    Sorry I am not up to speed with stuff. I send my N400 Friday and it was received today. How do you put yourself on this lockbox list.

  4. First, sorry in advance for any spelling mistake… I am French Canadian. YOUPPI!

    I have come on this website since the beginning of my K1 Visa request 2 years. This site has been a wonderful tool in providing me with guide, forum, and information (I say proudly: my attorney was less up to date than me from time to time, hahaha). VJ and his community of members and the sharing of their most recent experiences helped me a lot of time when I received confusing information. Oufff, the immigration process is confusing, long (and I wonder if it will ever finish) as we still need to finalize also our non-residency status in our native country at the same time, which mine is Canada. Now, I am in US, since July 2009, got married, did the change of status, and in a year will start with the Lifting Condition. A break please, it is what I got for a year, well deserve and I just have to enjoy, yah.

    I am trying to enjoy after this stressful time made of paperwork and waits for approval with the constant scare of being denied. I came on VJ again to find answers on how to enjoy! From time to time I was feeling really lonely (even if my spouse works at home), lost, disappointed at myself, guilty (for not having a constant smiling face), sadness, hostility and resentment (did not even understand the meaning of those words before). Got the picture! Ring a Bell! And more I read, more I was reading myself (am I going crazy? when did I wrote all of these threads). Anyway I found the answer: HOMESICK, did not know how I got this thing … And with this thing catches upon my arrival in the US, I have turned into an ALLIEN, yes here in the US. OK, I realize that I was not alone, so not so tragic. There were many, many other ALLIENS. They did not all look alike but they were all CRYING “ET wants to go HOME”. See ALLIENS miss their old way of life — they miss their family and friends, their customs and traditions, and the familiar settings in which they once lived. I was (and I am still) an ALLIEN, suffering A BIT. Did I brought you up to speed? I did tried to do a short story (no one on this site can it related the long immigration process).

    Anyway, what is on his way for the ALLIEN is, I am rewarded myself with a renewed perspective on life … First step acceptation of the ALLIEN transformation. What I have read the most about ALLIEN’s feeling is of being alone and therefore how much we wish there was another Canadian ALLIENS around with feeling the same way we do, we could cry together “ET wants to go HOME” if it helps. I know there is many, many ALLIENS out there but could not find any group. Is there any group that you know??? I would like to find other Canadians ALLIENS located in my region in California (the Monterey Bay area from San Francisco to Santa Cruz). If not could some be interested in forming a group that could meet on a weekly or monthly basis to discuss and support each other, and even do activities. I am sure I am not the only ALLIEN interested in this idea (might not be a new one); Trying out can be worthy!!! Canucks, who have turned into ALLIENS, located in from San Francisco, through San Jose, Santa Cruz, as far as to Monterey please identify yourselves by contacting me.

  5. Hi Kate and Matt,

    As soon as you get your NOA2 starts gathering all the paper needed for the interview. You will need to submit the part 1 of the form DS-230, the form DS-160 that we do online and also the forms 156 for you and each child. They will ask for the following documents (also for your child) with one photocopy as they will look at the original and give it back to you and will keep the copy for their file:

    birth certificate

    passport (make sure it is still valid for a few years)

    5 passport photos as per their requirements size (3 for medical and 2 for visa)

    police certificate (should not be more than 3 months old)

    court and prison records (only if you have been convicted for crime)

    military records (only if you have been in it)

    medical exam (take your appointment asap)

    divorce and death certificate (if you or fiance have been previously married)

    evidence of support (Form I-134 Affidavit of Support must be done by your fiance and notarized)

    another letter from your fiance stating that he is still willing to married you

    documents for accompanying child (the same than above at the exception of police certificate)

    Court jugement showing sole custody of child

    letter from child other parent stating he does not have any objection to the child immigration to the US

    For the medical your child will also need to go through it. There is only 4 doctors doing it and 2 are located in Montreal, one is in Vancouver and in Toronto. You will need to bring your vaccination records to the medical exam and the copy of the letter in packet 3.

    People are right when saying that Vancouver is really fast compare to Montreal because you can fax your documentation and are less busy than Montreal.

  6. Thanks for all your replies. I'm still very confused however, perhaps I will call the consulate and find out for certain what kind of documentation I will need.

    She is four. As far as sole custody goes, I have no custody order, however she has always been in my custody.

