  1. Hi. I have some general questions on the AOS forms:

    1) The signature in my passport is in Russian signed by me when Iwas 15, when I got to the US, my relative told me it looked weird and didn't make sence so he adviced I should change it. So, I started signing everything using English letters(including the marriage certificate). So, is it ok if I have a signature on AOS forms, if it's different from the signature in my passport?

    2) About passport-style photos: should I put them in littel baggies?I read on here that's what most of people do, but I couldn't find those baggies anywhere. Where can I get those or what could I substitute those with? Would I need to have 4 of them: for I-130 (2), I-485, I-765 or just 2 bags. How should I attach them to the forms(should I use a separate sheet of paper for each baggy, or just attach those to forms)? Also, shouldI use papaerclips or staples? The same question I have about checks.

    3) Our marriage is gonna be recorded in a few weeks at the City Clerk, so can I go ahead and just send a photocopy of the original marriage certificate that we have on hand with our AOS petition instead of waiting to get a certified copy from the City Clerk?

  2. Hi. I had a question about the birth certificate. I know I need to sumbit a photocopy of the original birth certificate, but what about the translated version? I got my birth certificate translated back home by a certified translator and got it notarized by notary puband signatures on itlic(back home). It has seals and signatures on it. I'm not sure whether I need to submit tha actual translation or a copy of it? My husband said I might need the original translation for other things(like when I get a doctor etc), and I would prefer not to have to translate and notarize the birth certificate again :) So, my question is:

    Would it be fine to submit a PHOTOCOPY of the translated and certified birth certificate COPY?

  3. When I came to the US, no one stapled I-94 into my passport, so I thought it was just a trash and threw it away. When I found it it was valuable, I also realized you have to replace it which costed me $320.

    The replacement form is at uscis.gov- fill it out, add a check and send it.

  4. I just got married, and preparing stuff for AOS. What should I do about opening a bank account together? I have my own account at Bank of America (registered for me as a non-resident alien)and my husband has an account at a different bank- Desert Schools. I was just wondering whether I should add him to my account, or he should add me to his? Or scould we just open a new account? What did you do and what are the advantantages of doing it?Also, what bank is better in your opinion: Wells Fargo or Bank of America? Thank you guys.

  6. 1) No answer to this question, since I'm not in CA.

    2) Send the package to U.S. Citizenship and Immigration Services P.O. Box 805887 Chicago, IL 60680-4107. For express deliveries:USCIS Attn: FBAS 131 South Dearborn - 3rd Floor Chicago, IL 60603-5517.

    3) I-864- you need copies of your spouse's tax return and W2 for the past year (2 more previous years is optional), employer letter and/or pay stubs for the last 6 months. Bank statement is oly neccesary if the income is isufficient.

    4) I'm not sure, but I would think if only one parent is a household member on forms, you do'n have to include the other one as a dependent (unless he is a dependent on your spouse's taxes.

    5)2008 is fine. As mentioned above, 3 previos years' tax returns are optional, but thelast year is required.

    6)I-864 is for your spouse, main sponsor. A form for household member is I-864A Contract between Sponsor and Household Member(needs to be notarized).

    7) I'm not sure about this one, but I tend to say 6a.

    8)Number 17 on 765 you will leave blank because it is N/A to you (it's for people of category c3C).

  7. The fact that you are married is not gonna change anything until you apply for AOS. I've flown inside the U.S. 5 times since I came here on F-1 visa, and they never look at your visa at the airport-they always look at your biographical page. My visa expired in January but my I-94 is valid for duration of status, so visa in the passport is not always the most important document to have. I think you should be fine evenwith expired visa.   8. Which passport are you talking about? In my case, I have 2 paasports:

    one is in my native language which is used as an id back home

    the other one is my international passport, which is used abroad and where visas are stamped.oreign languageThis one is written in English.

    If your passport is in a foregn language, i needs to be translated for sure (just like every other document in a foreign language). Good luck!

I jost got married yesterday and when signing the marriage certificate, I made a small error (I was kind of dazed by the ceremony and the judge's speech and started writing my last name as I used to do back home in Russia). I tried correctng it and now it looks a bit sloppy. Will immigration officials care about it when I submit a copy of it in the AOS package? Of course, my printed name on the certificate is correct. Is it important that the signature on the applications and the marriage certificate are exactly the same, or looking relatively close is fine? Also, when submitting the paperwork, do we need to include a regular copy of our marriage certificate,or a certified copy from the court? Thank you.

