    It seems we will follow the CR1 path now.

    I sent the I-129f form to my husband 2 weeks ago. He didn't get them yet (he is serving in Iraq so I print all the form for him, it's easier).

    Meanwhile, my husband told me he got a document from a visa service center talking about an Affidavit of Support and a fee of $70, non payable by check. Does that mean our I-130 has been approved and we can abandon the K3 visa process?

    If that is the case, what to expect? What is the next step?

    Why do you think this visa is better than the k3?

  2. If all he has received is the NOA1 then it is still at USCIS.

    Once approved and sent to the NVC then the billing for AOS will be sent out.

    The USCIS will accept personal checks but the NVC will not.

    Money Orders or certified bank checks must be purchased to pay NVC.

    NVC is the State Department and they have different requirements of payment.

    As you can see from my signature, we sent and got the NOA1 for the I-130. We didn't send the I-129f yet.

    Anyways, my husband tells me he got an affidavit of support form and he has to pay $70, but it is not possible by check.

    It sounds shaddy to me, but he tells me it's a letter from the Immigration services.

    What is it? I never heard of that.

    It appears that what you got on 3/13 was not NOA1, but the NOA2 approval notice. The case would now be at NVC and indeed you will have a $70 bill and soon a $380 bill. Your foreign spouse is receiving this because you didn't set yourself up as the agent of choice. He can send the forms back through you, so you can add the money orders or certified checks.

    You might as well change your profile to reflect the facts. You are not a K3 filer. You've petitioned for CR1 only at this point. I wouldn't bother filing the I-129F now because it would have little chance of catching up with an already approved CR1 petition.

    Ok, my husband, the US citizen received it. So that would mean we are going through the CR1 visa?

    Mmmm, I'll have to check that one.

  3. They will send you a notice of action in the mail which is a notice that they received the petition. You need to make a copy of that to include with our I-129F application. They won't process the I-129F without it since they need proof that you have a pending I-130.

    Hopefully you will get it soon.

  4. Hi I am the Frenchie of the couple too.

    My husband is currently in Iraq for an 18 month tour. It's hard sometimes but we both work and save most of our paycheck so that we can work on hour house in Minnesota and not be too stressed before I find a job.

    I am very happy to see lots of couples from France! One actually live in the same city as me! it's a small world.

    My husband is in Iraq until May 2007 (he could be extented until August 2007, you never know with the US Army).

    Should we start the K3 process now or should I wait 2 more months? If I get the visa, how long is it valid? i mean, how many days/month do i have to enter the US once I have the visa in my hands?

  6. I was suprised to see IMBRA RFE everywhere as I had never heard about it (I joined this website back in 2004, I come every now and then).

    I did some researches and it seems to be for mail order brides.

    My husband and I met "naturally". No agency or anyone involved. I guess the IMBRA RFE is not for us. But I see a lot of people talking about it and needing it.

    - is it because I misunderstood?

    - OR does that mean most people here met through agencies?