    If its of any relevance when I've taken her with me to the USA in the past I've only ever used her Birth Certificate and I've never had a problem before. Obviously this is a little different than a two week trip however.

    I understand you are confused. All the information you received by others state the same you will need documents. My child birth certificate shows the father name. the point 11 in the packet 3 state the following:

    DOCUMENTS FOR ACCOMPANYING CHILD: Your children, if under 21 and unmarried, may also receive a visa, but only if they are included in the petition of your fiance and listed in the first paragraph of this letter. Each child must have all the documents noted above (on the checklist download it from this site from the consulate info vancouver) except for police certificates if under the age of 16. Evidence of support must mention each child name. Children must have their own passport. You must show that you have sole custody of any children under age 18 who will accompanying you to the US. Present divorce jugements showing that you have sole custody of accompanying children. If you do not have sole custody, you must obtain a notarized statement from the children other parent stating that they have no objection to the children immigration to the United States.

    If you have travelled before to US with your daughter without any question from the custom border officer it is because you brought your child birth certificate with no father name on it. Each time I crossed with my daugther they asked question on where he was and I have to have a notarized permission signed by him for me to take her for a visit and vacation in US. I am ok with this as I personnaly as a mother would not want the father to get out of Canada during his visitation rights with her. We will swore at the beginning of the interview and you will be asked questions about the father. It is not because his name is not on the birht certificate that he does not have any rights toward his child. If he does not want to sign the permission letter you will need to go to court and the judge will simply take the decision. Like Rooster said previously if there has been no legal custody arrangement to date, you should proceed with that as soon as possible and before the father decide to do so and request custody himself. You have took care of your child and this is in your favor as the father never applyed his visitation rights except for 2 months ago. I do not want to scare you in anyway but both parents has the same right and no having no custody arrangement will be a very serious matter from the immigration point of view. They will not issued a visa without having legal documents, do not thake this the wrong way but as a mother it is exactly what they should do to protect children from abduction.

  7. I have a question about the K-2 visa. I am the only parent on my daughters birth certificate however I do have a court order for child support. My daughters father met her for the first time two months ago and told me today that he was going to make a fuss about her leaving the country. Is this something I should be concerned about? If it is an issue how would it be resolved?

    Hi,

    I have a 11 years old daugther and we had our visa interview last week in Montreal. You will need a notarized letter of the other parent (the father) specifiying that: You need to have a court jugement mentionning you have sole custody of the child, and also you will need a notarized letter from the other parent (the father) stating that he agrees his child moves to USA with his mother.

    In my case I did not have sole custody of my daugther so I had to ask the father to come with me to my attorney and I have redone the agreement with him. I agreed to not ask for more child support as he was worried about paying more. He knew I would not work probably for a while without a green card. We also established new visit schedule as I will pay for all the flights for her to come to Canada. The visitation will be 4 weeks during summer and 1 week for spring break and 1 week at Christmas. The new court jugement of February 2009 mention that I have Sole Custody of my daughther and also to avoid any confusion or problems I requested they put his statement that he agrees that the child moves with the mother in USA.

    The paper received in packet 3 mentionned both requirements. At the interview the officer asked if I have sole custody and to show her the original court jugement and for a copy. She asked me also for the notarized letter letter of the father stating that he agrees to his child moving in USA. I did not need the letter as it was written down in the jugement, I told them that and showed them where it was stated on the court jugement and they carefully review the content.

    So .. Interview for me is today, hopefully everything will be OK, wish me luck :D

    For those who have the interview today in Montreal, there are a bunch of peoples protesting in front of the embassy. They where there Saturday, Sunday, today and still where there when I left work at 12pm. Cops where there to check in case of problems .. I do not know what the heck it is all about, but I just wanted to let you know so you are not too surprised (in case they are still there)

    We got our interview yesterday. We had our K1 visa interview yesterday in Montreal and we came back last night with a big smile... Ge got approved too. They are really nice so my advice just prepare well. stay calm and enjoy the experience. I was so excited when I heard we were approved that I completely forgot to ask about the instruction, what to expect or to do when the Visa arrives and what would happen when I took my packet to the airport in Ottawa. If anyone knows or have any instruction ( I read that some received an instruction sheet at their interview in Montreal), please would you share it.

    We are still waiting for our interview date. We call on Monday and they said we were in the waiting list. Keep faith everyone, it will speed up soon.