  10. Nuh... You either have to live with her and her roomate or get a place of your own while she is going to school or wait till spring for you to arrive in the U.S. Either way, if you are only starting your K1 process soon, it will take at least 3-4 months up to 9 months (rarely) to process. In USCIS perspective, you must be living together and having sex :)

  12. Hey! NO ATTORNEY!!!NO EXTRA MONEY SPENDING! You are in an ok situation, if I'm not mistaken you can overstay your visa up to 3 months bfore you apply for AOS. Start filing the paperwork right now!Even if you are late and send it after June 28th,there shouldn't be a problem. As far as the deportation, I'm pretty sure your situation would look legit to the government. If you have a proof of you being here as a student and a visitor and the relationship and correspondence with youer future husband, that's what you need to have just in case. You could make copies of your previous visas in your passport and phoe bills showing your correspondence along with pictures of you at different times. However, it is not very nessesary. Many people come here for as much as 2 MONTHS and manage to find someone, get married, and apply for AOS the following day and get approved. Believe me, your situation is much better, you have already been married for a month!:) Just gather some pictures of you, your wedding, open a bank account together, and, for instance, register for the lease together or health insurance and send the proof of this in your AOS packet. You don't have to do all of these things right now, but one of them is required (pictures of you are just optional though).I think you should be fine!Good luck!!!

  13. Yeah, there is always a chance that your visa would get denied and they don't usually explain the reason. However, there are many nuances which would effect their decision. If you really want to go visit home this summer, look at these aspects:

    -When was the last time you entered the country and how long was your visa issued for.Usually they issue a visa for a year,and you are abe to travel abroad within this year Your I-94, though (the white card given to you during the flight) normally is issued for "the duration os status". It means you can stay in the U.S. as long as you go to school for no longer than 5 years. However, if you leave the country, you have to apply for F-1 visa again at your home country and you need to provide same documentation as you did the first time. Usually you can request a letter from school stating that you are enrolled in school for the next semester, that would increase your chances of getting a visa.

    - I don't think your passport would even matter in this case. When you go back home though, I quess you should translate your marriage certificate and take it to the passport establishment, so that they can change your passport. I wouldn't be concerned about the passport issue. The government here does not care if you are married and would not give you any benefits before you apply for the green card.

    When you do it, you can file the form I-131 Advance Parole which allows you to travel outside the U.S. for a year while your application is pending. You can apply for it concurrently with your AOS packet, and usually it take between 2 to 3 months to get the advance parole.

  14. I am also a F-1 student, I have a further question:

    If F-1 gets married and applied for AOS, he/she loses the F-1 status. What is his/her AOS got denied, can he or she still finish school on F-1 visa? or he / she has to quit school and go back to homeland?

    As a matter of fact, when you apply for AOS through marriage, you don't "loose" your F-1 status; you still have to go to school and be a full-time student until you get your green card. I'm going to go through AOS process filing soon, so I went to an international student advisor at at my school to ask if I could take fewer classes in the fall, and she explained that the reason why it's required to stay on your F-1 status is exactly the chance of you AOS getting denied!

  15. Hi! My boyfriend and me want to get married, I'm on the student visa, and he is a citizen. I've been doing research on how to fill out all the paperwork, but this question remains unclear to me:

    His income for 2008 is about $22,000 for 2 dependents, so I know he meets the income requirements (they just updated them by the way, so it's now $18,212)

    His lost job was at a Curcuit City, so he got laid off at the end of Decebmer, he hasn't found a new job yet(the economy sucks!). He is really trying but it isn't working out!

    Does he have to have a job to be the only sponsor of mine, or it's enough that he meets the income requirements for 2008?Eventhough I think we should probably have a currently working joint sposor, I just wanted to know what you would say.Thank you!!!

  16. The visa number should be in your passport where they staple visa. I read the book on filling out the AOS forms, and it says if the question doesn't apply to your case, put N/A. So I guess if you could come without a visa, you should put N/A. The government just doesn't like when you leave spaces blank, the book says. (it is written by a lawyer).

    And throught the whole process of filling out the paers, always make sure you either put "N/A" or "None" instead of living a space blank. Good luck!
