    Considering that his administration, by all appearances, will basically be a coalition of left-wing special interest groups... I can't see how that would help the VJ crowd.

    The only exception may be if he manages to depress American prosperity so much that there's no illegal immigration left. In that case, I suppose checking applications for fraud will get considerably easier.

  2. The OP's intentions are well-meaning I believe. I am from the Philippines and sad to say, I do admit, there are scammers everywhere. :) But, that does not mean, we're all a bunch of scammers here and nothing genuine is ever happening. It's an open discussion everyone. Some degree of hurtful truth is in the OP's post.

    As far as I can see, there are high and low fraud consulates on each continent. I mean, is it racist against white people to say there's a fair bit of fraud in Russia?

    BTW I would say there's a difference between a sincere marriage with bad motivations (i.e., "I want to marry him for his money/status/citizenship, but I do intend to be his wife") and a completely fraudulent marriage (i.e., "I want to marry him, gain status, and ditch him.") But do people really want to be married to either? IMHO I would not marry a woman who was specifically looking to marry outside her country, unless there was a cogent reason that didn't have to do with citizenship. (i.e., ethnic or religious minorities looking to marry within their own group, and not able to meet anyone locally who's part of that group). In that case, one hopes that her reason for moving is simply to be with the man she loves...

As stated above, the requirement is that you have met in person within the last two years, not that you have sustained your relationship for that length of time. I remember an April filer who petitioned for his fiance just two weeks after they met.

    They had a K-1 petition ready to send, two weeks after they discovered each other's existence? They must have started filling out the paperwork on their second or third date! Did they get a visa?

    Again, I think the big question is what the OP meant to say by "we met for the first time on December 31st." If he's just talking about the first face-to-face meeting, then what he's suggesting isn't even all that unusual for VJ. If he's talking about finding each other, talking, dating, courtship, marriage proposal, AND K-1 paperwork all crammed into two weeks, I think it's fair to say that this would raise some eyebrows. It's not necessarily a deal-breaker, but to say that the consulate wouldn't even notice is probably a tad optimistic.

    In the US, we call that a D&C. "Dilation and Curettage". The same procedure is used for other purposes, whether a fetus was ever present or not. It just puts the uterus back in a "fresh" state.

    Right, that makes sense. I'm just not getting why this was termed an "intentional abortion" if the baby died on his own without being killed by someone else. Surely the PI government doesn't equate a miscarriage (a tragic, natural event) with a deliberate act to end the unborn child's life?

    There was a list of red flags awhile back. A brief relationship, followed by a very fast plunge into matrimony, was listed as one of them. Makes sense to me - not saying the OP's relationship is fraudulent, but rather that a quick wedding would have obvious appeal to a fraudulent couple. (Why bother taking time to ensure that you're really compatible, if there's no relationship to start with?)

    You know, now that I read the OP's posting again, I'm noticing he says that the two of them "met for the first time on December 31." OP, could you clarify for us - do you mean that you had never known of each other before then? Or was this a face-to-face meeting that you'd been leading up to for awhile with emails, phone calls, and the like?

    Rocky&Bullwinkle - to classify a miscarriage as an intentional abortion isn't just cruel, it's medically wrong. They may have used the term abortion - which in formal gynaecological language (as opposed to common US usage) simply means any pregnancy that does not culminate in a live birth - but if they actually prepended "intentional," this is medically inaccurate. Are you sure they don't say "spontaneous abortion"?

    If someone had actually made a comment about my religion, yeah, I'd have defended it. But that's different from launching into how-dare-you-say-stuff-about-Muslims diatribes when nobody had even brought up religion.

    Just to chime in one thing you might have already known - Air China and China Air are two very different entities. China Air is a Taiwanese carrier with a decent record; I'd be willing to fly with them. Air China is the former CAAC, which is to say it is the Chinese equivalent of Aeroflot. Nuff said.

  10. This really shows how antiquated/old fashioned the immigration system is (not to mention the minds of some people). I used to think as a child the U.S. was the most advanced nation leading the world in freedom and justice. Ignorance is truly bliss. -Jeff

    It has nothing to do with the system being "antiquate", it is NOT legal at the moment. I'm all for gay marriage but you can't blame the system that is based upon US FEDERAL law in which it is not legal. If US law changes, then so will USCIS eventually.

    australia allows immigration for persons in intimate relationship, and does not even require marriage.

    I can't imagine the level of visa fraud that would take place if an "intimate relationship" were all that it would take to get a visa here.

