    I just found this thread, I hope I'm not to late. I'm also an august filer. I sent my AOS package on August 13th, so far I had my bio done and an interview schedule for january 21st, 2009. But my case is very complicate as you can see on my timeline, but with the grace of God I will get through it. I will keep you posted, may God bless you and yours. Happy Holidays!!!

    Hi, i have a case like yours. I don't understand how you can file AOS without having the i130 approve. My case was forward to the local office to schedule a date for the i130 interview but i was told by my lawyer there is a possibility i can get arrested at the interview since i did not leave voluntarily. I also have a son and i am a college graduate with 2 degrees, am so worried of losing my family.

    Why dont you PM me or send me an email so we can talk and exchange ideas. In my case also there is a possibility I can get arrested, but my attorney and many others people already have a plan in place just in case. Get a hold of me so we can chat. But always remember this, doesnt matter what anything is possible through God. Looking forward to hear from you.

    :help: I have an interview for my I-485 on January 2009 with an IO, I was granted VD back in 2002, appeal dimissed by the BIA in 2004. My previous lawyer filed for I-130,I-485,I-601, and I-765 in August 2008 (Now after reading, researching and talking to people who knows more about immigration laws I found out that it was a big mistake to file all of them together, specialy the I-601). I had my bio done, it's over 90 days now I still havent got EAD. The date of my I-130 havent change online since the first time I saw it, now over 4 months. Also I have a motion to reopen pending with the BIA since December 1st filed last month by my new lawyer. What are my options? What should I do? Is it possible to have an I-485 interview with an IO while in removal procedings? Without the I-130 approve? If need of any clarifications, please feel free to ask me. Thank you in advance for all inputs. :help:

    Thank you so much. Yes I will be honest with them, nothing to hide. I just hope the person interviewing me got a good heart. My living child is the light of my life. Also I have a college degree. And you are so right, anything is possible with God. I just hear so many things, like when you are not supposed to be here, you could be arrested at the interview, but I also hear that if the interviewer is nice he or she might not bring anything up and just approve you.I see that you have the france flag, that's where you are from? Again thank you.

    Thank you again. Do you have Laurel Scoot contact information? Yes the lawyer thought it was a good idea to file the I-130, I-485, I-601 and I-765 all at once. I was event told that it was the wrong way to go, that a motion to reopen was the best way to go for me. Yes my timeline is so mess up, i just want this over. Thank you so much, it means the world to me for you giving me your inputs.

    Thank you for your question. Yes my I-485 is pending for the same period of time because i filed all of them together. I rescheduled my bionetrics appointment for the I-485 and I-765 many times because i was told i can be arrested and deported if i go to it. Yes i have an attorney who told me to look for another one who deal with deportation case and stuuf...I'm so lost. Please let me know if you have any other questions or advices. Again thank you.

    High school from January 2000 to June 2002, played basketball (Graduated)

    Applied for asylum in June 2000 by advise

    IJ denied my asylum in September 2002 (Granted Voluntary Departure)

    Appeal filed in October 2002 (BIA)

    Married an US citizen in August 2003

    oBad marriage (Arranged by my college basketball coach)

    oLawyer lied about applying for marriage petitions, but actually never did.

    Appeal dismissed in February 2004

    Separated in June 2005

    Divorced in July 2006

    Death of a son in July 2006

    Remarried in August 2006

    Son born in September 2007

    College from August 2003 to May 2008, played basketball (Graduated)

    Filed in August 2008 and pending (I-130, I-485, I-601, I-765)
