Hi, I filed for my wife's AOS (K-1) in May, and our daughter arrived in September on her K-2 visa. I am now filing for our daughter's AOS and am a little confused on the fees I need to pay. On the USCIS web site it states that if child is under 14 we pay $600 if filing with the I-485 application of at least one parent. Does that mean that we will have to pay the $930(or $985 after tomorrow) because I couldn't file them together?
Also, we still haven't got an approval on my wife's AOS. The interview was Sept.15, and the Officer said we would receive a decision within 30 days. I have been waiting to get the approval before I file our daughter's AOS, but she turns 14 on Dec.5. I need to do something quick. I am afraid it isn't going to matter if I get the daughter's AOS filed before her 14th Birthday, that we still have to pay the higher fee because we couldn't file the apps together.
Any input is always greatly appreciated. Thank you!

How much money do you have? ALL of it.
Once the paperwork is complete and all the fees paid and all the government hacks are staisfied...you will have a new wife that needs to replace all the things she left behind, your utilities will double, your food bills will double (at least) and every dollar you make will be consumed by the family. Welcome to life in the USA.
Be happy. When you are HAPPY using all your money for your family, you will always be happy.
The fees for the K-1 and the AOS and the Removal of Conditions and the Citizenship and the education, drivers license, medical expenses, insurance....ALL of it, is but a tiny down payment on a life of bliss. Enjoy it every day! It conitnues for decades, children multiply expenses many fold, then they have children. It will end when you die.
Between now and then, enjoy every moment. When the most enjoyable thing you vcan do with your money is to buy your son a new pair of "cool shoes" you will have arrived in everlasting happiness.
Thank you, Gary. Very well put. With the arrival of our daughter from China on Sept.8, and projected arrival of our baby daughter from the womb on Oct.8, I am about to enter said bliss. I am and will continue to enjoy every minute of this blessing of life. This journey has seemingly taken every penny I make, but to have the most wonderful wife and family in the world is truly priceless.

Hi, our 13 year old daughter is due to arrive from China in September and we are getting ready to enroll her in school and getting a jump start on her AOS. I am the USC petitioner and am wondering if we would have any problems when she arrives and we go to Social Security and have my last name put as her new last name. She has never known her bio father, he abandoned them at 7 months of age, and she knows me as her father, which I am, as far as I am concerned. Up to now her last name has been my wife's maiden name. My wife changed her maiden name to her middle name when she took my last name when we married. We are expecting a child in October and don't like the idea of three of us having one last name and our oldest having a different one. I am just wondering if this is anything we need to worry about as far a having problems with S.S. or are we just worrying over nothing? Thanks!

Great info, Darnell, as always. Yeah, they are still doing K-2 ftj's, they just sent my step-daughter her packet 3 a couple weeks ago, after 5 months of dicking around. I just hope we don't get stuck paying the increased NIV fee of $350, up from $131.

On a seperate note, if we are now going to have to pay up to $350 for a visa instead of the $131 for a K visa, then maybe those that choose this route should be steamlined since they are paying twice as much as other petitioners Jerome
Those that choose this route will be paying $350 more than the illegals who will benefit from the amnesty that the increased fees are going to pay for. This bull$&!^ is the govt once again punishing those who play by the rules to take care of people who don't give a ####### about our country, its citizens and legal residents, and our laws.
You are very right, Jeromebinh, it should go towards streamlining the process, unfortunately it won't be streamlining anything for those who follow the rules.

Yes, Darnell! I am glad you mentioned that. I have been told that we would be OK since it was GUZ's fault for taking so long with processing the child's case. My wife was issued her visa from USEM Abu Dhabi and they transferred the case to Guz on 12/01/2009. A series of comm snafus led to GUZ just now sending the instruction packet to the child in China a week ago. GUZ said they were waiting for a paper file, ABD kept saying they sent an electronic copy and they will have to load it from the "IVO-Topics-Status/Receive case transfer." GUZ could not figure this out til a few weeks ago and then they kept sending e-mails referring to my wife's E-MAIL NAME as the beneficiary for the K-2 visa! This would be hilarious if it wasn't our family being together at stake! Do you know if it is correct that we should be OK since it is the Embassy's fault in taking so long in the processing? My wife was issued her visa on 11/25/2009 and case transfers on 12/01/2009, that is pretty quick, this should have been over a long time ago.

I am filling out my wife's AOS packet and a recent thread on VJ recently has got me thinking and doubting the way I filled in Part 3 of the I-864, Affidavit of support. For 8. I checked " I am sponsoring the principal immigrant named in part two above," and for 9. I checked that I am sponsoring the following family members immigrating at the same time or within six months...., and I put down our daughter's name and info, (My step daughter).
The little girl is 13 years of age and she has just received the instruction packet from Guangzhou, and we won't be sending in the completed packet until my wife gets her AP so she can travel back to China to attend the interview with her.
Should I not be including the child's name on my wife's I-864 form? Is the K-2 considered a separate visa petition, and I don't list the child until I fill out her own separate form when I apply to adjust her status when she eventually gets here?
Also, for #8 of part 3 it lists a YES and NO box, I would check the YES box? It seems checking the first box after #8 already answers in the affirmative, but I thought I would post my question and make sure. Thank You for any and all help/comments!

