  1. This is probably a dumb question, but I haven't seen it addressed explicitly, so:

    My girlfriend has a B-1 (10 year multi entry) work visa which she has used to come to America multiple times for her job. She is not currently in America and as far as she knows, she doesn't have any business trips here in the near future. Does her B-1 help us in any way? I'm assuming we can't AOS from it unless she is physically in the country when we get engaged - on the grounds that even though it was obtained for her job (well before we met), it would still be an abuse of the B-1 for her to come here (even if also travelling on business at the time) with the intent to get married and adjust status. Am I right or is there something I'm missing? Can she at least use it to come and visit me while a K-1 is processing? Or is it solely for business and not relevant here?

  2. Photos are far from the most powerful evidence. They should be used as secondary evidence only. Using photoshop I could put you with anyone at any time in any location

    Thanks for pointing that out - you beat me to it.

    To the OP, you want to think like a detective. If you wanted to prove that two people were in one place at the same time, you'd need a lot of evidence. Flying somewhere makes a big paper trail:

    - receipt for the ticket

    - boarding pass

    - passport stamps

    - receipts for things you bought while there (which usually have dates - also helpful)

    - bank statements for charges you made in her country (also dated)

    - ATM statements for cash withdrawals there (ditto)

    Put it all together and it's very hard for someone to say you weren't there. My gf and I aren't to this point yet, but we're already keeping e-v-e-r-y-t-h-i-n-g...
