  1. My wife came over on a K3 status visa in 2010 and we did an adjustment of status and she got her Green Card in 2011.

    I am finally filing for N-400 and she meets the 3 years requirement.

    My question is I have the marriage certificate from the country we got married but i never did a court marriage when she migrated to the states. Will this be a problem for my filling of N-400? We have tax records, mortgages and Bank accounts that state both of our names. Also birth certificate of our child has her and my name as well.

  2. We have our AOS interview tomorrow. Heres what i am taking

    Wedding Pics,Rental Agreement, Health Care Verification, Car Insurance, I485 Forms, w2, employment verification, last year tax returns.

    Anything else you guys can think of?

    Also we have a marriage certificate from Pakistan but not from the US. Will that be an issue?

    Wifey wants to travel back home in the next coming days, should we let them know at the interview?

  3. I'm confused...your profile says your wife is on K3 visa, but you said in your post here that she is on K1 visa...

    If she is on K3, she can go to Pakistan and re-enter the US without a problem (she just has to show proof of her ongoing I-485)...but if she is on K1 visa, she needs an approved Advance Parole (AP, or I-131) before she goes to Pakistan.

    On the Visa its says " Visa "R" Type/Class "K3"

  4. So we applied for AOS with Work Authorization back in November 2010, we got the letter for Biometrics which was done Back in Mid December...Whats next? when should i expect to hear from USCIS?

    Also my wife is currently on Fiance Visa Expires in August 2011, shes planning on going back to Pakistan to visit for a month. Is this fine to do while AOS is still in process?

  5. I am about to file for my wife's AOS and had a couple questions.

    1. Marriage Certificate: WHAT SHOULD I SEND TO THEM? I have my marriage certificate from Pakistan where I married my wife will that work or I need to go an do a Court Marriage in the states.

    2. G325A Petitioner: Do i need to send a G325 form of mine as well as my wife's (non-immigrant)?

    3.Medical Examination: My wife had her medical examination October of last year back in pakistan, does she have to do an medical examination in the states or is it valid.

    How long is the medical examination valid for?

    4. I-601--What is this? do i need to fill this out?

    5. Travel Documents: I-131- Do i need to fill this out? If so why?

  6. so my wife came over on K3 and now i am applying for AOS on the i-458 it is listed:

    I am applying for an adjustment to permanent resident status because:

    An immigrant petition giving me an immediately available immigrant visa number

    that has been approved. (Attach a copy of the approval notice, or a relative, special

    immigrant juvenile, or special immigrant military visa petition filed with this

    application that will give you an immediately available visa number, if approved.)

    b. My spouse or parent applied for adjustment of status or was granted lawful

    permanent residence in an immigrant visa category that allows derivative status

    for spouses and children.

    c. I entered as a K-1 fiancé(e) of a U.S. citizen whom I married within 90 days of

    entry, or I am the K-2 child of such a fiancé(e). (Attach a copy of the fiancé(e)

    petition approval notice and the marriage certificate.)

    d. I was granted asylum or derivative asylum status as the spouse or child of a person

    granted asylum and am eligible for adjustment.

    e. I am a native or citizen of Cuba admitted or paroled into the United States after

    January 1, 1959, and thereafter have been physically present in the United States

    for at least 1 year.

    f. I am the husband, wife, or minor unmarried child of a Cuban described above in

    (e), and I am residing with that person, and was admitted or paroled into the United

    States after January 1, 1959, and thereafter have been physically present in the

    United States for at least 1 year.

    g. I have continuously resided in the United States since before January 1, 1972.

    j. I am the husband, wife, or minor unmarried child of a Cuban and meet the

    description in (F) above.

    h. Other basis of eligibility. Explain (for example, I was admitted as a refugee, my

    status has not been terminated, and I have been physically present in the United

    States for 1 year after admission). If additional space is needed, see Page 2 of the

    instructions.

    WHICH one should I PICK?

  7. You don't need to AOS or file an I-765 to get a SSN, they're not related.

    Go to your nearest SS office about 2 weeks after her arrival, to give her time to show up in the system. Take the required documents and you should get her card in a couple of weeks.

    shes been here for 1 week...i went today and they said i need to get a I-765 form from homeland security filled out and submit it..

  8. my wife just got to the states after getting her K3. I haven't applied for AOS yet, but will be in a couple of months but wanted her to join my medical insurance at work.

    I see that the work permit I-765 is $340, shes not going to be working. I just need a SS# for the purpose of putting her on my medical at work.

    Is there a way around not paying the $340 fee and getting work permit (I-765 form)? what are my choices?

  9. Hey Guys my wife had the interview on August 3rd, and she got approved, they gave her a confirmation # and told her that passport will arrive in 10-15 days through american express.

    Questions they asked her:

    3 questions:

    1. When was your marriage (date)

    2. What does your husband do?

    3. Where does he live?

    Question How long is the visa for?

    I most likely travel to pakistan in december and on the way back do our honeymoon. is it ok to travel to another country before entering the US?

  10. They should know everything about you guys. Ask them to take pictures of wedding and pictures of you two together. They will definately ask how you were met, and how much time was spent together. Proof like pictures is important to take with.

    Does anybody have example questions?

    Also my fiance (wife) are married......since we are married and have all the paperwork will that be easier?
