  1. Everyone brings up discrimination. It is perfectly legal to discriminate. We all do it. The only type of discrimination from a state actor that is illegal involves race, age, gender....and so on. Also, you have no constitutional right to bring someone here from another country.

    Of course the embassy will look at obvious differences. There is no legal issue concerning age. She isn't being denied a visa due to her age. Doesn't matter what age you are, you can get a visa. She is being denied because the difference in age is suspect. If I were working at the embassy, and I saw the picture posted and knew of only one trip being made....I'd tend toward fraud on his part.

    Just keep up the fight!

  2. I'm a single dad of 2. Raised my 4 year old since he was 9 months old totally on my own. If my ex wife (who has weekends on and off) decided to take my kids out of the country, I'd be damned if I'd just say..."Great opportunity for the tots!" If there are two parents in the picture.....I think it is totally unfair to step in and try to drag a child across the globe. If the dad or mom is in the picture, think about the parent/child relationship.

  3. I sent several things to prove I met my fiancee. She is from Colombia, but we flew to Peru to meet. We went to see Machu Picchu, so I had photos of us together with the ruins in the backdrop. I had flight tickets for her and for myself. I had stamped passport information for both of us. The only thing I did not send was copies of emails and MSN conversations to prove ongoing relations. Should I package up some and send them, or will they ask me for additional proof if needed? Thanks!

  4. I filed for a K-1 visa in 2008 for another girl. Soon after I filed we discovered the father of her child would not sign to allow the baby to come to the US. This basically ended the relationship so I cancelled the K1 request and also was notified it was cancelled.

    I'm including a waiver request for my current fiancee.....anybody want to give me an example of a waiver request? Any help will be greatly appreciated.

  5. My questions concerns a petition I filed last year. June of last year I filed a for a fiancee visa for another girl. Unfortunately, the relationship did not work out. (The father of her child refused to allow her to immigrate and some other issues!) So, I cancelled the process. I am presently filing another petition for my current fiancee.....will the past petition hurt my present filing?

    (9) I have previously submitted affidavits of support for the following persons. Will I need to list the first petition I filed even though I cancelled it shortly afterward?

  6. I met my fiancee online August 23 of last year. We met in person (went to machu picchu!) 2 weeks ago. We have lots of photos, emails, IM's, some phone calls....and we are ready to get going. Any start up advice? I'm preparing the I-129F and she has the G-325a and is about to mail it out to me.

    Thought someone would have some start up wisdom to offer. :) BTW...my fiancee is a nurse...does that help a little?

    Sadly, your fiancee being a nurse will probably not help your petition (their job is not really in question), it may help at the embassy though :star:

    if she is a nurse I suggest she starts the application to get permission to sit her NCLEX exam now - because the only thing slower at processing applications than USCIS are the US nursing boards!