Hi, I have a question about part 3, section B: "List your present spouse and all of your children".
OK, here's where I am a bit confused, our daughter, (My step-daughter), is still waiting for her instruction packet from the embassy in Guangzhou, so she won't be getting her K-2 visa in the very near future. In section B it asks if the child is applying with you. I am assuming it means applying to adjust status, right? So we would check the NO box? Our daughter was included on the original I-129f petition, so I just want to be clear that the I-485, part 3. section B is asking about applying for AOS. We will apply for our daughter's AOS after she arrives here, we can't be certain that she will immigrate within 6 months of my wife's POE date. Can anyone help clarify this for my very tired and blurry mind? Thank you for your help!

Hi, I am getting ready to file my wife's AOS packet and have a quick question on the I 864A. My sister is our co-sponsor, makes well over the required income to be our sponsor, but she files her taxes jointly with her husband. Now, do we list her individual income, taken from her W-2, or list the total on line 22 of the form 1040, total income, which is the combined income of her and her husband's income?? Question 11 on I-164A asks for TOTAL income as reported on the federal tax returns, but I thought only SHE can be the co-sponsor. Any help would be greatly appreciated. Thank you.

Sorry but what is AP??
It is Advanced Parole, and it allows you to re-enter the U.S. if you leave, while still waiting for your Green Card.

No issues. The SS administration is a federal function. You can apply at ANY SS officxe in the United States or its posessions and have the card sent to any address in the US you choose.
1. Apply in her maiden name, exactly as in the passposrt, whether you are married at that time or not.
2. Do not leave until they tell you your application is accepted. If you run into any problems or they tell you there will be ANY delays, you have run into one of the untrained morons that work for SS. ask for a supervisor. DO NOT leave until your application is accepted. Ask them for their number to call the next morning and get your SS number, the numbers are generated overnight and you can call or go to the office and get the number the next day. The card is useless, it is the number you need.
3. After you get the green card or EAD go back to ANY SS office and change the name on the card IF YOU WANT. It is not necerssary to change the name on the card or for your wife to change her name to yours, it is entirely her option

Hello, my Fiancee arrived in Los Angeles with no problems on Dec. 29 and we are so stoked to be together again! We live in AZ, but are in CA for a month or so visiting my family and I have some work here, so we went to the local Social Security office to apply for her SS#. They said they could not process the application because we live in AZ and must apply there. I don't want to wait until we go back to AZ to start this, and so I called and asked if we could just list my parent's address here in CA and have the card sent here, they said no problem, cool. Does anyone know of any issues that may arise at a later date because of us submitting our application at a different location from where we live? It is just where they will send the card, right? The SS card just has her name and number, but I just want to make sure this won't create a problem down the road. Thank you very much for your help!

Hey vwtj, what you have sounds pretty good, but I have read in other posts here on VJ that you will want to keep your binders under 1" thick, as that can cause problems passing through the window at the embassy. As far as the phone logs, maybe just a monthly sample from each year, so they get the Idea, but if you don't mind shipping it over, it couldn't hurt. I wish you both the best!

Hello, I am in need of some guidance. My Fiancee received her K-1 visa from USEM Abu Dhabi, which is great! The embassy is in the process of forwarding the case to Guangzhou for the 12 year old daughter to follow to join later. I believe we will need some form or document from the birth father stating he does not object to the child moving to the U.S, permanently. The birth father abandoned my Fiancee and the baby when the child was 7 months old, and hasn't been seen nor heard from since. My Fiancee is in China right now and she was able to locate the guy. She asked him if he would sign a paper stating he doesn't object to the child leaving and have it notarized. Well, lo and behold, at first he wanted his daughter back, so he could send her to Japan to live with his brother(??), now, he wants them both back and is refusing to sign anything. They were never married, and he has never helped to support the child, even in the 7 months of the baby's life he was around. What can we do? Does anybody know if my Fiancee can file for sole custody on the grounds of abandonment, having not been married? I have a lawyer here in the US and am still waiting to hear from him, but I doubt he can be of any assistance in this case and we really cannot afford another lawyer in China, but obviously I will do whatever is necessary to get our family together. I hear that GUZ is a slow embassy and so we are planning for my Fiancee to get here ASAP so we can be married and adjust status and get EAD and AP so she can travel back to China in time to attend the daughter's interview. I have been told it can take 90 days to receive packet 3 from GUZ, so we should have plenty of time to receive advance parole before the interview date. I am sure we aren't the only ones who are facing a spiteful ex in obtaining a visa for our little girl, so I hope someone can set us on the right path. Thank you very much for any help you can give!

That shouldn't be a problem. Just make sure she has police certs from China as well as Japan, (And anywhere else she has lived for more than 6 mos. since the age of 16) to bring to the interview.
