that i-797C (NOA1).

  4. My husband wants to hire a laywer and even paid him $500. That's for consultation fee I guess and he didn't even advice us which one is better...K3 or Cr1...He just gave us a quoted price for the service fee and visa fee of K3 and CR1. But I insisted not to continue and will do it ourselves. So, we filed the petition without a lawyer's help only VJ and some research. Thanks God, approved within 90 days WITH NO RFE.....

    Sorry I misunderstood it.

    Next Step is wait for the USCIS approval (NOA2) it takes 3 - 5 months. In our case, it was 90 Days ( California Service Center).

    And If the petition is approve they will send you a Notice of Action II ( NOA2) , and your documents will be forwarded to NVC.

    Sorry to hear that. As what other VJ's said, try mo ulit kausapin hubby mo..Not sure if oks to, try mo kol USCIS if may file kayo doon. Matagal na yung Feb na filling. April kami nag file, CR1 din, pero nasa NVC na docs namin.If honest husband xa, dapat alam mo every detail lalo na sa processing ng papers nyo. naghingi ba xa sayo ng mga civil docs mo like BC, MC nyo, ID picture mo, etc.? If talagang nagfile xa, you can check your status at USCIS website, basta alam mo rin yung Receipt number mo.....We will pray for you ...Sana maging okay ang lahat. God bless.

  8. You should start gathering documents such as

    DS-230 part one sign by beneficiary. Part 2 not need to sign

    1-copy of passport

    2-pictures (2) (passport type)

    3-Birth certificate (original & copy) translated ,notarized (beneficiary)

    4-marriage certificate (original & copy) translated, notarized

    5-termination of previous marriage (if any)

    6-proof of relationship

    7-police reports

    8-deportation(if any)

    9-prision records (if any)

    10- military records (if any)

  9. All I can say is go to a marriage counselor and fix your marriage since you have a child. Nothing will happen to every relationship if always relying on divorce, divorce, divorce. Nothing will happen to both of you if after fighting , arguing, blah, blah, blah and problem in marriage is to give up and think about divorce. There's no issue that can't be resolve. You need to talk to your wife deeply and sincerely if you truly love each other. I admit that I have some issues as well brought by my childhood experiences. But my life is an open book to my husband so he will understand me and will not ride on my tantrums and issues. Like he leaves me for a while and gives me a break if I turn crazy...And everything will be fine afterwards...But we talk about it - our weaknesses and strength so we will know where we stand every time it will happen. ..But cleaning the house is not my issue at all..as it is a mere responsible of a wife....Why not give another chance for both of you for the sake of your child? Talk about it and prove to her that you love her and nothing to jealous about. I hope you will be fine and will not ending with a divorce...If you will divorce her, and remarry again..what if you will marry again an another woman that has another issue? Divorce again? Sounds not good. Work on it..its part of your marriage life. Time to go for the next level to the maturity of your marriage.

  10. I just basically downloaded the forms, edited and printed it. Meaning the answers in the field AREN'T HIS HANDWRITTEN. Is that a problem? We will have the same answer anyway.

    You will be fine sis. I am 23 years younger than my hubby and I did prepare all the paper works as well because my hubby is busy and not much into documentation ( And I even the one doing his paper works, paying his bills online, renew his DL, car etc even I am still here in the Philippines) and I guess there is no problem with that as you both working together and doing the easy way. I even prepared all the proof with pictures and labeled them ( handwritten) and also our short story ( its not necessary though).

    Additional: Some of the info in our Biographic sheets is my handwritten too. :)

    Praise God we approved at USCIS with no RFE or red flag...You can do it sis...Everything will be fine. Just follow the steps and submit more proofs of your relationship. ( age doesn't matter as long as you love each other).

  11. Finally got my RFE and says they want pics with dates, receipts, and ticket stubs or stamp passport. I had previously sent ticket stubs on which some you can't really see dates cause they are from 2009. I sent pics of us together as well, but they don't have dates. Do they need to have dates? The only thing I had not previously sent was copy of my passport stamped and receipts. When they say receipts, do they mean any sort from when I was in the UK visiting my fiance? If anyone can help me on this one I really appreciate. :) Thanks!

    I prepared our petition packet. My husband came and visit me last 2009 as well and we filed on April this year. Our pictures have no dates but I labeled them by putting dates, name of place and what we did ( Civil wedding, church ceremony, eating, honeymoon, with my family, etc.) I even put a short story of how we met and what we've been through ( its not necessary though but in case it will be helpful). I put the 1 page story as a the title page of our pictures.

    Yes, please do send the copy of receipts (hotel and restaurant receipts), passport stamps and tickets. ( if you purchased ticket online,maybe you can print again the ticket that airlines sent to you - only a suggestion)

    I will get my Police Clearance in Hong Kong as well after I will receive my Manila Case #. My suggestion is, email the HK Police and ask them when they sent the Clearance to US Embassy. The HK Police reply to each inquiry asap. Then, if they will reply forward the email to the US Embassy and ask for their receipt confirmation. God bless.

  14. Today, I received a text from USCIS, and telling me my case was updated. I was kind of nervous because what if I got denied but when I put my case # and it said IT WAS APPROVED. I was shocked so i scream YES at my work place and all the people were looking at me I'm a weirdo. I called my fiancee she picked up the phone and I told her good news. She told me she was on her way home from church because they had a prayer meeting to those who had a problem. She told me God gave her an answer while she was praying that the case will be approved but she didn't know it will be today. She was happy and I can hear her voice that she was crying. I might have little doubt that God might not answer any of my prayer but God once again proved me WRONG. I have learned my lesson that God does hear you but He just picking the right time for you. Anyone of you whose out there are waiting PATIENCE is the KEY and God does hear your prayer.

    Thank you for approving our case, and teaching me how to be patience. I pray that you will give me a strength to take care of my fiancee or soon to be my wife. I pray that You'll lead us the way you want us to be. I also pray for those who are still waiting for their approval. Please give them peace. Once again Thank You LORD for approving OUR CASE.

    Congratulations to both. Yes, God does answers the prayers of His people. Pray that our petition will be approve next..hehe. God bless.
