  2. If you do the K3 then you will still have to do all this anyway but K3's take longer.

    Really? Seems like they are taking the same amount of time at the California Service Center.

    The marriage in Vietnam can be problematic, but it can be accomplished in less than a month. I know this for a fact because we did it. 3 weeks after I hit the ground we had the certificate. Our trick? When we started bickering at each other in the interview they started laughing and said we must be in love.

    You can PM an organizer and ask them to move this over to the Asia: East and Pacific (Except China) forum. You will get more Vietnam specific answers. Or you can try to call the Consulate. The number is listed on the website. I simply don't know the answer.

  4. Not to change the subject, but I just wanted to sign in here and thank everyone who's offered me their advice on this thread over the past year.

    This week, my wife passed her interview and subsequently got her visa-containing passport back in the mail, so we are finely golden.

    She's gonna chill for a minute to say her goodbyes and pack up the rest of her sh!t, then she'll shoot here for the 2nd week in February.

  5. If i get all the required evidence, it's best for me to send all the required paper work to my fiance in Vietnam, then she can bring it to the US Embassy over in Vietnam right?

    I also have another question, in the CRBA form, it asked for the baby's birth certificate number. That means my fiance should get a birth certificate for the baby first before filing the CRBA?

    I would assume that you would need the Birth Certificate. It says only one parent has to be present for the appointment, so it appears your fiance could do it. It also says to schedule the appointment 3 months in advance. I'd get cracking on it, while making sure I did everything right!

    I am assuming that you are not married since you didn't mention a I-130. The D.N.A. test is required.

    Birth Abroad Out-of-Wedlock to a U.S. Citizen Father: A child born abroad out-of-wedlock

    to a U.S. citizen father may acquire U.S. citizenship under Section 301(g) and 309 (a) of the INA provided:

    * a blood relationship between the child and the father is established by clear and convincing evidence;

    * the father must have had the nationality of the United States at the time of the child's birth;

    * the father had been physically present in the United States for a period of five years, two of which were after the age of fourteen;

    * while the person is under age of 18 years -

    a- the father submits recognisition of child born out of wedlock under the law of their residence or domicile,

    b- the father (unless deceased) must submit a notarized Affidavit of Paternity and Financial Support or

    c- the paternity of the applicant is established by adjudication court.

    Birth Abroad Out-of-Wedlock to a U.S. Citizen Mother: A child born abroad out-of-wedlock to a U.S. citizen mother may acquire U.S. citizenship under Section 301(g) and 309 © of the INA if the mother was a U.S. citizen at the time of the child's birth, and if the mother had previously been physically present in the United States or one of its outlying possessions for a continuous period of one year.

    I would go ahead and get a D.N.A. test done even if I was doing a K-3 or IR/CR1. They have been known to ask for one to be done when the beneficiary interviews. I'd beat them to the punch.

    A DNA test may be required but the "clear and convincing evidence" could be as simple as a doctor's statement as to date of conception combined with evidence the petitioner was present with the beneficiary mother in country overlapping any date range in which the conception took place.

    Maybe. You know how this Consulate is though. They may ask for video evidence of the moment of conception.

    Now people unfamiliar with the area may think they are entering the town of Obama, population: 55.

  9. All of the advice listed is good. One thing that is lacking is the fact that your Husband needs to call USCIS (NCSC/National Case Service Center) at 1.800.375.5283 and ask to open a SERVICE REQUEST. He needs to ask to do that SPECIFICALLY. He will not be able to make an INFOPASS appointment until they have had 45 days to resolve the issue through the Service Request.

    Order from Immigration Court - If you were directed to us for processing based on an order from the Immigration Judge. You must bring all documents required in the post order instructions given to you by the court.

    Case Processing Appointment - If you received a notice to go to your local office for further case processing.

    EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.

    Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

  10. Welcome! I have to say that I am VERY glad you posted here. I did not realize I could file jointly with my Wife. Our return just doubled! I will be there at the end of February and will be down in that neck of the woods. We owe you and your Wife dinner if you'd like! :thumbs:

  11. Has anyone who is married to a Vietnamese National done this? It appears to be possible. I see that a ITIN (Individual Taxpayer Identification Number) is required and any income the spouse made in thier home Country would have to be counted towards the total income. Any help or advice would be greatly appreciated.
