    Thank you :) Here is the sentence from the USCIS site that has gotten me all confused:

    "In addition, applicants are required to show they have resided for at least three months immediately preceding the filing of Form N-400 in the USCIS district or state where the applicant claims to have residency (See 8 CFR §316.2(a)(5) & §319.1(a)(5))."

    Again, do I have to show that he has been physically present those 3 months (passport stamps I guess) or that he has just been a resident of the state/district (apartment lease, utility bills, etc)

    I guess if I know what type of evidence they need to see then it would give me a better idea. Thanks for the clarification...

  2. Here is one additional question....

    About by 90 day question, does it mean he has to be physically present in the us before he applies or that he needs to just have maintained his residency? Because if that is the case, if he was not here, but our apartment lease is still in his name, bank accounts, credit cards, utility bills, etc. Would those things be sufficient evidence?     I hope all is well and I sincerely wish that all of your cases proceed well and without delay :)

    I have a question, I have been searching around reading the boards to make sure that everything goes well when I apply for my husband's citizenship in a few months. I ran across a few things, hopefully you all can help clarify for me.

    1. My husband came to the US almost 3 years on a fiance visa. He entered the US in Sept 2009 and got his conditional permanent resident card in Feb 2010. Feb 2013 is when he will have been a PR for 3 years so 90 before that is when we can apply for his citizenship, correct? 90 days from his PR date, not from the date that he came to US, I believe.

    2. My next question would be about residency. For his 3 yr residency requirement he needs to have been in the US for at lease 18 months in the past 3 years (he has had to travel a back home a few times to take care of his family but has been in the US for more than 23 months and has never been out of the US for 6 months or more at a time). I am not so worried about that part, but I saw something on the USCIS website that says you need to show that you were in the US for the 3 months before you file your n-400 application. Is that true? My husband is out of the county and it is still about 3-4 months before he can apply so I want to make sure if this is a req or not. If it is, how would we prove it? would they just look at his passport?

  4. Hello Everyone,

    My husband currently holds a conditional permanent residence card. He has plans to go back to Iran soon, and plans on being gone just a couple months. If for some reason he has to stay longer how would that affect when he can apply for citizenship.

    My first question:

    From what I understand his permanent residence status would be ok as long as he was not out of the country for a year (or is it 6 months?) I would remain in the US and we would have constant communication, he has bank accounts/credit cards that would still be active so I think that would show that he has not abandoned his status. Is this true? Is 6 months the limit or less than 1 year?

    2nd:

    If my husband is out of the country for more than 6 months does that affect his eligibility to apply for citizenship? I mean, would he have to wait longer or would his 3 years (he came as my fiance so from the date of his 1st green card he could apply after 3 years) start over? This is the part that I am more concerned over. Thank you all for any info that you might have and I hope that all of your cases are going quickly and successfully.

    I hope all of your cases are progressing swiftly and successfully. My mother in law just arrived in the United States a couple of days ago. Her daughter is a US citizen and applied for her green card to come to the united states. When she was at the POE they took pictures of her and her fingerprints. What I wanted to ask was, is that all she needed to do for her green card? Will it just come to her in the mail? I know when I brought my husband here with a fiance visa we had to apply for his AOS to get his green card, but I dont think we need to do this with her since she technically wasnt applying for a visa. Does anyone know for sure? Thank you so much!

    I hope everyone's cases are going good and fast!!

    I have a question about my mother in law, she recently went to Abu Dhabi and received her visa to come to the US. Does anyone know how much time she has to enter the US from Iran before her visa expires? I know my husband had about 3 or 4 months to enter with his k1 visa. Her visa is not a tourist visa, but to come and then get her green card. Does anyone know how much time she has?? Thanks!

Yeah, we had been paying online before but the site was down for a couple days, so we opted to just send the check rather than waiting to see when the site would be back up. I called the NVC today and they said only send what we asked for so I guess I'll wait for the IV bill to clear and then do that.

    Does anyone know.....they give the interview after this step, correct?

    Yer not using the online payment portal for anything, right?

    you're 'waiting' on NVC to tell you, the next step, each time, right?

    re: the RFE - you're to 'answer' the RFE, give them the info they've described, and no more. Of course, if you think you've mucked about, made a grievous error with the I-864 - then MAYBE you should consider making a NEW I-864 with supporting documentation, and send that back with the RFE coversheet (make a copy of that, for yer files btw)

    re: ds-230 - since yer doing 'paper processing' - sure - you can send in the check with the ds-230 package - no worries there. This is how it 'used to be done' - and NVC still handles 'that postal processing'.

