  1. Does I USCIS or NVC offer individual support service by phone ? ? I have some detailed questions I need to have answered regarding the K-1 I filed. I realize I can ask questions on this board but I`ve gotten several different answers. I appreciate the responses but need assurance from the USCIS or NVS. Any info you can pass along would be appreciated

  2. Does the interview have any flexibility in approving the visa if the petitioner is about $2000 short of the 125% poverty level ? I realize savings accounts, property, co sponsors, ect can have a effect on the decision but is the 125% written in stone?

Also does the USCIS take into consideration how employable the beneficiary is ? (ex nurse, physical therapist or another professionals that may be in demand is the USA)

  3. My fiance in the Philippines keeps getting error message "[#1000 B] You are not allowed to visit this forum" after she signs in to VJ It tells her that she is logged in but when she tries to click on anything it gives her the error message. She tried to re register using a new email address and new screen name but still no luck. Any solution to this problem ? Thanks

  4. Welcome, I submitted my K-1 packet on October 1st of 2010. I`ve never called my fiances cell phone or maybe just once. We did all of our talking over YM and skype. I sent in every page of our skype call records since this past May. It was about 250 calls. I also sent in some YM chat conversation. It`s better to send in to much info rather than not enough. Where in the Phils are you living ?

  5. An update from me.

I finally got my Fiance to call the USCIS today (calling the USCIS is NOT useless - we were very lucky he did call today). When he called to find out why the NOA1 was taking so long the person told him they were going to send it back to him because the application was missing a form (G-325a form - biographical form), when they checked it was there (they saw a "tab" on the one so thought there was only one copy instead of 4!!), and so said that they would process it today!! :( I'm so upset - that is two weeks of wasted time! So we now hope to get the NOA1 notification today or tomorrow!! Holding thumbs its today! WOW i'm super upset but I guess i should be happy that things will get moving now...

    Good luck to everyone!! :)

Hi, I understand that you are upset but at this point there isn`t much you can do about it. Believe me in in a short period of time you will forget about this issue. The entire process is a long and detailed. You are going to have to learn to expect possible delays, errors, ect. This may end up being the only slow down in your entire process. Just feel happy that it`s the USA govt handling this for you In many many other countries this process may take even longer. The USCIS isn`t perfect but I think it`s safe to say they are efficient the majority of the time. Time seems to go by much slower when you are waiting for something like this so patience is a must. In a way it`s getting you ready for marriage which is also about patience, understanding and trial and error.

  6. We also sent ours in on Friday Oct 1. We got the email notification on Tuesday Oct 5. We got the postal letter on Thurs Oct 14. Also keep in mind that Monday Oct 4 was a Holiday. I`m sure that slowed the mail down a day. I`m guessing you will get yours Monday or Tuesday. Did you send your K-1 overnight mail or just regular mail ? I sent ours Priority mail which guarantees delivery in 2-3 days. I sent it to the regular mailing address and not the Express mail address.

  7. Do the letters of intent that my fiance and I submit have to be worded differently or can they be the same ? I think I read somewhere on this site that it asked for "Original statements" The statement my Fiance used was

****I, (her name) , do hereby state that I am legally able and willing to marry (my name), and intend to do so within 90 days of my arrival into the US using the K-1 visa.****

Can I write the same thing ? If not can someone give me a sample of what they wrote? Thanks so much !!

  8. They'll just throw your binder away once it gets there and arrange it according to their standards. We sectioned off each part of our petition with paperclips and then bound it all together with an Acco fastener to make sure nothing shifted around during transport. I also punched holes through the top of the papers to make it a little easier on them to put in their files.

How how far apart did you punch the holes on the top of the page ?

  9. Thanks for all the responses. I went downtown, which I was trying to avoid doing and got a certified copy of the decree along with a much better embossed stamp/seal. It copied very nicely. They charged me $1 per page which came to $6 for the certified copy. If you just wanted copies with no certification it was just .10 cents per page. All they did was make regular copies of the decree and one blue page for the certification stamp. Sounds like a racket to me. from .10 cents per page to $1 per page. The only difference was the stamp which was just a machine the clerk inserted the blue page into.

  10. I have a copy of my Divorce Decree. The last page has the official clerk of courts stamp on it. It`s not a ink stamp but the type of stamp that is pressed into the paper. The problem I`m having is that the stamp doesn`t show up very well when I copied it in a copier. Has anyone that you know of ever had a RFE for this ? Any info you can pass along would be appreciated.