    I have a question and hope this is the right place but I believe some of you might be able. Once I received the K1 visa I will be flying from Ottawa to Chicago or Washington and then to San Francisco. Is anyone know the POE, the transport companies ask for it. Will I need to activate my K1 Visa in Ottawa when I go through custom here before boarding or when I will be landing in US (Chicago or Washington)?

    I look at all port of entry but I am so lost. Thank you in advance for your reply.

    I just received my NOA2 on January 9 and preparing a bit in advance. I have started with my vaccination process, I was not up to date with that. I have some questions and would like some answers from the K1 applicants who has recently received their packet 3 from Montreal.

    Canadian Police Certificate: I have called the RCMP Detachment in Ottawa, it is the nearest from Gatineau. The lady told me to contact my local police office in Gatineau. What I have heard is we need the Canadian one from the RCMP so I am confused about this. Guys, is the Montreal Consulate has provided you with any information regarding what they want, fingerprint or not. Do they want it from the RCMP or local police office is good. Is there a validity period, if I go now is it good if my interview is just in 6 months? How long does it takes to get it from who ever RCMP or Police office. Is it the one with or without fingerprint?

    Does anyone has seen a copy of the checklist send by Montreal on this site. If so let me know the link to it.

    you just need the one from your local office, its not finger prints its just a piece of paper saying if you have any criminal background, and it only takes about a week or 2, im not sure how long its good for, but since it only takes a couple weeks to get it you can wait a few months to get it at least then you wo nt have to worry about that

    thank you to both of you for your answers. I do not know why here the RCMP woman says they do just fingerprints one. Anyway I will go to my town police station and will get the police certificate. I do not know at this time if the I-129F has left for the NVC. Can we call in for a medical in advance even if we do not received the packet 3 yet?

  12. Did you guys see a touch before the approval - sept filers - karri, sarjori, etc... I have not seen any touches since 9/30.

    Did it come by email or postal mail

    I am getting really anxious...I need the NOA2 approval soon...

    In our case we did not have any touches since the NOA1. I believe they probably started working on our Petition late in the day of January 8 and finished Friday January 9. We received our approval Friday night at 7H15pm (Quebec Time). I was really happy because Paul-Richard was here since December 24 and was leaving today. My wish was that we could just see a change in date before he goes back to California.

    we are pretty sure you will see some movements on your file before the end of the week. We will send a lot of energy.

    Paul-Richard have hired an attorney back in September to help us with our Petition because we did not know how to proceed with it. We provide all the information to the attorney and look at all the paperwork, organized it and submitted it. She is the one who has received the NOA1. She did request that we pay the Visa fees in advance. She provided us with the link for us to be able to look at the status of our case. So I guess everything was well organised. Now like everyone who got their approval, we will work on the paperwork for the application once the Montreal Embassy sends me the packet. Our attorney mention that she will once again look at all the information before I sumbit it to the Embassy.

    Even with an attorney, I can say that the VJ website has provided me with great support. If it was not of this website I would have harrass our attorney each day. The waiting process is stressful. Thank you to all of you who are sharing information and your experience, you are making things easier.

    I will send out energy to those who are still waiting approval.

I have discovered so much information that helped me a lot. I just decided to register, this is my first post and not sure how it is working but I will found that out with time. My US Fiance and I as started the process in september just following my return to Gatineau QC after spending the summer in California with him and my daughter. If everything goes smoothly we are planning to get married on August 15, 2009, in California so in less than 9 months. But I can say that I am a little worried about the wedding date because I have read a lot on this site concerning the Montreal Consulate waiting time being really long. Anyway we keep our spirit up. By the way, I just want to let you know that I am French and I might make some mistakes from time to time while writing. All the best to all of you.

    Welcome aboard our quiet little waiting train. with the recent touches and August starting to move, maybe August 2009 will be no problem for you. The probelm might be that you get approved too soon and need to get married before that point, but I wouldnt expect that to be a problem either. I think you have up to 6 months to enter the US, then 90 days to get married. So should be OK.

    Thank you Grace and Chuck to have Welcome me. Being approved too soon will be less of a problem than being approved to late. The next 6 months I need to focus on selling my residence, packing, moving the houselhold, looking for new school in California, preparing a wedding and making sure professionally to live the office with a well trained person. No doubt in my mind not to be approved, once they touch it. Positive Energy is the most wonderful Power full of Love. It will be the same for you too.