  8. There was one part of the I864 that was incomplete, I think we were supposed to have written n/a if we didnt have an answer, not leave the field blank. Also, I have one additional document about my income that i need to send. So I can just send the missing parts rather than sending a whole new affidavit?

    I also have received an email requesting a $400 fee, this should mean we are towards the end of the process right?

    Once we send that fee and they have all of their documents do you know how long it should take them to give us an appointment?

  9. Hello! I have an important question regarding a application to bring the mother of a US citizen from Iran.

    We have already sent the main application along with the fees, we then were asked for the I894 affidavit of support. We also sent that and then a couple weeks later we received a letter with a checklist of some things that they said were missing frm the affidavit of support.

    I can get the missing info, but my question is do i just send them the missing info or do i need to submit a whole new affidavit of support?? If anyone can help me I would greatly appreciate it. I would hate to do it wrong and delay her case even further.

    Also, once they receive that info along with the DS230, which they also requested, does anyone know after that how long it takes for them to schedule the interview?

    For the green card process, of bringing the mother of a US citizen from Iran, does anyone know what step comes next after the Affidavit of Support is sent back and approved? Do they request other information afterwards, should we start gathering things like passport pics, her shenasnameh (birth certificate) from Iran? I wanted to know what comes next so we can be ready and help things move faster. Thank you so much!!!!!!!

    I am trying to get some info about the I864 AOS for the parent of a US citizen. I know that if the sponsor's income is not enough they can use a member of their household or a joint sponsor to meet the requirements.

    If the sponsor's husband's income is enough, would he need to fill out an entirely separate I864 or would he just be listed on the sponsors AOS form as a household member with sufficient income?

    So I guess my question is do they need to fill out 2 separate forms?

  12. Thank you sooo much for all of your responses!! I will most definitely be there with him for support. During the interview, are all of the questions directed at him, am I just there for support or will they ask me any questions??

    Also, I dont know if the guidelines for the Ankara embassy have changed recently, but they had us sent his original birth certificate to them with the last packet of paperwork. They also have a copy of it as well as the original english translation of it. I was just wondering, after the interview they will give us back his original birth certificate right?? Seeing as it is a vital document that he will probably need when he is in the united states. Does anyone know if they will give us back his original english translation either?

    my fiance and I are anxiously awaiting our interview date next month and want to make sure that we are ready.

    I have a question about his language....

    He is Iranian, so he speaks and is obviously more comfortable speaking Farsi. He is learning English and is able to speak English well with me, but he feels like he would be too nervous to speak English at the interview.

    we dont have any problems communicating with each other since I also can speak Farsi, but I want to see if anyone knows if he is allowed to speak farsi at his interview and if it could possible effect his visa negatively....

    Also.....What questions (from your experiences) have they asked you at the interview?? Are they more about you and your fiance's relationship, or what you want to do in the US/$/etc.

    My fiance and I have finally gotten our appt date after waiting nearly a year! I filed his K1 visa to bring him from Iran. We have our appointment in Ankara, Turkey.

    I was wondering if anyone knows if the embassy does any kind of background checking or processing on his case during these 4 months while we are waiting for our appointment for his visa. I was hoping that if they do some processing now and if all goes well, then he may get his visa a few days later instead of being put in AP and being forced to go back to Iran to wait for God knows how long. Any info that anyone may have would be much appreciated!!

  15. Hello everyone!!

    I am currently in the process of bringing my fiance to the US with a K1 visa, but am also helping my future sister in law file a petition to bring her mother to live in the United States.

    I am helping her fill out the I-130 form and I had just a couple questions about it, both almost the same question.....

    -question #8: on the form asks for the date and place of present marriage if married. If she is widowed would we just answer n/a or would we put the date that she married her husband even though he is deceased?

    -question#17: it asks to list the husband/wife and all children as well as their birth dates. Again, does this mean all children? two are deceased and 3 are still living. Would we need to list all of them or only the ones that are alive? Her husband is also deceased, so would we need to list him or not?

    Thanks so much for any information that anyone may have, we just want to make sure that everything is filled out correctly the first time so we dont have any problems or delays later!! Thank you so much, and good luck to all of you who are waiting for your loved ones, hoprfully we will all be with those that we love very soon!

  16. From what Ive heard its more like 6 months for the police certificate. I think youre ok, but you can call the embassy to be sure and have some piece of mind

    1 or 2 months?! Are you kidding? Then does that mean the one I have isn't valid either? We got ours a couple weeks ago, but by the time May 19th rolls around, it'll have been roughly 2 months. Gr.

