I can not believe the IRS. Just depends on who you talk to. IRS told me to file as married. Spouse will not get SSN until in America. You can file and fill out a W-7, Application for ITIN, Individual taxpayer I D number. There are Instructions on how to fill it out, on the web, and ID requirements. Basically if your SO has passport, they need to get a photocopy and an apostille in home country and bring to USA or send to you. That is the only stand alone document you can use. Then you have to attach all that to your tax return and send it in. (Not electronically). Once the IRS assigns the ITIN, they will put that on the return themselves and process it. Another way is to get US notary stamp, but that is usually $40 a pop per document. That is not the same as a general notary at any bank or car dealership, by the way.

Where can I get US notary stamp? can I get it from the post office?

I just came back from the IRS office, I had my W7 , the sworn statement and a photocopy for my wife's passport plus my complete 1040 form. the lady said they need to see her actual passport. even a notarized copy is not acceptable. she said if I have the Notarized copy of her pasport I only can send the forms by mail. but, even if I get a certified copy of her passport and I mailed all these form, what would be left for me to sent it to NVC? I was hoping to get a copy of my submitted 1040 to send it to NVC.
I dont know what to do!! I was hoping that I can file Married filing jointly and get a 1040 copy to send it to NVC. I have everything ready (2005, 2006, 2007 transcripts) except my 2008 taxes. Please let me know what should I do to get this done with.

When you send your 1040 attach W7 with that. I am going to do it this way and I have to get my wife's copy of passport notarized.
just question, how you are going to get the pasport copt notarized if you wife in not in the US?

Anyone know how long it'll take to receive the AOS fee bill in the mail? I want to pay the fee so I can mail in the I-864 stuff! I can NEVER get through at NVC...seems like everyone is calling all at once! Still no 'acceptance' of DS-3032...still waiting on that. Oooh I hope this all goes much quicker!

wow..... didn't think that would be such a touchy question but thanks He hasn't been in the u.s. for the '08 year will be here in 5 days he had 0 income last year and i claimed head of household and single cause the w2 said if they are a non residant alien i couldn't count them. i am a single mother sharing joint custody of two kids. ( I am claiming one the ex the other). So when he gets his SSN and I file the return I can claim joint or file as a dependant (sorry if i am stepping into something) just seeing my options and getting information cause it looks like either way can work.
If you were married in 2008, you can file MFJ for tax year 2008 (filing deadline of April 15, 2009). Your spouse does not have to be present in the USA at any time during the year. With him having zero income, it would save you money to file MFJ vs. HOH (you can calculate your savings using the tax table - http://www.irs.gov/pub/irs-pdf/i1040tt.pdf)
Additionally, your spouse cannot be claimed as a dependent. They are a spouse and receive an exemption, same as you, when you file MFJ.

John, thank you so much for the info. it is exactly my case. I am a US Citizen and my wife never been in the US. we got married in 2008. so I am going to file Married filling Jointly. I know I have to attach W_7 form signed by my wife with my 1040 form. do you know what else i should attach with 1040 form?

a touch means your file is moving from the draw to the officer disk or vice versa. so, it is just an indication that your file didnt get lost somewhere. you applied in CSC which is much faster than VSC . you will got you approval in couple more month. hopefully sooner.check my time line and signature it might give you an idea. apparently, CSC employees don't go by the the oldest date on the files, they go by they order they randomly slam it to their desks. I hope all June and august get approved this week.

Aman, you mentioned that, you have an REF requesting your 2008 W2 form. so, I figured I should sent my 2008 W2 form to avoid having the same REF. you next post you posted that, the reason of you REF was sending 2008 W2 form, which is contradicting you prevous post!!. I am so worried they will ask me for 2008 returm because I sent them the 2008 W2 form. So, I am thinking to call NVC today and ask them to disregard 2008 W2 form, or consider it as a proof of current employment. any Ideas?