  11. Just to point out, you could get married and file the DCF to bring your Japanese wife to the US with you. Read the guides for more information. Or you can continue with plans for the K1.

    My second question is (2) can my fiancee fly to Germany to visit her parents while we are applying for the K-1 Visa? From what I understand, she cannot leave the U.S. once she enters the country on the K-1 Visa, but I am unsure as to if she can travel to Germany while the paperwork for the K-1 is being processed.

    She can visit wherever she wants as the K1 is being processed, it's only once she enters with the K1 that she must stay in the US until she is given her greencard or travel permit (3-6 months).

    Just to elaborate on what Gemmie wrote, she can attempt to visit US (though she isn't guaranteed entry) while the K-1 is in process. Chances of entry to the US on a tourist visa while K-1 is processing are decreased somewhat, because the K-1 shows immigrant intent. That said, many people have visited successfully. Your question, which she addressed, pertained to Germany; visits to anywhere but America should not be affected by the K-1 application (I know pushbrk is going to bust me for writing application instead of petition - neener, neener! :lol: ) and likewise, the visits should not cause any good or bad effect for the K-1 app... app... alright, petition.

    What she needs to travel outside the US is called Advance Parole, or AP. This is the relevant portion of the FAQ:

    6.7)...Can my spouse leave the United States, and then re-enter, before receiving the Green Card (conditional permanent residency)?

    A...The spouse cannot re-enter the US unless they have "advance parole" authorization (application form I-131). Advance parole allows you to re-enter the US before approval of Adjustment of Status. Without advance parole approval, leaving the United States is considered an abandonment of your application for Adjustment of Status. Without advance parole approval, the USCIS (INS) will consider you an intending immigrant without a valid visa, and you will be denied entry. If you do not apply for advance parole when you file for Adjustment of Status, contact your local USCIS (INS) office to find out how long it takes them to issue Advance Parole. Although advance parole is supposed to be issued to anyone who wants it for any reason at all, some local USCIS (INS) offices may take weeks or months, and may require proof of a serious emergency.

    If you have left the US without advance parole approval, you will most likely have to apply for a "spousal visa" (I-130 Petition for Alien Relative) to re-enter the US. This can take months. Any other legal remedies through US Consulates will be time-consuming as well.

    As has already been pointed out, if you've both lived in Japan for a long enough period of time, it would be more efficient for you to marry now and do DCF - direct consular filing for a spousal visa. But only the two of you know whether this would be applicable to your relationship, or if this would be rushing things.

The slick, over-produced Madison Avenue candidacy that gave us such silliness as "the office of the president-elect"?

  14. Wow, quite a step forward for Hyundai - I remember the original Excel which was also produced for Mitsubishi and sold as the Precis! There were oodles of them around, but the metallurgy (combined with the cavalier maintenance this price point attracts) ensured that they're a rare sight nowadays.

    Does the new Genesis look pretty sweet? You betcha! But I do think it's going to be a hard sell these days, compared to something like a used LS400 - which is proven technology, lasts a long time, and depreciates pretty quickly to boot. Nice LS's are going for well under 10 grand these days.

  15. Okay, in case you want to cancel the visa you have to send the whole visa package and your passport back to the Consulate. They will then cancel it. I have received my passport today and my visa is NOW cancelled =) "Cancelled without prejudice". YAY!

  16. All I can say is, I hope that I am totally wrong about him. I think I speak for a lot of people in saying that.

    When America chose Obama, it was the presidential equivalent of those poor souls who come here and say "I don't really know anything about her, but I am absolutely positive it's true love... isn't it?"

    Once in a while, it really is. And for the sake of my family, my country, and the free world, I hope this is one of those once in a whiles. But... that's not the kind of hope we were hoping for.

    I'm still missing something here. Do you currently live in the US, or in the Philippines?

    Being a nurse isn't going to cause a problem for your petition. However, if you already live here, the two of you are probably better off doing AOS than a K-1.

  19. as far as children are concerned in the marriage, we have already agreed not to have any because both of us feel that it would be a must to raise the child in our own faith... :) I know, always shocks everyone, but it's one of those decisions you make in life for better or worse.

    Oh, it's not shocking. But what happens if the birth control fails?

    I know that's quite a personal question, and you don't have to announce your answer here. But unless you're well and truly infertile (i.e. hysterectomy), "we have already agreed not to have any" is a bit simplistic.

    According to MDConsult's drug info for typhoid vaccine, no mention is made of typhoid vaccination protecting from anything besides typhoid itself.