    I applying for my fiance in Iran at the Ankara, Turkey embassy. I have always heard in the past that once the embassy receives the packet they will usually inform you of your interview date about 6-8 weeks in advance. I know someone who is also applying through Ankara for their Iranian fiance and they have just received their interview date, but it is in 4 months! I have checked the website's interview schedule and all of the dates before then are not filled yet.

    Does anyone know if this normal or not? Should I expect the same thing??

    I know that first come is not always first served, at least when it comes to USCIS. We both applied at the same time and she got her NOA2 2 months before me. Does anyone know if the same thing can happen with the embassy? Like if they give out random interview dates or if they do everything in chronological order.

    Can anyone speak from experience?

  18. Wow, seventeen months! What did you do for that long, how did you survive it??

    If we get stuck in AP it is my plan to go to Iran to wait with him, but since I am a non-Iranian US citizen it does make it a little tougher...I have been there before, I'm sure he could get me another visa, but I doubt I could extend it for 18 months!!

    I know I have the official translation of his birth certificate and the copy of his shenasnameh that we sent originally so hopefully that will be enough.

    How long ago did you apply for your husband?

    It has been 8 months right now dealing with USCIS and we've finally made it to the embassy stage. His name is not all that common and we are both going to the interview together, I pray that God will help us somehow and let him come back with me!!

  19. I'm so happy to find someone else bringing their fiance from Iran! Are you as stressed out as I am right now? I even have a lawyer and I am so stressed and overwhelmed and worried about making a mistake! :(

    I definitely know what you mean about being more worried about the forms than AP!

    I got the same email from the embassy about what forms to fill out, the only thing is they are not the same forms that my lawyer is having me and my fiance sign. She emailed him a DS 156 to sign and I don't believe there was one in that email. Its little things like that that are making me so stressed out and confused!

    Another thing, do you know what exactly we are supposed to send to the embassy and what we just need to bring to the interview? I know one of the links had a checklist but I feel like everything I read is contradicted somewhere else!

    2 passport pics- do we mail these or bring them to the interview

    birth certificate (shenasnameh)- do they need the original Farsi version as well, and do we mail it or bring it to the interview

    passport-copy of everypage?

    Sorry about all the questions....you know how it gets when you've been waiting for soooo long and you finally see the end in sight. I just want to do it right and get him here!!!

  20. Hello everyone! I am relatively new to these boards am I am so happy that I found them, sooner rather than later-my fiance's application has recently arrived in Ankara. We applied in Aug '08 and it has been over 8 mos since I've seen my love! :(

    My biggest fear right now is that dreaded "Administrative Processing"

    I have read that all Iranian applicants have to go through it and it takes at least 3 months, but does anyone have any experience? I hope that they would go by the merits of our case, and not because he is Iranian.

    He doesn't have a really common name that would put him on a watch list and we have a lot of pics and evidence to prove we are legitamate. Does anyone know if there is still a chance that we could make it out of there with his visa, or are we already doomed to have to wait yet again? I'm hoping that with all of our paperwork and a successful interview that it will be enough.....Inshallah

    Yeah, I heard about the administration visiting Turkey, what wonderful timing!! ;)

    I don't believe that my fiance has a name would would put him on any "watch lists" and I definitely have waaaaay too much documentation to prove our relationship (phone bills, pictures from 3 different trips to see him) so if it was going by individual cases then I would feel a little more confident, but if they go by the sole fact that he is Iranian, then I am very discouraged!

    Normally, police certificates are not required from Iran, but I wonder if he was able to get one if that could speed up the process or perhaps prevent AP altogether. any ideas?? Sorry, Im so nervous!

  22. Wow, I am really starting to panic here....

    I am a USC filing on behalf of my Iranian fiance. We finally received our NOA2 after 8 months of waiting and now our papers are in Ankara, Turkey. I am beginning to prepare all of our documents to send and I came across some frightening information.

    It was my understanding that the horrible process of Administrative Processing is conducted if they have any doubt during the paperwork, interview, or if the beneficiary's name has a hit in the database. Now it is saying that extensive administrative processing is required for all Iranian applicants and takes at least 12 weeks.

    Can anyone say from personal experience whether this is the case or not?? I have talked to one woman who brought her fiance from Iran via Turkey and he was given his visa a few working days after the interview.

    I dont know if the website is just saying that it happens for every Iranian applicant or if it is just a general statement.

    I pray to God that this is not the case, I have been waiting to be with my fiance for over 8 mos now since we filed, I couldn't bear to tell him that he will have to wait at least another 3 to come here!

    Thanks for any info that you can give me!