  11. Just recently I received a email from CherryBlossoms.com advertising their Fiance K-1 service. They have packages that range from $350 to $1600. I know that there are many services out there that will help you put together your K-1 package but CherryBlossoms.com makes the following claim

**********The United States Citizenship and Immigration Service is not like Home Depot. The USCIS makes it *HARD* to DIY (Do It Yourself). Most (about 95%) people who attempt to file a Fiancee or Spousal Visa petition on their own are denied or face YEARS of delays. Being unable to see your wife for years? Terrible. Having her visa denied and unable to come to the USA AT ALL? Even worse.

"95% !! of people who file on their own are denied or face YEARS of delays" REALLY ??!! In my opinion that is a out right lie. How in the world would they get that info?? Are we suppose to believe that the Govt is giving them this info. I emailed them and asked "Can you show me where you got this stat ?". They responded:

    Aloha,

"****The stats are based on CB’s 30 + years experience of fiancée and spousal visa support.

It is truly heartbreaking to hear the stories of frustration and helplessness that come our way too late. Our intention is to assist as many couples as possible in their desire to be together.

    Best wishes,CB Visa Staff"***

This service just plays on the fears of those who want to bring their loved one to the states. In my opinion that claim needs to be investigated by the Hawaii attorney general. It should be criminal to make such false claims. Yes I realize there are other services that probably make similar claims. For some reason the Cherryblossoms claim really angered me.

  12. The adjudication officer told me to bring in or send in only the last page with the stamp on it. She said they had no interest in any of the other documents. To make sure they had it I took it to the USCIS office myself.

Thats why its so hard for people. One persons experiance or opinion doesnt replace the requirement of a particular officer.

I would send in everything that pertained to the divorce decree & let them sort it out if I had to mail it.

Thanks Ning, My experience has also been that many places who have asked for my divorce decree just wanted the first and last page. Some people on this forum dont realize why we ask questions such as this. They don`t seem to understand many of us are new to this process and want to be sure we are doing things correctly. I`m on here to ask questions of the community and not to be lectured.

  13. I have either lost or misplaced the boarding passes for my outgoing flight to Manila. I do have my boarding pass from Manila to Bacolod. I also have the boarding passes from Bacolod back to the USA. Do you think this is going to be a problem? I do have plenty of pictures of us together. I do not have a hotel receipt because I stayed at her house. Although I do have a receipt from the hotel for the one night I spent in Manila on the way back to the USA. I also have 11 pages of skype call records. Are the outgoing boarding passes necessary ? Any advice would be appreciated

  14. Hi, On my cover letter I`ve been told to include the address of the service center. Do I use the Dallas or Lewisville Texas address ? I realize I need to address the entire 129F packet to Texas but is this also considered my Service center ? Any info you could share would be appreciated.

Let me try to re word this to make it easier to understand. I live in Ohio. I know I`m suppose to send the I129f packet to Lockbox in Texas. Is Texas also considered my service center ?

  15. If your daughters benefit is paid to YOU it counts for you. If it is paid to your daughter, it does not. The I-134 has no provision for combining incomes. Your daughter counts in your family size in any case.

Your condo would be considered an asset. You need an appraisal and a statement or deed showing it is paid in full. The value is then divided by 3 for a family visa to arrive at the value of income that the asset offsets. An asset of $30,000 for example, offsets $10,000 in income. Bank balances are assets also. Credit cards have no bearing whatsoever, good or bad. There is no credit check and there is no calculation of other expenses except family size and gross income.

Thanks Gary that is some good info you gave me. My daughters social security disability payment is paid to me but her name is also there. I`m assuming that this disqualifies the income. Maybe I will add a attachment sheet to the I 134 showing this. I doubt they will count it towards my income but Im guessing it wont hurt to try.

  16. Hi, I hope some of you knowledgeable people out there can help me with these questions. I`m preparing to start the K-1 fiance Visa process. I`ve been on Social security disability for about 4 years. Because I`m on Social security disability my minor daughter, whom I have sole custody of also receives a benefit every month. Am I able to count that towards my household income on the I-134 ? If I can that would definitely put me past the 125% poverty requirement. Also I have a condo where I live that is paid in full. Does immigration consider this when determining if I am eligible ? I have about $3000 in savings in the bank for a few years now that I haven`t had to touch. I do have a credit card with about a $2000 balance. Any info is greatly appreciated!
